The meeting was called to order by the Mayor.
The roll was called and Councilmen Brown,Christensen,Magagnos,Bullock,Noy,Gee,
Probst,Fisher and Loop,(9),were noted present and none absent.
The minutes of the meeting of February 15th 1909,were read and ordered approved.
Claims against the General Fund amounting to :i400.50;against the Police Fund amount-
ing to :;'35.15;against the Fire Fund amounting to ij,422.25;against the Street Fund amounting
to '665.53;against the Electric Light Fund amounting to tip the Library Fund,
amounting to '',569.36 and against Municipal Improvement Fund No.8,(Park & Playground)
amounting to 0.50 having been approved and audited by the proper officials were read by

Mr.Bullock moved that the claims as read be paid,seconded by Mr.Noy and carried

Mr.Bullock called the attention of the Council to the death of E.Minor Smith
Assessor and Auditor on Friday,February 19th and offered the following memoriam:
The Council of the City of Alameda in regular meeting assembled on this 1st day
of March,A.D.1909,remarks the vacant post of City Auditor and Assessor and bows to the
inevitable call which ever must be heeded.
He whose best life efforts were given patiently and modestly,and with wisdom and
impartiality in the daily decision of that which is most important between the citizen
and his government,has now been called to meet that final assessment which is levied
but once on all that lives and has paid his willing tribute to the supreme tax gatherer.
Therefore this Council pauses in its deliberations and gives these lines of sincere
regret for the passing of this man whose hand has writ,year in,year out,with precision
and with zeal the archives of the village,of the town and of the city.
"The moving finger writes,and having writ,
Moves on;nor all your piety nor wit,
Shall lure it back to cancel half a line,
Nor all your tears wash out a word of it."
A true gentleman in the broadest sense,a public officer sure of the simple satisfrc-
tion of duty well fulfilled,

Mr.Bullock moved, its adortion,seconded by Mr.Noy and carried by a rising vote of
all the members of the Council.
A communication was received from the Mayor in which he announced the appointment
of Fred J.Croll to the office of Auditor and Assessor,to fill the unexpired tern of
R.ivlinor Smith, Deceased, Mr .Noy moved that the arpointment be confirmed, seconded by
carried by the following vote. Ayes :Councilmen Brown,Christensen,,J gagnos,Bulloch,NoL,,
Gee,Probst,Fisher and Loop, (9).

The Clerk reported that Fred J.Croll had taken the Oath of Office and had filed
his bond in the sum of 5000.00 with the United States Fidelity and Guaranty Company as
surety and that the City Attorney had in writing approved the same. Ordered filed.
Plant for the month of January,1909. Ordered filed.
A certificate was received from J.Eugene Freeman the Architect for the new fire
house on Webb Avenue certifying that the third payment of 0000.00 was due the Contractor
under the terms of the contract. Ordered filed.
A communication was received from the Finance Committee stating that 860.00 had
been paid out of the Street Fund toward improvement of the Webster Street 'Roadway which
should. rightfnlly be paid out of the Municipal Improvement Fund No.8,(7ebster St.P.oadway)
and recommending that said amount be transferred from said Improvement Fund to the Street
Fund. Er.Bullock moved that the Clerk be directed to notify the Auditor and the City
Treasurer to make the necessary transfer on their books,seconded by Mr.Noy and carried
by the following vote. Ayes :Councilmen Brown,Christensen,Magasnos,Bullock,Noy,Gee,
Probst,Fisher and Loop, (9). Woes :None. Absent :None.
A communication was received from Walter E.Rode,Attorney for the Baker Advertising
Company protesting against the license tax that said Company was being taxed for bill-
boards. The same was referred to the Committee of the Whole.
The following applications for gratuitous licenses were presented
From Lary Lehan to sell trinkets from house to house and from Wood and harsh to
sell garden racks from house to house. Mr.Masagnos moved that the applications be
granted,seconded by Mr.Fisher and carried.
A protest against the garbage crearnatory at the north end of Chestnut Street was
received from C.A.Borle and many others. The Clerk was directed to address a communica-
tion to the Hart Heat & Power Company directing them to abate the nuisance.
A petition was received from the Alameda Wheelmen requesting permission to conduct
a bicycle race on March 14,1909,over certain streets of the city. Mr.Hagagnos moved
that the request be granted,seconded by Mr.Probst and carried.
A communication was received from the Police & Fire Commission requesting permission
to purchase for the Police Department a complete finger print outfit at a cost of 200.00.
Mr.Probst moved that the request be granted,seconded by Mr.Gee and carried by the follow-
ing vote.

A communication was received from the Police & Fire Commission requesting authority
to appoint two Auto-engineers at a salary of 100.00 per month each. Mr.Probst moved
that the authority be given to take effect when the engine was purchased by the city and
provided, that the men who would be appointed and while being instructed in the workings
of said engine would be paid by the makers of the same and were not to be considered as
in the employ of the city, seconded by Mr.Yegagnos and carried by the following vote.
Ayes :Councilmen Brown,Christensen,Magagnos,Prohst,Fisher and Loop,(6), Noes ;Councilmen
Bullock, Noy and Gee, (3). Absent :None.
Applications were received from Samuel Orr and James A.Collins for the appointment
of Building Inspector. Ordered filed.
The matter of the electroeliers laid over from the last meeting was taken up and
the Clerk directed to notify the Board of Electricity that, it was the desire of the
Council to erect no more of such poles except the three that still remained to install.
.Magagnos brought up the matter of keeping the books of the Electric Light Depart-
ment and suggested that the City Attorney take steps to have the Charter amended so as
to arrange for same. Mr.Probst moved that the matter be referred to the City Attorney,
seconded. by Mr.Magagnos and carried.
The matter of the wharf and obstructions at the north end of Oak Street as occupied
by the 7larden-Meeker Company laid over from the last meeting was taken up and referred to
the Street Superintendent,City Engineer and City Attorney'.
A communication was received from the Alameda Improvement Club requesting he
Council to take steps looking to the improvement of the east side of the Webster St.
Roadway. The same was referred to the Committee of the Whole.
A communication was received from the Police & Fire Commission stating that the
Auto Fire Engine made by the Waterous Engine Works Company of 3t.Paul,Minn.,had been
delivered to the City,that they had had the same examined and tested,and that they had
found that it complied with the contract and therefor recommended its purchase. Ac-
companying the recommendation were reports from the Engineering Department of the
Board of Fire Underwriter's and of two automobile engineers. After discussion Mr.
Foy moved that the matter be referred to the Committee of the Whole,seconded by Mr.
Brown and carried.
Mr.Christensen offered the following resolution and moved its adoption:
Whereas request has been made and good cause therefore appearing,
RESOLVED that the Street Mperintendent be and he is hereby authorized and direct-
ed to grant 30 days extension of time on contract for the performance of Street Work to
Robt.R.Smith on his contract to construct a sewer in Encinal avenue between Park Avenue
and Regent Street under Resolution of Intention No.728 provided tha17 in no event shall
any liability accrue by reason thereof against said city or officials.
The resolution was seconded by Mr.Noy and adopted by the following vote. Ayes:
Councilman Brown,Christensen,Magagnos,Bullock,Noy,Gee,Probst,Fisher and Loop,(9). Noes:
None. Absent :None.
Mr.Brown was excused and retired from the meeting.
The Clerk presented affidavits showing due publication and posting of Notice of
Street Work inviting Proposals therefor and reported that one bid had been received for
the work as set forth in Resolution of Intention Yo.730. The bid was from Hutchinson
Company and was ordered received and opened and was read as follows
For grading,two and seven eighths cents 2-7/8 cents per square foot.
For Macadamizing,eight and nine-tenths 8-9/10 cents per square foot.
For Gutters of broken rock grouted with cement fifteen cents 15 cents per square foot
For Straight Curbing concrete 8"X 14" forty nine cents 49 cents per linear foot.
The City Engineer reported that the prices quoted were reasonable and thereupon
Mr.Christensen offered the following Resolution and moved its adoption:
Resolved,That the Council of the City of Alameda,having in open session on the 1st
day of March,1909,opened,examined and publicly declared all sealed proposals and bids
for the following street work in said city,to wit: That the northern half of Fountain
Street from the northeastern line of Santa Clara Avenue to a right line 120 feet right-
angular measurement easterly from and parallel with said line of Santa Clara avenue,be
improved as follows: That the northern half of said street between said limits be
graded to the official gra#e;that concrete curbing eight inches by fourteen inches in
cross section dimension,be constructed two inches above the official curb grade on the
curb line of said street between said limit ;that a cement grouted rock gutter,three
feet in width,of the flat pattern,be constructed in the roadway of said street between
said limits,contiguous to said curbing;that the remaining portion of said roadway in
the northern half of said street,between said limits,be macadamized with a layer of
broken trap rock eight inches in thiciess,hereby rejects all of said bids except that
next herein mentioned and hereby awards the contract for said work to Hutchinson Com-
pany they being the lowest responsible bidders therefor,at the prices specified in
their bid therefor on file to wit:
For grading 2-7/8 cents per square foot
For Macadamizing 8-9/10 cents per square foot
For Gutters 15 cents per square foot
For Straight Curbing 49 cents per linear foot.
The City Clerk is hereby directed to post Notice of this Award conspicuously for
five days near the Chamber door of this Council and to publish said notice for two days
in the Alameda Daily Argus,newspaper.
Er.Noy seconded the Resolution and it was adopted by the following vote. Ayes:

Lr.Christensen offered the following Resolution:
RESOLVED,that the City Engineer be and hereby is directed to make Plans,3pecifications
and quantity estimates for the following Street work to be done in said City mely:
That Dayton Avenue from the eastern line of karu Street to a right line parallel with
and im 273 feet,right angular measurement easterly from the eastern line of Grand Street,
including the crossing of Grand Street with Dayton Avenue,be improved as follows; That a
'
salt-glazed,vitrified iron tone sewer six inches/,inside diameter with four inch Y-branch-
es and without house connections,be constructed in said Avenue from the existing manhole
at said crossing of Grand Street,in a right line to a manhole which shall be construct-
ed hereunder at a point in the center line of said Avenue 300 feet easterly from said
existing manhole at the crossing of Grand Street;that said manhole to be constructed here-
under shall be of Brick marionry,with cast iron top and cover and eight inch walls and
bottom,and shall be constructed in accordance with "Plan of Brick Manhole",adopted by the
Board of Trustees of the City of Alameda,January llth,1897,and on file in the office of
the City Clerk of said City,which plan is hereby referred to and made a parthereof.
That the entire width of said avenue between said limits be graded to the official
grade,and that the crossing of Grand Street with said avenue be regraded to the official
'ade;that concrete curbing,8 inches by 14 inches in cross section dimension,be construct-
ed 2 inches above official curb grade on on all curb lines of said avenue between said li-
mits,and on the four curved corners,at said crossing of Grand Street with said avenue;
that cement grouted rock gutters 3 feet in width,of the flat pattern,be constructed on
each side of the roadway of said avenue between said limits,contiguous to said curbing
and to said curved corners;that the remaining portion of the roadway of said avenue between
said limits be macadamized with a layer of broken trap rock,8 inches in thickness;that
2 gutter bridges 5 feet in width,and of pine lumber,be constructed at each of the four
corners of said crossing of Grand Street with said avenue;and that two cast iron culverts
imbedded in concrete be constructed across said avenue,one in the western and one in the
eastern side of said crossing,as per Resolution of Intention No.729 adopted by this Coan-
cil,January 4,1909,and that the Clerk be instructed to notify the City Engineer of the a-
doption of this resolution.

The City Engineer presented plans,specifications and quantity estimates for the
above work and thereupon the following Resolution was affered by Mr.Christensen.
RESOLVED,That the Plans,Specifications and quantity ,imates furnished by the
City Engineer of the City of Alameda,to this Council for the following Street work to be
done in said city,namely:
That Dayton Avenue from the eastern line of Paru Street to a right line parallel
with and 273 feet,right angular measurement easterly from the eastern line of Grand Street

proved. And the Clerk is directed to file the same.
Mr.Christensen moved the adoption of the Resolution,seconded by flr.Noy and carried

LIr.Christensen offered the following resolution and moved its adoption:
WHERRAS,It appears to the satisfaction of this Council that Resolution of Intention
no 729 for the work of constructing a sewer in a nd the grading,curbing,macadanizing and
otherwise imnroving Dayton Avenue from the eastern line of Paru Street to a point 273
feet east of the eastern line of Grand Street in the City of Alameda,adopted by this
Council January 4th 1909,has been posted and published according to law,and that no legal
objection to the doing of said work has been filed with the City Clerk of said City.
RESOLVED,That the public interest and convenience require and the council of the
City of Alameda,hereby orders the following described street work to be done in said city
according to the plans and specifications adopted therefor,namely: That Dayton-Avenue,
from the eastern line of Paru Street to a ri htline parallel with and 273 feet right
angular measurement easterly from the eastern line of Gran a Street including the crossc;
ing of Grand Street with Dayton Avenue be improved as follows: That a salt-glazed,vitri-
fied,iron-stone sewer,six inches in inside diameter with 4-inch Y-branches and without
house connections be constructedin said avenue from the existing manhole at said cross-
ing of Grand Street in a right line to a manhole which shall be constructed hereunder
a point in the center line of said. avenue 300 feet easterly from said existing mang
hole at the crossing of Grand Street:that said manhole to be constructed hereunder shall
be of brick masonry with cast iron top and cover and eight inch walls and bottom and

ter bridges five feet in width and of pine lumber be constructed at each of the four cor-
ners of said crossing of Grand Street with said avenue ;and that two cast iron culverts
imbedded in concrete be constructed across said avenue onein the western and one in the
eastern side of said crossing.
The Clerk of this City is hereby directed to publish this resolution for two days
in the Alameda Daily Argus a daily newspaper published and circulated in this city and
which is hereby, designated for that purpose he is also directed to post conspicuously
for five days near the chamber door of the said Council notice of said work with spec-
ifications inviting sealed proposals or bids for doing the work ordered and to publish
notice of said work inviting sealed proposals or bids for doing the work and referring to
the specifications posted or on file also for two days in the Alameda Daily Argus the
newspaper hereby designated for that purpose. Both of the said notices shall require
a certified check or a bond either as described by law and for an amount not less than
ten percent of the aggregate of the proposal and shall. name Monday the 15th day of March,
1909,as the day hereby designated on which up to the hour of 8 o'clock P.M. the said
proposals or bids shall be received.
Mr .Noy seconded the resolution and it was adopted by the following vote. Ayes:

A communication was received fronS.T Rice,Chairman of the East End Improvement
Club requesting the use of the Council Chamber as a meeting place for said club.
Mr.Loop moved that permission be granted for Friday evenings,seconded by :,:r.Magagnos
and carried.
In the matter of the recommendation of the Mayor that the patent lines along the
southern and eastern shore be established a communication was received from I.U.Chalman
City Engineer that the work would cost about 3400 .00. The matter was referred to the
Committee of the Whole.
Mr.Christensen introduced A Bill entitled "A Bill for Ordinance No. tab-
lishing the Salaries of Certain Officers of the City of Alameda.",which was laid over
under the provisions of the Charter.

A Bill entitled "A Bill for Ordinance No. Fixing the Salary of the City Clerk",
introduced February 15th 1909,by Mr.Fisher came up for passage and was read by the Clerk,
Mr.Fisher moved its adoption,seconded by Mr.Bullock and carried by the following vote.
Ayes :Councilmen Christensen,Magagnos,Bullock,Noy,Gee,Probst,Fisher and Loop, (8). Noes:
None. Absent :Councilman Brown,(1).
Mr.Probst moved that the Clerk be directed to notify the advertising companies
to remove the bill-boards located on the property recently purchased for school pur-
poses at Eighth and Santa Clara Avenue,seconded by Tr.Loop and carried.
Mr.Probst brought up the matter of the lack of Police protection in the west end
of Alameda and moved that the Police & Fire Commission be requested to make arrangements
so as to have a patrolman on Webster Street at all times,seconded by Mr.Loop and carried.
A communication was received from the Mayor regarding the enforcement of laws for
the protection of fish and game within the limits of the City,and recommended the passage
of an Ordinance which would prevent seine fishing within the City limits. The matter -
was referred to the City Attorney.
A communication was received from the Mayor stating that the Meeker-Warden Co.,
were willing to abandon any claim they may have to any portion of Oak Street and the
wharf at the north end of said street in consideration of the city taking charge of the
wharf and paying them the cost of construction in accordance with the previous agreement,
and recommending that the grade of the north end of Oak Street be established and that
it be graded,curbed,macadamized etc.,and thereupon Mr.Christensen introduced A Bill en-
titled "A Bill for Ordinance _No. Fixing the Official Curb Grade of Oak Street from
Blanding Avenue to the U.S.Tidal Canal",which was laid over under the provisions of the
Charter.
A communication was received from the Mayor regarding the opening of the north
side of Alameda and the obtaining of a right of way for a railroad along what would be
the westerly extension of Blanding Avenue and recommending that immediate action be
taken to secure such right. The matter was referred to the Committee of the Whole.
A communication was received from the Mayor regarding the water supply for the
parks and the conditions of the wells located on the Thompson and on the Waymire tracts,
and recommending the installation of an electric motor at one of the wells on the Way-
mire tract and also t the artesian well at Lincoln Park and that a well he bored
the park at 7ighth Street and Central Avenue. Mr.Noy moved that the matter he refer-
red to the Park And Playground Commission,seconded by Mr.Christensen and carried.
The matter of the opening up of Clement Avenue was taken up and discussion had
regarding what would be best as regards width,etc.,7)ut no action taken.
There being no further business to transact the Council adjourned until the next
