The minutes of the regular meeting of April 5th were read and ordered approved.
The minutes of the adjourned regular meeting of April 7th were read and ordered
ova d.
Councilman Probst arrived and was noted, present.
Claims against the General Fund amounting to 343.15;against the Police Fund amount-
ing to 250.55;against the Fire Fund amounting to 51398;against the Street Fund amounting
to 359.15;against Municipal Improvement Fund No.8,(Park & Playground) and against Muni-
cipal Improvement Fund. No.8,(Fire) having been approved by the proper officials were read
by the Clerk as follows:

An affidavit of Publication was receiveaAshowing ue Iublication or a list of the
candidates for election at the General :funicipal Election held on April 12th,1909. Or-
dered filed.
A communication was received signed by the Mayor,Auditor and City Clerk certifying
that they had on this date counted the money in the hands of the City Treasurer and
found the amount to be '!148,771.01 and in addition the sum of 32,i66.07 which had been
received by him but which had not be apportioned as yet. Ordered filed.
A report was received from Mayor Taylor reporting on the condition of the affairs
of the City and on the achievements of the administration during his term of office dur-
ing the past two years,which was read at length by the City Attorney. The same was or-
dered
placed on file.
Mr.Fisher moved that the Council proceed to Canvass the returns of the election of
April 12th 1909,seconded by Mr.Ballock and carried and thereon the Clerk proceeded to
open the official returns and the result was found to be as set forth in the table
spread on the minutes on the next page of this record;-

RESOLVED that from the canvass of the votes
cast at the Municipal Election of April
1909,it appears that the following named persons received a majority of the votes cast for the
respective offices for which they were candidates and they are hereby declared to be elected
for the ensuing terms for said offices,as follows:
- -Mayor
Fred J.Croll Auditor and. Assessor
John H.Walker Councilman at Large
Fred L.Erumb Councilman from the First 7ard
Edward. D.Ells -Councilman from the Third. Ward
- -Councilman from the Sixth Ward
Also that the proposition to adopt the provisions of the Charter relating to the establish-
ment of a Teachers Annuity Fund,failed to receive a majority of the votes cast on said preposi-
tion and the same is hereby declared to have failed of adoption.
Also that the proposed Ordinance prohibiting the issuance of Liquor Licenses in any pre-
cinct without a previous vote in favor of such licenses therein failed to receive a majority of
the votes cast thereon and the same is hereby declared to have failed of passage.
Also that the proposition for grantirv, Liquor Licenses in the several precincts
affirmatively received, a majority of the votes cast in each precinct,said proposition
declared to have been carried and adopted in each of said precincts.
Mr.Bullock seconded the resolution and it was adopted by the following vote.
Councilman Brown,Christensen,Magagnos,Bullock,Gee,Probst and Fisher,(7). Noes:None.

A communication was received from William H.Noy in which he tendered his resignation
a member of the Council of the City. Mr.Bullock moved that it be accepted,seconded by Mr.

Councilman from the Fifth Ward to fill the vacancy caused by the resignation of William H.
Noy. Mr.Bullock moved that the appointment be approved,seconded by Mr.Probst and car-
ried by the following vote. Ayes:Councilmen Brown,Christensen,Magagnos,Bullock,Gee,Probst
and Fisher,(7). Noes :None. Vacancy: One. Absent :Councilman Loop, (1).
A communication was received from the Ma or in which he suspended Poundmaster A.Ewing
and appointed John J.:Lay in his place and stead until final action by the Council,also set-
ting forth the charges of conduct unbecoming an official of the City, Ordered filed.
At this point the outgoing members of the Council,Me srs M.W.Brown,C.P.Magagnos,and,
R.S.Gee and excepting F.S.Loop who was ahsent,withdrew and the incoming members Messrs
Fred. L.Krumb,Edward D.Ells,Sumner Crosby and. John H.Walker presented themselves and the oath
of office having been administered to them by the Clerk they assumed their seats, There-
upon William H.Noy took the oath of office from the Clerk as Mayor and called the Council
to order as re-organized.
Ex-Mayor Taylor tendered Mayor Noy an address of Welcome to which Mayor Noy respond-
ed in a few well chosen words. The roll was called and Councilmen Christensen,Walker,
Krumb,Hammond,Crosby,Ells,Fishe ,Probst and Bullock,(9),responded and were noted present.
W.H.L.Hynes addressed the Council and lobby on behalf of the citizens of the City
which was answered by ex-Mayor Taylor and Mayor Noy.
Auditor Elect Fred. J.Croll presented himself and was sworn by the Clerk.
Mr.Crosby nominated'Mr.Bullock for president of the Council,seconded by Mr.Chris-
tensen as their were no other nominations the same were declared closed,and thereupon the
roll was called and Er.Bullock was elected by the following vote. Ayes :Councilmen
Christensen,Walker,Krumb,Hammond,Crosby,Ells,Fisher,and Probst, (8). Noes :None. ffot

Mr.Walker nominated. E.B.Bullock,as Chairman and Summer Crosby and P.Christensen as
members of the Finance Committee, seconded. by Mr.Ells,as there were no further nominations
the same were declared closed,and thereupon the roll was called and the Councilmen named
were elected by the following vote. Ayes :Councilmen Christensen,alker,Krumb,Hammond,
rosby,Ell ,Fisher and Frobst,(8).

A communication was received from the City Clerk in which he notified the Council
that the terms of office by appointment of himself,as City Clerk,V.E.Frodden as Street
Superintendent,7..Maslin as a member of the Board of Trustees of the Free Public Library
and. Dr.J.Emmett Clark as a member of the Board of Health would expire on the 22nd day of
April 1909,and that the term of office of I.U.Chayman as City Engineer would expire on the
26th day of Apri1,1909. Ordered filed.
Mr.Probst moved that Frank E.Browning be appointed. City Clerk for the ensuing tern,
seconded by Er.Bulloch and carried by the following vote. Ayes :Councilmen Christensen,
Walker,Krumb,Hammond,Crosby,Ells,Fisher,Probst and Bullock,(9). Noes :None. Absent:
None.
Mr.Christensen moved that V.M.Frodden be appointed Street Superintendent for the en-
suing term,seconded by Er.Krumb and carried by the following vote. Ayes :Councilmen
Christensen,Walker,Krumb,liammond,Crosby,Ells,Fisher,Probst and Bullock,(9). Noes:None.
Absent :None.
A communication was received from Mayor Noy in which he appointed I.N.Chapman,City
Engineer said appointment to date from April 26th 1909. Mr.Probst moved that the ap-
pointment be approved by the Council,seconded by Mr.Fisher and carried by the following
vote. Ayes:Councilmen Christensen,Walker,Trumb,Hammond, rosby,Elle,Fisher,Frobst and.
Bullock,(9).
Noes :None. Absent :None.
Mr.Ells moved that E.W.Easlin be appointed a member of the Board of Trustees of
the Free :Public Library, seconded by Lr.Probst and carried by the following vote. Ayes
Councilmen Christensen,C;alker,Yrumb,Hammond,Crosby,Ells,Fisher,Probst and Bullock,(9).

A communication was received. from Auditor & Assessor Fred J.Croll in which he ap-
pointed Ernest ::layrisch as Deputy Auditor and Assessor. Er.Walker moved that the ap-
pointment be approved,seconded by Mr.Ells and carried by the following vote. Ayes:
Councilmen Christensenalker,Krumb,llammond,Crosby,Ella,Fisher,Frobst and Bullock, (9).

A verified, statement and claim was received from E.U.Derby t Co against J.M.Boyd,
Contractor for materials furnished by said Company to said J.E.-)oyd to be used in the con-
struction of the Fire House on the south side of Webb Avenue between I'ark and Everett
3treets showing a balance due the said Company of Ordered filed.
A communication was received from the National Lastic Roofing Company stating that
they had a claim against J.1,.1.Boyd the Contractor for the Fire House on \7ebb Avenue and
notifying the Council to withold the sum of :55.00 from payment to said Boyd. Ordered
filed.
A communication was received from John Biddle,Lieut Colonel Corps of Engineers
U.S.A.regarding the leasing of the water front on the tidal canal. Ordered referred to
the Committee of the
A communication was received from J.U.Young acknowledging the receipt of a commun-
ication from the Clerk with relation to the alarm bell at the junction of the rail-road
right of way and Everett and stating that the matter would be investigated and a later
report made. Ordered filed.
A communication was received from the Oakland Traction Co.acknowledging receipt of
communication from the Clerk with relation to the re-construction of the roadway of their
tracks on San Jose Avenue and stating that they would commence the work within ten days.
Ordered filed.
A communication was received from the Police and Fire Commission with reference to
the placing of a hydrant at the corner of Buena Vista Avenue and Pearl Street as peti-
tioned for by esidents of that neighborhood, stating that a hydrant could not be placed
at the said corner but that the Chief of the Fire Department had asked to have one in-
stalled at the corner of Lincoln and Pearl. Orderedfiled.
A communication was received from the San FranciscoAaccpmpanied by a large photo-
graph of a vellsel unloadin
at their wharf at the foot of Walnut Street and telling of
the improvement that they contemplated making along the water front of their property.
Ordered filed and the Clerk directed to acknowledge receipt of the photograph with the
thanks of the Council.
A communication was received from the Police and Fire Commission stating that as
the Police Department was virtually supported by the fees collected for licenses,that all
future application for gratuitous licenses be referred to them for investigation before
issuance by the Council. Referred to the Committee of the Whole.
The following persons made application for gratuitous licenses
a'.Handelsman to sell a piano and furniture polish to business houses and office
buildings;Nathan Vineburg to sell ice cream on the streets from a wagon and from H.C.
Ballheimer to conduct a small notion store at the N.E.corner of 6th Street and Central
Avenue. Ordered referred to the Committee of the Whole.
A communication was received from the East End Improvement Club recommending that
an Oak tree growing in the street on High Street opposite an Buren Street be removed,
claiming that it was an obstruction and a menace to the safety of the rublic. The same
was referred to the Park and ilayground Commission.
A petition was received from Hutchinson Comany requesting permission to grade,curb,
gutter and macadamize Santa Clara Avenue between Fountain and High Streets. :Referred to
the Committee of the Whole.
Mr.Christensen offered the followinp: resolution and moved its adoption:
RESOLIED, That the public interest and convenience require and that it is the intent-
ion of the Council of the City of Alameda to order the following street work to be one in
said city,namely: That Jay Street from tie northern line of Pacific Avenueto the southern
line of Eagle Avenne,exceptinp: the crossing of 73uena Vista Avenue with Jay Ttreet,be im-
proved as follows : That the entire width thereof hie graded to the official grade ;that con-
crete curhing,eight inches by fourteen inches in cross section dimension,be he constructed
on the cur lines of said street ;that cement grouted rock gutters,three feet in width, of
the "Flat" .attern,be constructed along the roadway of said street contiguous to said curli-
ing;that the remainifig portion of the roadway of said street be macadamized with 's. layer
of broken trap rock eight inches in thickness.
The Alameda Daily Argus is hereby designated as the daily newspaper published and
circulated in this City in which this resolution,ard the Street Superintendent's Notice
of the passage thereof, shall be published. The Clerk is hereby directed to publish this
Resolution by two successive insertions in said newspaper,and post the same for two days
conspicuously near the Chamber door of this Council.

Br .Christensen offered the following resolution and moved its adoption:
Resoltred,That the public interest and convenience require and that it is the inten-
tion of the Council of the City of Alameda to order the following street work to be done
in said city,namely:That Stanton Street from the northern line of Pacific Avenue to the
southern line of Buena Vista Avenue be improved as follows : That the entire width of said
street between said limits be graded. to the official grade ; hat concrete curbing, ght in-
ches by fourteen inches in cross section dimension,be constructed on the curb lines of
said
treet between said limits;that cement grouted rock gutters,three feet in width of the
"flat" pattern,be constructed along the roadway of said street between said limits con-

line of Santa Clara Avenue to a right line 120 feet easterly from and parallel with said
line of Santa Clara Avenue,done by Hutchinson Company under Resolution of Intention No.730;

A Bill entitled "A Bill for Ordinance No. Establishing the Office of Building In-
spector and Fixing the Salary of said Officer",introduced Atril 5th 1909 by 17 .Fisher came
up for passage and was read by the Clerk. Mr.Probst moved to amend the same by fixing
the salary at One Hundred and Twenty-five Dollars instead of One Hundred ])ollars,seconded
by Mr.hammond and carried by the following vote. Ayes :Councilmen Christensen,Walker,
