The Roll was called and Councilmen Christensen,Walker,Krumb,Hammond,Crosby,Ells, Probst and Bullock,(8),were noted present and Councilman Fisher,(1),absent. Mr.Bullock moved, that the claims as read be paid,seconded by Mr.Christensen and carried by the followitg vote. A retort of the balances on hand in the various funds was received from the Audi- tor for the month ending November 30th 1909. Ordered filed. Mr.Krumb offered the following Resolution and moved its adoption: Resolved,that the salary of W.McConnell,the engineer of the Road Roller used by the Street Department be raised from U5.00 to $100.o0 per month,the same to take affect and be in force from and after January 1st t2 2 1910. Mr.Probst seconded the resolution and it was adopted by the following vote. Ayes; Councilmen Christensen,Vialker,Krumb,Hammond,Crosby,Ells,Fisher,Probst and Bullock,(9). Noes :None. Absent :None. A communication was received signed by the Mayor,Auditor and City Clerk certifying that they had counted the money in the hands of the City Treasurer and found the sum of 063,865.44 and that the same agreed with the balance as shown by his books. Ordered filed. A communication was received from the Mayor in which he appointed,sybject to the approval of the Council,F.P.McLennan as a member of the Park and Playground Commission, vice Dr.F.W.D'Evelyn,term expired. Mr.Crosby moved that the appointment be confirmed seconded by Mr.Fisher and carried by the following vote. Ayes :Councilmen Christensen, Walker,Krumb,Hamnond,Crosby,Ells,Fisher,Probst and Bullock, (9). Noes:None. Absent: None. A communication was received from the Powell Bros. Construction Company, offering to put a reinforced concrete top on the present sea-wall at the foot of Oak Street and Laurel Street, at a price of Two ($2) Dollars per linear foot. Mr. Hammond moved that the matter be referred to the Street Committee with power, seconded by Mr. Christensen S. Army, stating that it was not in the province of the United States Government to pay for any part of the street improvement of Harrison Street, between the Park Street and Fruitvale Avenue bridges. Ordered filed. The matter of the application of Janitor Ward of the City Hall for authority to purchase a Vacuum Carpet Cleaner was taken up, and Mr. Hammond moved that the matter be referred to the Building Committee with power, seconded by Mr. Fisher and carried by the following vote. Ayes:Councilmen Christensen,Walker,Krunb,Hammond,Crosby,Ells,Fisher Probst and. Bullock, (9). Noes:None. Absent :None. A communication from F. H. Hearsch complaining of the license tax on dogs under six months of age was taken up. Mr. Krumb moved that the matter be referred to the License Committee with power, seconded by . Bullock and carried. A communication was received from E. R. Deming complaining of the street-car ser- vice from Oakland via Twentythird Avenue. Mr. Hammond reported that he had already communicated with the Traction Company and the communication was ordered filed. A communication was received from the Alameda Improvement Club stating that com- plaints had been made that 17ells Fargo & Company's Express and the Telegraph Company were making extra charges of twenty-five (25V) cents for delivery in certain parts of Alameda. Mr. Ells moved that the matter be referred to the Public Utilities Committee, seconded by Mr. Hammond and carried. A communication was received from O'Brein & Werner, requesting permission to use Terra Cotta flue lining in three chimneys of a residence to be erected on the southeast corner of San Antonio Avenue and Bay Street for Dr. W. T. Lum. Mr. Hammond moved that the matter be referred to the Fire,Water and Police Committee with power to act, second- ed by \1r. Fisher and carried. A petition was received from McGeorge and Cooper asking for a free license to soli- cit orders for gas burners, etc., basing their application, for the reason that they man- ufactured these articles themselves. Mr. Christensen moved that the matter be referred to the License Committee with power, seconded by Mr. Hammond and carried. A petition was received from F. E. Mason and others requesting the Council to take action to have the alarm signal bell, maintained by the 'Railroad Company at the railroad crossings and Everett Street, removed. Mr. Krumb moved that the matter be referred to the Street Committee, seconded by Mr. Hammond and carried. The Clark presented an affidavit showing due publication of Notice of Sale of Tank and Windmill and requesting bids for same, and reported that three bids had been receiv- ed. Mr. Probst moved that the bids be received and opened, seconded by Mr. Christensen and carried and thereupon the following bids were read- L. Serralunga. $60.50. Frank Costa, 60.00 Portola Boat Club. For material. Thereupon Mr. Christensen moved that the matter be referred to the Street Committee and Street Superintendent with power, seconded by Mr. Fisher and carried. A communication was received from the Police and Fire Commissioners stating that several leaks had been discovered in the boiler shell of Fire Tngine and requesting permission to have a new shell installed at a cost not to exceed. $487.50. Mr. Krumb moved that the matter be referred to the Fire, Water and. Police Committee and the Chief of the Fire Department with power to act, seconded by Mr. Hammond and carried by the following vote. Ayes:Councilmen Christensen,Walker,Krumb,Hanmond,Crosby,Ells,Fisher, Probst and Bullock, (9). Noes:None. Absent :None. A communication was received from the South Shore Land Company requesting that the Council proceed to widen Central Avenue at Washington Park by setting the curb line back 14.20 feet in accordance with the agreement adopted by the Council on the 6th day of July, 1909. Ordered filed. Thereupon a report was received from the Street Committee recommending that the City take such action in accordance with said agreement. Mr. Probst moved that the recommendation be adopted, seconded by Mr. Crosby and carried. A communication was received from the Police and Fire Commission stating that the Water Company would within the next 60Tdays install pipe the uniform size on Park Street between Clement Avenue and Buena Vista Avenue to connect with the main already in place on Park Street. Ordered filed. A communication was received from the Police and Fire Commission stating that the Powell Bros. Construction Company agreed to tear out the present cement floor and replace with a new cement floor, the flooring of the Sherman Street Fire House, at a cost of thirty-five (354) cents per square foot and recommending that the bid be accepted. Mr. Probst moved that the report and recommendations be adopted, seconded by Mr. Walker and carried by the following vote. Ayes: Councilmen Christensen,Walker,Krumb,Hammond,Crosby, Ells,Fisher,Probst and Bullock, (9). Noes:None. Absent:None. A bid and contract was received from Gorman & Thomas of San Francisco for the remov- al of the large safe in the Auditor's present office on the second floor, to his new office on the third floor, at a cost of $75.00. Ordered filed. A communication accompanied by a set of resolutions requesting the U.S.Uovernment to appropriate the sum of ,,400,000.00 to be used by a like sum approrriated by the State of "%alifornia,for the improvement of the Sacramento and Jan Joaquin Rivers,was received f from the State Department of 7ngineering. Mr.Probst moved that the Council, endorse the same and that the Clerk be directed to notify Cxongressman Jos.R.Knowland of their action conded by Mr.Christensen and carried. A petition was received from the 'Hunter Lumber Co.,requesting that they be given a franchise to run a sput track from the main line of the Southern Pacific Company near the north end of the Webster Street Roadway into their lumber yard located at that locality. Mr.Crosby moved that the matter be referred to the Street Committee,seconded by Mr.Probst end carried.. Mayor Noy broupht up the matter of the protest against the opening of a new street on the north side of the city west of Grand Street as provided for under Resolution of In- tention No.737 and thereupon Mr.Krumb moved that the hearing of said protest be set for the next meeting of the Council,Tuesday,Decemher 21st 1909,at 8 o'clock P.M.and that the Clerk be directed to notify the protestants in writing of such hearing,seconded by M Crosby and carried. An estimate of the cost of the improvement of the south side of Encinal Avenue from Pease Avenue to Versailles Avenue,was presented by the City Engineer fixing the amount at 1002.24,acconpanying the same rare agreements signed by the various property owners to dispose of their property to allow for the widening of the said south side of said street between said limits at a total cost of ,.;3101.00. Mr.Probst moved that the matter he referred to the Street Committee,seconded by Mr.Krumb and carried. A communication was received from the Street Committee reporting that in their judg- ment that no action be taken toward lighting Webster Street Roadway with arc lights at present as the expense would be to gregt but recommending that favorable consideration be given the project when the budget for the next year was taken up. Ordered filed. A communication was received from the Street Committee reporting that it was im- practicable at present to construct Bay Island Avenue as part of it was under water and the Electric Light Plant was occupying part of the street with their condensing basin. Ordered filed. A petition was received from J.H.Reese,et al,requesting that sidewalks be construct- ed where not already laid on San Jose Avenue between Versailles Avenue and High Street and on High Street between San Jose Avenue and Encinal Avenue. kr.Probst moved that t the same be referred to the Street Committee,seconded by :Jr.Crosby and carried. idr.Krumb offered the following resolution and moved its adoption: Resolved,That all actions of the Council for Street improvement under Resolution of Intention No.732 be rescinded. !a-.7:alker seconded the resolution and it was adopted by the following vote. Mr.Krumh offered the following resolution and moved its adoption: Resolved,That all actions of the Council for street improvement under Resolution of Intention No.742 be rescinded. A Bill entitled "A Bill for Ordinance No. Approving and Ratifying Agreemen made the 3rd day of August,1909,between the City of Alameda and the Southern Pacific Com- pany,and Granting to said Company the Right to Place,Maintain and Operate Electric Feed Wires on Poles of the City of Alameda upon Pearl Street from its intersection with the Track of the Central Pacific Railway Company on Lincoln Avenue to its intersection with the track of the South Pacific Coast Railway Company on Encinal Avenue in the City of Alameda" introduced by Lr.Krurnb on November 16th 1909,came up for passage and was read by the Clerk. Mr.:Probst moved that it be adopted,seconded by LIr.Croshy and carried by the following vote. Ayes:Councilmen Christensen, Walker, Krumb , Hammond , Crosby, Ells , Fisher,Probst and Bullock,(9). Mr.Crosby introduced A Bill entitled "A Bill for Ordinance No. Imposing a License Tax for Revenue and Regulation upon Bill Boards,Fences and other Structures used for Ad- vertising,according to Business Transacted," which was laid over under the provisions of the Charter. Mr.Crosby introduced A Bill entitled "A Bill for Ordinance No. Imposing a Li- cense Tax for Revenue and Regulation upon Bill Boards,Fences and other Structures used for Advertising,According to Space Used," which was laid over under the provisions of the Charter. Mr.Bullock offered a Resolution Determining that the Public Interest and Public Necessity of the City of Alameda,demand the Acquisition,Construction and Completion of Certain Permanent ninicipal Improvements,Buildings for Municipal Uses,and Other Works, Property and Structures Necessary and Convenient to carry out the Objects,Purposes and Powers of said Municipality,the cost of Which is too great to be paid out of the Ordinary Annual Income and Revenue of the said Municipality,which was read by the Clerk in full, Mr.Bullock moved that it be adopted,seconded by Mr.Hammond,after some discussion of the same Mr.Hammond withdrew his second and thereupon Mr.Probst moved that the matter be laid over until the next meeting of the Council,seconded by Mr.Crosby and carried. Mr.Probst moved that the Clerk be directed to request the Board of Electricity to submit by the time the council met again an estimate of the cost of the installation of an electric Police Telephone and Red Light system,seconded by Mr.Ells and carried. A communication from P.A.Haviland,County Surveyor,addressed to :Ir.Krumb was presented with a map showing that no part of Alameda City had been included in the description of the boundaries annexed to the City of Oakland in the recent annexation election held by that City. Ordered filed. Mr.Krumb moved that the City Engineer and City Attorney prepare an Ordinance fixing the grade of High Street from the north end of the macadam northerly about 1100 feet to the Tidal Canal,seconded by Mr.Probst and carried. Mr.Probst moved that the City Engineer and City Attorney be directed to prepare a Resolution of Intention to grade,curb,macadamize and otherwise improve Santa Clara Avenue between 3rd and 4th Street,seconded by Mr.Crosby and carried. There being no further business to transact the Council adjourned until the next regular meeting,Tuesday,December 21st 1909,at 7.30 P.M. City Clerk of Alameda.
