TUESDAY, NOVRMBER 7Th, 1911.
The meeting convened with Mayor W. H. Noy presiding.
The roll was called and Councilmen Christensen, Krumb, Hammond, Spence, Probst,
and Bullock, (6) were noted present, and Councilmen Walker, Ells and Morgenstern
(3) absent.
The minutes meeting of October 17th, 1911 were read and ordered
approved.
3ilrnan Ells arrived during the reading of the minutes and was noted pre-
sent.
The Street Superintendent presented a statement of the labor and material
used for grading, shaping and putting in culverts in the Xilkenny Road on Bay Fan'
Island showing the amount to be .418.47. Ordered filed. Thereupon Mr. Bullock
offered the following Resolution and moved it- adoption:-
RESOLVED, that the sum of Four Hundred and Eighteen and 47/100 (0418.47)
Dollars be, and the same is hereby transferred from Municipal Improvement Fund No.
8 (Bay Farm Island Road) to the Street Fund, and the Auditor and the Treasurer
are hereby directed to affect the said transfer upon. their respective books.
Christensen seconded. the Reolution and it was adopted and passed by the
following vote Ayes :Councilmen Christensen, Krumb, Hammond, Spence, Ells
Trobst and Bullock, (7).
Noes:None. Absent:Councilmen Walker and Morgenstern,
Councilman Morgenstern arrived and was noted present.
A rerort was received from the Auditor stating that suffioient money had been
deposited in Local Improvement Fund No. 772 to pay the indebtedness of the said
Fund to the General Fund, caused by transfer on August 15th, 1911 and October
30th, 1911. Ordered filed.
Councilman Walker arrived and was noted present.
Mr. Bullock offered the following Resolution and moved its adoption:
WHEREAS, it appears from the report of the Auditor that a sufficient sura of
money has been deposited to the credit of Local Improvement Fund No. 772 to pay
the indebtedness of said Fund to the General Fund, therefore be it
RESOLVED, That the sun of Seven Hundred and Fifty (050.00) Dollars be and
the same is hereby transferred from Local Improvement Fund No. 772 to the General
Fund, and the Auditor and the Treasurer are hereby directed to affect the said
transfer upon their respective books.
Mr. Spence seconded.Hthe- Resolution :and it ws. passed:and adopted.by the
following vote:- Aye-':Councilmen Christensen, Walker Krumb, Hammond, Spence,

A report was received from the City Engineer certifying that the L. H. West-
dab pany, contractors for the East End Intercepting Sewer had completed enough
word under the terms of their contract to allow them a payment of 687.07. Ordered
filed.
Claims against the General Fund amounting to '100.-fo; against the Police Fund
amounting to 14.80; against the Electric Light Fund amounting to 6984.56; against
the Street Fund amounting to 2043.92; against tIle Library Fund amounting to 445.41;

Two burety bonds were received,both in the sum af 5OOO .00 each, on behalf of
Leon H.Ader and Louie :T.Cordee,clerks in the office of the City Tx Collector and
Treasurer,with the American Surety Co.,of 7ew York, surety. Ordered filed.
The Clerk brought up the matter of complaints against advertising bill boards
and Mr.Hammond move d. that -the matter be-referred to the Street Committee in con-
tion with the City Attorney,seconded by :1r.Probst ard carried.
v/ An affidavit was presented showing due publication of Notice inviting propo-
sals for the construction of lamp posts,conduits and wiring &c,ir district To .1 un-
der Resolution of Intention No.760,which was ordered filed. The Clerk reported
that in answer to said Notice one bid had been presented. Mr.Hammond movecl that
the cane be received and opened,seconded by Toir.Prohst and carried and thereupon the
Clerk opened and read the bid which wa from C.F.Adams,accompanied by a certified
check in the sum of q!300.00,and was for the sum of $2750.00. Mr.hammond Moved
that . same be referred to the Street Committee and the Board of Electricity in
conjunction with the City Attorney,and to report back to the Council at the next
meeting,seconded by Mr.Christensen and carried.
A contract was received from Scott,Lagner & Miller for the supplying the Fire
Department with feed for the hores of the said departnent for the year ending Oct-
ober 19th 1912,and in accordance with their bid filed Octoher rd 111. Ordered
filed.
A petition was received from 11obt.D.Hunter,to move a two story frame building
from 1532 Chestnut Street to the west side of Lafayette Street about 150 feet south
Lincoln Avenue. The sane was accompanied with the written consent of the ad-
joining property owners and a bond to cover Tossible damages in compliance with the
ordinance governing the moving. of houses. Mr.Krumb moved that the request be
granted,seconded by ir.Eanxrion d and -carried.
The following named persons made application for gratuitous lieenses,which on
motion of Mr-711s seconded by Mr.Spence were granted.

and F.h.Kellogg,to solicit orders for a patent as stove lid.
Fred Witham presented a petition for a gratuitous license peddle a clothes
hanger. Chief of Police Conrad recommended that the sane he denied. Mr.Ells
moved that the petition be denied,seconded by Mr.Spence and carried.
A communication was received from the Alameda Improvement Club advocating the

the said buildings and grounds are named. Ylr.Christensen moved that the matter
be referred to the Public Building6 and grounds Conmittee,seconded hy T,:r.Hammond and

A communication was received from the Alameda Chamber of Commerce calling at-
tention to the arbitrary switching charges of $2.50 per car on certain commodities
coming by freight to Alameda. Zr.Hammond moved that the niatter be referred to the
Public Utilities Committee,e, onded hy Mr .Probst and carried.
A communication was received from the River Express Co.,asking if it was the
intention of the City to demand a wagon license tax on wagons of the said Company
doing business in the City and whether the license paid for the past year would be
refunded. Mr.Ells moved, that the Clerk be directed to notify the said company
that the city would demand the said tax and would not refund the tax paid for the
pasft year,seconded by Mr.Hammond and carried.
A communication was received from the League of California Municipalities
desiring to know whether the Council would require any copies of the report of the
convention of the said League at Santa Barbara which had been recently held. Mr.
Hammond moved that the Clerk be directed to order three copies,one :Mr the City At-
torney,one for the Street Bepartmcnt and one for the Clerk's office, seconded by
Mr.Probst and carried.
A communication was received from the Board of SuperviSors stating that a meet-
ing of the Sub-way Committee as soon as possible. Ordered filed.
A communication was received from Joel A.Hayes residing at 408 Oakland Avenue
Oakland,in which he tendered all his right,title and interest in his plans to im-
prove the Alameda and Oakland water front. Mr.Hammond moved that the same be ref-
erred to the Alameda Harbor Conmission,seconded by Mr.Ells and carried.
A communication was re eived fro y W.R.Scott,Asst Genl.Manager of the Southern
Pacific Company addressed to idayor Noy in reply to a communication from the Mayor in
which he stated that it would be impossible to comply with the request to establish
cent fares between all stations within the city Alameda. Ordered filed.
A report was received from the Public Utilities Committee stating that con-
ditions pertaining to the proposition of fixing the rate of fares on the railroaa
at 2-- was such at the present time that it would not be advisable to take any
action at this time Mr.Probst moved that it be filed,seconded hy Mr.Ells and
carried.
A report was received from the Public Utilities Committee,to which was attach-
e d copies of correspondence between the Board of Electricity and J.M.Davis,General
Supt.of the Southern Pacific 0 ompany,relating to agreement between the City and the
said Company regarding the erection and maintenance of lights at the various sta-
tions of the said railroad company,and requesting the the Clerk be directed to noti-
fy the Board of Electricity that the Council approved of the action of the said
Board in making the agreement. Mr.Hammond moved that the request be complied with
seconded by Mr.Bulloch and carried.
A report was received from the Public Utilities Committee stating that it had
held a meeting with representatives of the various Improvement Clubs and the Chamber
of Commerce and that it was the consensus of opinion not to interfere with the rail-
road regarding the complaint against the blowing of alarm whistles. Mr.Probst
moved that the report he filed,seconded by Mr.Morgenstern and carried.
A report was received from the Building'& Grounds Committee recommending that
E.R.Deming & Co,he awarded the work of constructing a gasolene tank at the City Hall
and also at 7ire House No.1,at a cost of tg ?140.00 each and also the construction

A report was received from the Public Buildings and Grounds Committee recom-
mending that the work of re-arrangeing the Emergency Hospital in the basement of the
City Hall be given to Jacob Boodt at a cost of 4237.50 in accordance with the plans
and specifications therefor. Mr.Christensen moved that the recommendation be adopt-
ed seconded by Mr.Bullock and carried by the following vote. Ayes:Councilmen
Christensen,V;alker,Krumb,Hammond,Spence,Ells,Morgenstern,2robst and Bullock, (9).

A report was received from the Public Buildings and Grounds Committee recom-
mending that the work of placing a metal rail from the sidewalk to the first floor
on the stairway leading into the City Hall be given to Otto Bechtle at a cost not
to exceed 65.00. Mr.Christensen moved that the recommendation be ado ted,second-
ed by Mr.Bullock and carried by the following vote. Ayes :Councilmen Christensen,
Walker , Krumb , Harunond, Spence , Ells , Korgenstern,Probst and Bullock, (9). Noes :None.

A report was received from the Fire,V;ater and Police Committee recommending
that the request of the Police c Fire Commission to have the telephone system of
the several stations of the fire department,rebnildt,be for the present,denied.
Mr.Walker moved that the ecommendation he adopted, seconded. by Mr.Hammond and car-
ried.
A report was received fror the Street Committee otating that the fountain 10-
cated on the north side of Central Avenue about 100 feet east of Jar eet had
been connected. with the sewer as requested by the Board of Health. Ordered filed.
A report was received from the Park & Playground Committee recommending that
no action he taken toward removing a certain tree growing in Morton Steeet south of
Santa Clara Avenue. Mr.Probst moved that the recommendation he adorted,seconded
by Mr.Bullock and carried.
A report was received fror the Park Playground Committee stating that George
Pratt had resigned as Janitor of the Park -laygron and that they had appointed
Thos Goff in his place and stead and requested that the said appointment be confirm-
ed.
Er.Probst moved that the said appointment be confirmed,seconded by r.Bullock
and carried by the following vote. Ayes :Councilmen Christensen,alker,Krumb,Ham-
mond,Spence,Ells,Ilorgenstern,Probst and l'u11och,(9). Noes :None. Absent :None.
A communication was received from 17.N.Frodden,Street Superintendent stating ±k
that he had appointed James E.Sutton as inspector of the East End Intercepting lewer
at a wage of ,;4.00 per day

A commrication was received from the Street Committee recommending that 1:c7.

agreement had been made with the property owners owning property along the proposed
improvement of Kilkenny Street on Bay Farm Island whereby the said owners would
make the proposed improvement by private contract and recommending that all action
in the matter 1e recinded. Mr.Krumb moved that the recommendation be adopted,
seconded by Nr-.Talker and carried l) the following vote. Ayes :Councilmen Chris-

A communication was received from the Police and Fire Commission requesting
authority to appoint an additional ratrolmantto take effect as of November 1st 1911.
Mr.Bullock moved that the request he granted,seconded by r.Walker and carried by
the following vote. Ayes :Councilmen Christensen,alker,:rumb,Hammond,Spence,

A petition of remonstrance was received from 7.G.Cohen,claining to own a
majority of the ffrontage on Fernside Boulevard,protesting against the work of con-
structing a sewer in said Fernside Bou7levard under esolution of Intention No.777.
Ordered filed, and thereupon Lr.T-7rumb offered the following resolution and moved its
adoption:
Whereas,E.C.Cohen has filed objections to proceeding with the work proposed
by Resolution of Intention No.777,to construct a sewer in Fernside Boulevard from
the center of its intersection with High St. to a point therein 15E34.39 feet west-
erly

Therefore resolved that 8 o'clock P.L. on the 21st day of November,1911,and
the Councilroon of this Council be and are hereby fixed as the time and place of hear-
ing said ob,lections,and the City Clerk is hereby directed to give notice thereof to
all objectors in the manner prescribed by law.

It is further resolved that this resolution and proceedings hereunder are
ken under and by virtue of the provisions of an act entitled,"An Act to provide for
the lighting of public streets,lanes,alleys,roads and places in municipalities,and
for the assessment of the costs and expenses thereof upon the property benefited
thereby."

In accordance with the instruction contained in the foregoing Resolution of
Intention No.780 the Department of Electricity presented a report concerning the
proposed improvement,accompanied by plans,specifications and estimate of the cost
of the same,fixing the amount at $9,304.54,diagram showing the district referred to
in said Resolution,the boundaries and dimensions of the respective stb-divisions of
the land within said district and assessment roll of the total amount of the cost •
and expenses upon the several sub-divisions of land in said district in proportion
to the estimated benefits to he received by such sub-divisions which were ordered
filed and thereupon Mr.Krumb offered the following Resolution and moved its adop-

islature of the State of California,entitled "An Act to provide for the lighting of
public streets,lanes,alleys,courts and places in municipalities,and for the assess-

March 21,1905,and acts amendatory thereof,the Board of Electricity of the City of
Alameda,has filed with the Clerk of the City Council its report;therefore be it
RESOLVED,That Tuesday,the 5th day of December,1911,at the hour of 8 o'clock,
P.M.,at the Council Chamber of the City Council,in the City Hall of the City of Ala-
meda at the northwest corner of Santa Clara Avenue and Oak Street,be and the same are
hereby appointed as the time and place for hearing protests in relation to the pro-
posed improvements particularly described in said resolution and report.
RESOLViO,That the Clerk be and he is hereby directed to give notice of said hear-
ing as provided by said Act of the Legislature,and that the Alameda Daily Argus be
and it is hereby designated as the daily newspaper published and circulated in this
municipality in which said notice shall be published,and that the Clerk be and he is
hereby directed to publish said notice for a period of two days in said daily news-
paper,and to post said notice as required by law.

Mr.Krumb brought up the matter of the erection of of electroliers in District
No.2,underl Resolution of Intention No.770,and stating that there was sufficient
ds dollected in said district and moved that the Clerk he directed to advertise
for bids for doing the said work,seconded by ILr.Spenoe and carried.
Mr.Walker introduced A Bill entitled "A Bill for Ordinance No. To Amend
Section 3 of Ordinance No.516,Prescribing Building Regulations and Fixing the Boun-
dary Lines of Areas within which Various Classes of Buildings may be erected",which
was laid oved under the provisions of the Charter.
Mr.Kruxni introduced A Bill entitled "A Bill for Ordinance No. Granting to
the United States of America an easement for sewer purposes",which was laid over un-
der the provisions of the Charter.
Mr.Probst introduced .A Bill entitled "A Bill for Ordinance No. Regulating
traffic and care of vehicles and horses on and over any of the streets of the City
of Alameda",which was laid over under the provisions of the Charter.
Mr.Lorgenstern moved that the vacancies on the Board of Health he filled by
appointing Dr.C.A.McQuesten to the vacancy caused by the resignation of Dr.Jas A.
Ellis and appointing Dr.James C.Hanley to thevacancy caused by the resignation enns--
of Dr.Harold A.Miller,seconded by Mr.Hammond and carried by the
following vote. Ayes :Councilmen Christensen,Walker,Krumb,Hammond,Spence,Ells 'Ior-

Mr.Probst moved that the Street C onmittee be authorized to have the work of
widening the roadway of Central Avenue west of Sherman Street done by narrowing the
sidewalk so as to allow such wideningtseconded by Mr.Hammond and carried.
Mr.Hammond brought up the matter of improving the west side of the Webster St.
Roadway so as to be the same as the east side and moved that the matter be referred
to the Street Committee in conjunction with the Finance Committee to devise ways and
means to have the said work done,seconded by Mr.Bullock and carried.

on the necessity of having the telephone system between the various Fire Houses
put in first class condition,and thereupon Mr.Hammond moved that the matter be re-
ferred to the Fire,Water and Police Committee to take up with the Police and Fire
Commission,seconded by Mr.Bullock and carried.
