1911-12-19 Regular CC MinutesREGULAR MEETING OF THE COTICIL OF THE CITY OF ALA TUESDAY,DECE= 19th 1911. The meeting convened with Mayor W.R.Noy,residi.ng. The Roll was called and Councilmen Christensen,Walker,Xrumb,Morgenstern and Bullock,(5) were noted present and Councilman Hamnond,Spence,Ells and Probst,(4) were noted absent. The minutes of the meeting of December 5th 1911,were read and ordered approved. Councilman Hammond arrived during the reading of the minutes and was noted present. V A communication was received from the Auditor requesting that transfers be made affecting certain funds which was ordered filed and thereupon Mr.Bullock offer- ed the following resolution and moved its adoption: Resolved that the sum of Five Hundred and Twenty-eight and 43/100 ($ , .43) Dollars be and the same is hereby transferred from the General Fund to Local Improve- ment Fund No.772,on account of Delinquent Electrolier Assessments on to the City of Alameda,and the Auditor and the Treasurer are hereby directed to affect the said transfer upon their respective books. Iir.Christensen seconded the resolution and it was adopted and passed by the following vote. Ayes :Councilmen Christensen,Walker,Lrumb,Hammond,Morgenstern and Bullock,(6). Noes:None. Absent:Councilmen Spence,Ells and Pro1st,(3). Mr.Builock offered the following resolution end moved its adoption: Resolved,That the sum of Five Hundred (Wo.no) Dollars,loaned the Park and Play- ground Fund on October 3rd 1911,1e re-transferred from the said Park and Playground Fund to the General Fund,and the Auditor and the Treasurer are hereby directed to af- fect the said transfer upon their respective books. j Mr.Christensen seconded the resolution and it was adopted and passed by the following vote. Mr.Bullock offered the following Resolution and moved its adoption: Resolved,That the salaries,of the City Officials and employees,for the month of December,1911,shall he due and payable on the 22nd day of December,1911,and the City Auditor is hereby authorized and directed to issue and deliver warrants for all such salaries on said last mentioned day;and the City Treasurer is hereby authoriz- ed and directed to pay said warrants so issued and delivered,and Be It Further Resolved that the City Treasurer be and he is hereby authorized to hold the said warrants so paid as cash on hand until the 1st day of January,1912. Mr.Christensen seconded the resolution and it was adopted and passed by the following vote. Ayes :Councilmen Christensen,Walker,Krumb,Hammond,Morgenstern and Bullock,(6). Noes:None. Absent:Councilmen Spence,Ells and. Probst, (3). A report was received from the Auditor showing an apportionment of Taxes ap- portioned up to December 19th 1911. Ordered filed. A continuation certificate was received from the United States Fidelity & 5706 Guaranty Company on Policy No .155163 for 030 000.00 burglar insurance on the City 158.30 $485.36 Treasury. Ordered filed. A report was received from the Poundmaster for the month of November,1911. Mr.Walker moved that the permission asked for be granted,seconded by Mr.Hammond and carried. A communication was received from the East End Improvement Cluh,thanking the Council for its action in securing and completing the East End Intercepting Sewer. Ordered filed. A communication was received from the Board of Education stating that it fav- ored the introduction of a kindergarten the same to be established gradually and re- questing that the Council place the sum of $8OO.oO at the disposal of the said Board for that purpose. Mr.Bullock reported for the Finance Committee that at the pre- sent time there were no funds available and that the said matter be should be taken up by the Board of Education at the time the budget was made up during the next year. The Clerk was directed to so notify the said Board. A communication was received from the Building Inspector requesting authority to purchase a Pierce Chainles Bicycle at a cost of $80.00. Mr.Hammond moved. that the request be granted,seconded by Mr.Bullock and carried by the following vote. Ayes :Councilmen Christensen,Walker,Krumb,Hammond,Morgenstern and Bullock, (6). Noes: None. Absent:Councilmen Spence,Ells and Probst,(3). Councilman Ells arrived and was noted present. The Clerk presented an affidavit showing due publication of Notice asking Pro- posais for Concession to sell refreshments in Lincoln Park which was ordered filed. He reported that in reply to the said publication he was in receipt of three bids and thereupon Mr.Bullock moved that the same be received. and opened,seconded by Mr. Krumb and carried and thereupon the Clerk opened and read the bids as follows: Jas.H.Orenshaw,3239 Encinal Avenue in advance. - 080.00 payable quarterly Mrs.Jos.C.Roesling,3248 Briggs Avenue ------ - $150.00 W.A.Butterfield,1305 High Street --------- 15.00 per month payable in advance,with the proviso that he have a free license. Mr.Krumb moved that the matter be referred to the Park and Playground Committee with power to act,seconded by Mr.Morgenstern and carried by the following vote. Ayes:Councilmen Christensen,Walker,Krumb,Hammond,Ells,Morgenstern and Bullock,(7). Noes :None. Absent :Councilmen Spence and Probst, (2). The matter of the application of Albertsen and Matthisen,to have the liquor license now held by Henry F.Brink at 1548 Park Street transferred to then,came up for further hearing and a communication was received from Fitzgerald and Abbott with- drawing their objections to the granting of such transfer which was ordered filed and thereupon Mr.Ells moved that the petition be granted,seconded by Mr.Walker and carried by the following vote. Ayes:Councilmen Christensen,Walker,Krumb,Hammond, Ells,Morgenstern and Bullock, (7). Noes :None. Absent :Councilmen Spence and Probst, (2). / The matter of the condemnation proceedings against the building located on the north side of Webb Avenue about ion feet east of Park Street carne up for hearing and Mr.Walker,Chairman of the Fire,Tater and Police Committee,reported that the said Committee had granted permission,to the owner of the said building to repair the same with galvanized iron. Mr.Bullock moved that the report be adopted,se- conded by Mr .Morgenstern and carried. 7 A report was received from the Street Committee stating that at the r nt ti,le there rere no funds available to improve the west side of the Webster Street j) ) c) 1 0 i.euemoer jnn 1W11. of the hands of the said committee. Mr.Christensen moved that the report be adopt- ed,seconded by Mr.Hammond and carried. A report,was received from the Street Connittee,in the natter of the building obstructing the general line of the sidewalk on Santa Clara Avenue at the southeast corner of 7:ebster Street,to which was a certificate of Search of the property on which the said building was located,and which showed that the owner of said property had never deedea any of it to the City,and statin g that the only way to have the ob- wtruction removed was by condemnation proceedings,the report further contained the request to have the natter taken out of the hands of the said Committee. Mr.Chris- tensen moved that the report be adopted,seconded by Mr.Hammond and carried. The matter of the further hearing of the Petition of Remonstrance against the ovement of Centennial Avenue under Resolution of Intention No 779,was taken up. Mr.Krumb reported that the owners of property who objected to the said improvement had agreed to have the said work done by private contract Fula within six month and moved that the protest be sustained,seconded by Mr.Talker and carried. The Clerk presented affidavits showing due publication and posting of Notices of Street Work Inviting Proposals therefor,in the matter of constructing a sewer in Fernside Boulevard under Resolution of Intention No.777. Ordered filed. The Clerk reported that no proposals had been presented. No further action was taken. « A petition was received from Hutchinson Company requesting permission to grade, curb,gutter and macadamize Lincoln Avenue between 5th Street and the westerly termin- ation thereof,the work to he done in accordance with pland and specifications of the City Engineer and to the salTisfaction of the Street Superintendent. Mr.Krumb mov- ed that the request he granted provided that the said Comrany file with the Clerk a copy of their contract with the owners of the property fronting on the street to be improved,seconded by Mr..Bullock and carried. Mr.Erumb offered the following Resolution and moved its adoption: Resolved,That the public interest and convenience require and, that it is the intention of the Council of the City of Alameda to order the following street work to be done in said city,namely; That Post Street from the southern line of Encinal Avenue to the northern line of Viashin.gton Street,including the crossings of San Jose Avenue and Adams Street with Post Street,but excepting the crossing of Madison Street with Post Street,be improved as fol]ows: That the entire width of said street between said limits,from property line to property line,be raded to the official grade;that cone- rete curbing,€3 inches by 14 inches in cross-section dimension,be constructed on the curb lines of said street and on the curved corners of the crossings between said li- mits;that concrete gutters three (3) feet in width and of the flat pattern,be constr- ucted along the roadway of said street,between said limits,contiguous to said curbing and to said curved corners;that two (2) part-circle corrugated iron culverts,one with and one without branches and handholes,be constructed,one on the eastern and one on the western side of the crossing of Adams Street with Post Street;and that two (2) p part-circle corrugated iron culverts,one with and one without branches and handholes, be constructed,one on the eastern and one on the western side,of the crossing of San Jose Avenue with'Post treet;that the roadway of said street between said limits and including said crossings,hut excepting that portion of said roadway occupied by gut- ters,be macadamized with a layer of broken trap rock 8 inches in thickness. The Alameda Daily Argus is hereby designated as the daily newspaper published and circulated in this City in which this resolution,and the Street Superintendent's Notice of the passage thereof,shall be published. The Clerk is hereby directed to publish this Resolution by two successive insertions in said newspaper,and post the same for two days conspicuously near the Chamber door of this Council. Mr.Krumb offered the following Resolution and moved its adoption: Resolved,that the City Engineer be and hereby is directed to make plans and specifications for the following street work to be done in said city,namely; That Grand. Street between the southern line of Dayton Avenue and the existing sea wall at the southern end of said street be improved as follows: That the roadway thereof, from said southern line of Dayton Avenue to a right line parallel therewith and dis- tant one hundred and seventy (170) feet right angle measurement southerly therefrom, but excepting that portion occupied by gutters be regraded and, macadamized with a lay- er of broken trap rock eight inches in thickness;that a concrete retaining wall be constructed along the western property line of said Grand Street extending from the sea wall above mentioned northerly for a distante of six-ty-five (65) feet,the top of said retaining wall to be four inches above .official curb grade;that the entire width of said street from property line to property line,between said right line parallel with and distant one hundred and seventy (170) feet right angular measurement souther- ly from said southern line of Dayton Avenue,and said sea wall at the southern end of said Grand Street,be filled and graded to the official grade;that a combined concrete curt and gutter,(curb to be 8 inches by 14 inches in cross section dimension and gut- ter to be 4 feet in width and 6 inches thick),be constructed along the eastern curb line of Grand Street from said right line one hundred and seventy (170) feet souther- ly from and parallel with said southern 11_ne of Dayton Avenue,thence in a right line southerly to a pol.nt on said eastern curb line distant thereon 329.75 feet southerly from said southern line of Dayton Avenue,thence curving to the east with a radius of ten (10) feet for a length of fifteen and 71-100 (15.17) feet thence tangent for a distance of six (6) feet to the eastern line of Grand Street;that a combined concrete curb and gutter,(curb to be 8 inches by 14 inches in cross section dimension and gut- ter to be 4 feet in width and six inches thick) be constructed along the western curb line of Grand Street from said right line one hundred and seventy (170) feet southerly from and parallel with said southern line of Dayton Avenue,thence southerly to a point on said curb line distant thereonfive (5) feet northerly from the northern line of said sea wall at the southern end of said street;that a combined concrete curb and gutter,(curb to be 8 inches by 14 inches in cross section dimension and gutter to be 3 feet in width and six inches thick),be constructed with the northern edge of said curb distant five (5) feet northerly from and parallel with the inside edge of said sea wall at the southern end of Grand treet;and that said combined concrete curb and gutter shall extend from the western curb line of Grans Street easterly to the eastern property line thereof:that a catch basin of brick masonry,with cast iron top and cover nnrisltruntPd in and -under the gutter herein provided for,on the western curb line of 4)ecomeer 19th 191M. said street at a distance thereon of six (6) feet northerly from said sea wall,and that an outlet from said catch basin be constructed of 18 inch vitrified iron stone sewer pipe in a right line therefrom southerly and parallel with said curb line to and through said sea wall;that a catch basin of brick rnasonry,with cast iron top and cover be constructed in and under the gutter herein provided for along the eastern curb line of said Grand Street at the curved corner herein above mentioned;and that an outlet fron said catch basin be constructed of 18 inch vitrified iron stone sew- er pipe in a right line therefrom and parallel with said last mentioned curb line southerly to and through said sea wall,as per Resolution of Intention No.778,Adopt- ed by this Council,September 19th 1911. And that the Clerk be instructed to notify the City Engineer of the adoption of this Resolution. Mr.Christensen seconded the resolution and it was adopted and passed by the following vote. In compliance with the direction of the preceding resolution the City Engineer presented plans,and specifications for the proposed work and thereupon Mr.Krumb of- fered the following resolution and moved its adoption: Resolved,That the Plans and Specifications furnished by the City Engineer of the City of Alameda,to this Council,for the following Street work to be done in said City,namely: That Grand Street between the southern line of Dayton Avenue and the existing seq wall at the southern end of said street be improved as follows: That the roadway thereof,from said southern, line of Dayton Avenue to a right line paral- lel therewith and distant one hundred and deventy (170) feet right angle measurement southerly therefrom,but excepting that portion occupied by gutters,be re-graded and macadamized with a layer of broken trap rock eight inches in thickness;that a conc- rete retaining wall be constructedalong the western property line of said Grand Street extending from the sea wall above mentioned northerly for a distance of sixty-five (65) feet,the top of said retaining wall to be 4 inches above official curb grade: that the entire width of said street from property line to property line,between said right line parallel with and distant one hundred and seventy (170) feet right angular measurement southerly frorn said southern line of Dayton Avenue,and said sea wall at the southern end of said Grand. And the Clerk is directed to file the same. Mr. Walker seconded the Resolution and it was adopted and passed by the follow- ing vote. Mr.Krumb offered the following Resolution and moved its adoption: WHEREAS,It appears to the satisfaction of this Council,that Resolution of In- tention No.778 for the work of re-grading and macadamizing the roadway of Grand Street from the southern line of Dayton Avenue to a right line distant 170 feet right angular measurement southerly therefrom;in filling,grading,macadamizing,curb- ing and guttering said street between said right line and the existing seawall at the southern end of Grand Street;in constructing a concrete retaining wall along the wect- ern property line of said-street in the City of Alameda,adopted 'ny this Council,Sept- ember 19,1911,has been posted and published according to law,and that no legal ob- jection to the doing of said work has been filed with the City Clerk of said city. ESOLVED,7hat the public interest and convenience require and the Council of the City of Alameda hereby orclers the following described street wotk to be done in said :lity,according to the plans and specifications adopted therefor,namely: That Grand Street between the southern line of Dayton Avenue and the existing sea wall at the southern end of said street be improved as follows: That the roadway thereof from said southern line of Dayton Avenue to a right line parallel therewith and dis- tant one hundred and seventy (170) feet right angle measurement southerly therefrom, but excepting that portion occupied by gutters,be re-graded and macadamized with a layer of broken trap rock eight inches in thickness;that a concrete retaining wall be constructed along the western property line of said Grand Street extending from the sea wall above mentioned northerly for a distance of sixty-five (65) feet,the top of said retaining wall to be 4 inches above official curb grade;that the entire width of said street from property line to property line,between said right line parallel with and distant one hundred and seventy (170) feet right angular measurement south- erly from said southern line of Dayton Avenue,and said sea wall at the southern end of said Grand Street,be filled and graded to the official grade;that a combined con- crete curb and glitter, (curb to be 8 inches by 14 inches in cross section dimension December 19th 1911. curb line of Grand Streetfrorn said right line one hundred and seventy (170) feet southerly from and parallel with said southern line of Dayton Avenue,thence in a right line southerly to a point on said eastern curb line distant thereon 329.75 feet southerly from said southern line of Dayton Avenue,thence curving to the east with a radius of ten (10) feet for a length of fifteen and 71-100 (15.71) feet,thence tangent for a distance of six (6) feet to the eastern line of Grand Street;that a combined concrete curb and gutter,(curb to be 8 inches by 14 inches in cross section dimension and gutter to be 4 feet in width and six inches thick) be constructed along the western curb line of Grand Street from said right line one hundred and seventy (170) feet southerly from and parallel with said southern line of Dayton Avenue,thence southerly to a point on said curb line distant there- on five (5) feet northerly from the northern line of said sea wall at the southern end of said t.eet;that a combined concrete curb and gutter,(curb to be 8 inches 14 inches tnche in cross section dimension and gutter to be 3 feet in width and six inches thick),be constructed with the northern edge of said curb distant five (5) feet northerly from and parallel with the inside edge of said sea wall at the south- ern end of Grand Street:wed that said combined concrete curb and guttershall extend from the western curb line of Grand Street easterly to the eastern property line thereof:that a catch basin of brick rnasonry,with cast iron top and cover be con- structed in and under the gutter herein provided for,on the western curb line of said street at a distance thereon of six (6) feet northerly from said catch basin be constructed of 18 inch vitriffied iron stone sewer pipe in a right line there- from southerly and parallel with said curb line to and through said sea wall:that a catch beain of brick nesonry,with cast iron top and cover be constructed in and under the gutter herein provided for along the eastern curb line of said Grand Street at the curved corner herein above mentioned:and that an outlet from said catch basin be constructed of 18 inch vitrified iron stone sewer pipe in a right line therefrom and parallel with said last mentioned curb line southerly to and through said sea wall. The Clerk of this City is hereby directed to publish this Resolution for two days in the Alameda Daily Argus,a daily newspaper published and circulated in this City,and which is hereby designated for that purpose. He is also directed to post conspicuously for five days near the Chamber Door of the said Councii,notice of said work with specifications inviting sealed proposals or bids for doing the work ordered,and to publish notice of said work inviting sealed proposals or bids for doing the work and referring to the specifications posted or on file,also for two days in the said Alameda Daily Argus,the newspaper hereby designated for that purpose. Both of the said notices shall require a certified check or a bond, either as prescribed by law and for an amount not less than ten per cent of the aggragate of the proposal,and shal? name ..uesday,the 2d day of January,1912,as the day hereby designated on which up to the hour of 8 o'clock 2.11.,the said pro- posals or bids shall be received. Absent:Councilmen Spence and Probst,(2). / Mr.Christensen introduced A Bill entitled "A Bill for Ordinance No. Con- senting to the Leasing and. Acquiring of Certain Real Property in the City of Ala- meda by the Board of Education for the use and. Benefit of the Public Schools of said City",which was laid over under the provisions of the Charter. / Mr.Walker introduced A Bill entitled "A Bill for Ordinance No. Amend- Ordinance No.513 Prescribing Limits for Public Laundries",which was laid over under the provisions of the Charter. V Mr.Hammond reporting for the Public Utilities Committee on the matter of the complaint of the Alameda Chamber of Commerce against the charging by the Railroad Company of a charge of $2.50 for switching cars of freight into Alameda,stated that the regulation of such a charge by the adoption of a recent amendment to the State Constitution placed all such matters in the hands of a State Commission and that therefore the City could take no action. Ar.Walker reporting for the Fire,Water & Police Commitee on the matter of the suggestion of former Mayor E.K.Taylor to have the bridge tenders,about to be appointed to operate the three bridges over the Tidal Canal,appointed special Police Officers,reported that he had taken the matter up with the Board of Super- visors and had been promised that such action would be taken by the said Board when the appointments were made. Mr.Walker brought up the immediate necessity of the purchase of horses for the Fire Department and moved that the Police and Fire Commission be authorized to purchase two horses,seconded by iir.Bullock and carried by the following vote. Ayes :Councilmen Christensen,Walker,Yrumb,Hammond,Ells,Morgenstern and. Bullock, Mr.Krurnb brought up the necessity of the erection of a building for the use of the person to whom would be granted the concession to sell refreshments in Lin- coln Park and moved that the Park and. Playground Committee be authorized to expend the sum of $100.00 for that purpose,seconded by Mr.Bullock and carried by the fol- lowing vote. Ayes:Councilmen Christensen,Walker,Xrumb,Hammond,Ells,Morgens rn and Bullock,(7). Noes:None. Absent:Councilmen Spence and Probst,(2). Mr.Hammond moved that the Clerk he directed to address a communication to Frank Arnold the purchased of the dairy,located on the north side of Clement Avenue between Chestnut and Willow Street,formerly owned by one Bangs and who had been granted permission to maintain an obstruction in Atlantic Avenue between Chestnut and Willow on his promise to move the said dairy out of Alameda by the 1st day of May,1912,and notifying said Arnold that the said permission would be continued to him on the same conditions,seconded by Mr.Walker ad carried.
