1912-01-02 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF TH.7. CITY OF ALAMEDA, TUF,SDAY FVPYING, JATTARY 2ND, 1912. The meeting convened with Mayor W. H. Noy, presiding. The roll was called and Councilmen Christensen, Walker, Krumb, Morgenstern and Bullock, (5) were noted present, and Councilman Hammond Spence, Ells and Probst (4) were noted absent. The Minutes of the meeting of Dece!iber 19th, 1911 were read and ordered approved. Councilmen Ells an Probst arrived during the reading of the Minutes and were noted present. Mr. Bullock offered the following Resolution and moved its adoption:- Resolved, That the sum of Ninety (00.00) Dollars be and the same is hereby transferred from the General Fund to the Police Pension Fund, and the Auditor and the Treasurer are hereby directed to affect the said transfer upon their respective books. Mr. Christensen seconded the Resolution and it was adopted and passed by the following vote:- Ayes:Councilmen Christensen, Walker, Krumb Ells, Uorgenstern, Probst and Bullock, (7). Noes:None. Absent:Councilmen Hammond and Spence, (2). Noes :None. Absent:Counoilmen Hammond and Spence, (2). A report Was received from the Municipal Electric Light Plant for the month of November, 1911. Ordered filed. A communication was reoeived from the Southern Pacific Company relative to the opening of gates at certain stations. Ordered filed. A communication Was received from the Oak:land Chamber of Commerce regaTdinr a report on harbor work by Congressman Ynowland. Mr. Krumb moved that the same be referred to the Puhlic Utilities Committee in conjunction with the City Statistician, seconded by Mr. Walker and carried. A report was received from the Park and F1ayground Committee recommending an increase in the salary of Thillin Trayssac, one of the gardners of the nars and play- grounds, from 250.00 to 7;.70.00 per month from January 1st, 1912. Mr. Walker moved that the recommendation be adopted, seconded by Mr. Probst and carried by the following vote :- Ayes :Councilmen Christensen, Walker, Krumb, Ells, Morgenstern, Probst and Bullock, (7) . Noes:None. Absent:Couneilmen Hammond and Spence, ( ) • A rerort was received from the Park and Plygrouna Committee recommending the appointment of Geo. E. Potter to the position of gardner of the parks and playgrounds in the place and stead of Peter Nicolson, resigned, at a salary of :70.00 per month. Mr. Krumb moved. that the report he adopted, seconded by Mr. Talker and carried by the following vote Ayes :Councilmen Christensen, Walker, Krumb, Ells, Morgenstern, Probst and. Bullock, (7). Noes:None. Absent:Hammond and Spence, (2). Mr. Hammond arrived and was noted present. v A communication was received from the Park and Playground Committee stating that they had awarded the contract for the concession in Lineoln Park to James H. Openshaw of 3239 Encinal Avenue, the price in his proposal, to wit:- 180.00 per year, payable quarterly in advance. Ordered filed. A petition was received signed by six Grocers in which they stated that they want- ed a gratuitous license issued to the Gordon Syrup COnnany of Berkeley to canvas the City in their interest. Mr. 7rumb moved that the sane be granted, seconded by Mr. Ells and carried by the following vote :- Ayes :Councilmen Christensen, Walker, Krumb, Hammond, Ells, Morgenstern, Probst and Bullock, (8). Noes :Tone. Absent: Councilman Spence, (1). A copy of esolutions adopted by the North Side Improvement Club relative to the development of Alameda Harbor, the opening of same to commerce and the building of a Municipal wharf at the foot of Grand Street was presented and on motion of Mr. Morgenstern the matter was referred to the the Public Utilities Committee, seconded by Mr. Walker and carried. A copy of Resolutions adopted by the North Side Imnrovement Club relative to January 2nd, 1912. WHEREAS, after further proceedings regularly had as required Ma law,said City Council of the City of Alameda did, on the 19th day of September, 1911, by resolution over-rule all protests against said improvement and the assessment for said improvement, and thereupon confimed the proposed assessment for said improve- ment, and thereupon adopted as a whole the said report of the Board of Electricity of the City of Alameda; and WHEREAS, said City Council did, upon the said 19th day of September, 1911, pass a resolution ordering said improvement to be done and made; and WHEREAS, pursuant to order of the said Council of the City of Alameda, the City Clerk. of said City of Alameda advertised for bids for the construction of lamp nosts, conduits and wiring on Paru Street from Santa Clara Avenue to the Bay of San Francieco; Grand Street from Lincoln Avenue to the Bay of San Francisco; Union Street from Santa Clara Avenue to the Bay of San Francisco; Lafayette Street from Santa Clara Avenue to the Bay of San Francisco; Chestnu treet from Lincoln Avenue to the Bay of San Franciaco; Willow Street from Lincoln Avenue to Encinal Avenue; Welnut Street from Lincoln Avenue to Central Avenue; Sante Clara Avenue from Paru Street to Oak Street; Central Avenue from Chestnut Street to Park Street; Alameda Avenue from Lafeyette Street to Willow Street; San Antonio Avenue frOm Morton Street to Chestnut Street; Clinton Avenue from Sherman Street to Willow Street; San Jose Avenue from Morton Street to Cheetnut Street; Dayton Avenue from Sherman Street east to the end, in accordance with the plans and specifi- cations for the said work adopted by the City Council of the City of Alameda as aforesaid; said advertisement was published in the manner and for the time pro- vided by law; and WHEREAS it appears to said Council that the time when sealed bids for said work was advertised to be received, was, to wit, up to the hour of Five o'clock P. M. of Tuesday, the 2nd day of January, 1912; and WHEREAS, it further appears to said Council that that time has passed and that no bids have been reneived; now, therefore, he it RESOLVED, that it be, and it is hereby ordered that said proposed contract be not made, and that the municipality it elf execute the work-embraced therein in accordance with the plans and specifications adopted for such work and employ the labor and provide the material, appliances and supplies necessary therefor; and it is further RESOLVED, that the coat and expenses of such work shall be paid out of the funds which have been collected therefor by the Tax Collector of said City of Alameda by virtue of the proceedings heretofore had under said Resolution of Intention No. 772, and as provided by law for said improvement. Mr. Christensen seconded the Resolution and it was adopted and passed by the following vote :- Ayes:Councilmen Christensen, Walker, Krumb Hammond, 711s, Morgenstern, Probst and Bul]ock, (8). Noes:None. Absent:Councilman Spence (1). The Olerk presented an affidavit showing due publication of "Notice to Dealers in Electrical Supplies and Iron Pipe." Ordered filed. In response to sane the Clerk stated that he was in receipt of six bids. Mr. Krumb moved that the bids be received and opened, seconded by Mr. Hammond and carried, thereupon the Clerk opened and read the same as follows:- From Lally Co., accompanied by a certified check in the sum of 90.00. ar) January 2nd, 1912, Public •uild•ngs and Grounds Committee, seconded by Mr. Krumb and carried. 1 A petition was presented by some two hundred residents in the neighborhood of Stanton Street and Lincoln Avenue requestinc a station at that point. LIr Hammond addressed. the Council on the matter and moved that the Clerk be directed to communicate rith the Southern Pacific ConTany informing them that it was the unanimous opinion of the Council that a station be established at tint place, and also that a station be established at Third Street and Pacific Avenue in the west end, seconded by Mr. Walker and carried. Yorgenetern brought up the subject of a station at Walnut Street on the south side and moved that the Clerk be directed to communicate with the Southern Pacific Company informing them to immediately take steps to erect a suitable place of shelter at that point and to erect them wherever stops are made on their local lines, seconded by Mr. Christensen and carried. The Clerk presented an affidavit shoring due publication of "Notice Inviting Proposals for the Construction of Imp Posts, Conduits and Wiring to be done in Certain Streets of the City of Alameda, under Resolution of Intention No. 772." Ordered filed. The Clerk then stated that he TflS in receipt of no bids, whereupon Mr. Krumb offered the following Resolution and moved its adoption:- WHEREAS, the Connell of the City of Alameda on the l5tli day of August, 1931, adopted its resolution of Intention No. 772 declaring its intention to order that iron pipe electric lamp posts each with a cast iron top and ground glass globe and lamp -and set up in a concrete base, be erected and constructed on both sides of the following streets and avenues in said City between the limits thereof hereinafter mentioned; said lamp posts to be placed at intervals of 150 feet along each side of said streets and avenues, and arranged so that the lamp posts on one side of any such street or avenue shall alternate with those on the other side ,thereof; and that said lamp posts shall be wired Etna connected by means of underground con- duits of iron pipe for operation by the municipal electric light plant of said city; that said improvement shnll be made and constructed on the following named stroets and avenues, to wit :- iaru Street from Santa Clara Avenue to the Bay of San Francisco; Grand Street from Lincoln Avenue to the Bay of San Francisco; Union Street from Santa Clara Avenue to the Ray of San Franciaco; Lafayette Street from Santa Clara Avenue to the Bay of San Francisco; Chestnut Street from Lincoln Avenue to the Bay of San Franci-co; Willow street from Lincoln Avenue to Encinal Avenue; Walnut Street from Linooln Avenue to Central Avenue; Santa Clara Avenue from Peru Street to Oak Street; Central Avenue from Chestnut Street to Park Street; Alameda Avenue from Lafayette Street to Willow Street; San Antonio Avenue from Morton Street to Chestnut Street; Clinton Avenue from Sherman Street to VAllow Street; San Jose Avenue from Morton Street to Chestnut Street; Dayton Avenue from Sherman Street east to the end; and WHEREAS, in accordance with the inetructions contained in said Resolution of Intention No, 772 adopted as aforesaid on the 15th day of August, 1911, and in accordance with the provisions of an Act of the Legislature of the State of California entitled, "An Act to provide for the lighting of public street, lanes, alleys, roads and places in municipalities, and for the assessment of the costs and expenses there of upon the property benefited thereby" adopted. Mr. Yrumb moved that the bids be referred to the Street Committee in conjunc- tion with the Board of Electricity, seconded by Mr. Christensen and carried. v The Clerk presented an affidavit showing due publication of Totice of Street 7ork inviting proposals therefor under resolution of intention Uo. 778. Ordered filed. The Clerk stated that he was in receipt of no bids, and Mr. Krumb suggested that the matter be held in abeyance for the time being. A report was received from the Street Superintendent certifying that the work of grading, curbing, macadamizing and constructing drains in :Pearl Street, done by autchillson Company under private contract, had been faithfully performed and to his satisfaction. Ordered filed. ( A Bill entitled "A Bill for inance No. Providing for the Leasing and Acquiring of Certain Real Property by the City of Alameda for the Use and Benefit of the Public Schools of said City introduced by Mr. Christensen on December 19th, 1911 came up for passage and was read by the Clerk. Mr. Christensen moved its adoption seconded by Mr. Probst and it was adopted and passed by the following vote:- Ayes:Councilmen, Christensen, Walker, Krumb, Hammond, Ells, Morgenstern, Probst and Bullock, (8). Noes:None. Absent :Councilman Spence (1). Mr. Bullock voted aye providing that the Board of Education pays the rental. A Bill entitled "A Bill for Ordinance No, Amending Ordinance No. Prescribing Limits for Puhlic Laundries" introduced by Mr. Walker on December 19th, 1911, came up for passage and was read by the Clerk. Mr. Hammond moved that same be referred to the Judiciary Committee to bring in a report, seconded by Mr. Ells and carried. 1 Mr. Krumh reported that theTAYEcars as used by the Oakland. Traction Company were not satisfactory to the traveling public and suggested that cars January 2n1, 1912. matter be referred to the Public Utilities Committee to have a personal interview with the Oakland Traction Company to see what could be done, siiconded by 11r. Ells and carried. Mr. Schaarschmidt appeared before the Council asking permission to build an oil tank at the foot of Sixth Street, to be used in connection with their baths. Mr. Hammond moved that the matter be referred to the Street Committee with,power to act, seconded by Mr. Walker and carried by the following vote:- Ayes:Council- men Christensen, Walker, Krumb, Hammond, Ells, Morgenstern, Probst and Bullock (8). Noes:None. Absent:Councilman Spence (1). Mr. Fbrought up the matter of the annual printing and moved that the Clerk be directed to advertise for bids for doing the same for the year 1912-1913, seconded by Mr. Bullock and carried. Mr. Yrumb sopke to the Council on the macadami7ing of Lincoln Avenue between Oak and Psrk Streets. City Attorney A. F. St. Sure spoke on behalf of the City on the matter and Thomas D. McCraith spoke on behalf of Mrs. Voogt. After some discussion Mr. Probst moved that the City Attorney proceed with condemnation proceedings against the proerty of Mrs. Voogt, unless sone settlement is made in the meantime, seconded by Mr. Walker and carried. 4 There being no further business to transact the Council adjourned until the next regular meeting, Tuesday, January 16th, 1912 at 7:30 P.
