1912-03-12 Regular CC MinutesJ. ADJOURNED REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA,TUESDAY,v1ARCH 12TH 1912. The Meeting convened with Council President Bullock,Presiding. The Roll was called, and Councilmen Krumb,Mac Rae,Hammond,Spence,Morgenstern, Probst and Bullock,(7),were noted present and Councilmen Walker and Ells,(2),absent. Mr.Bullock offered the following resolution and moved its adoption: RESOLVED,That the sum of One Thousand Dollars (01000.00) be and the same hereby transferred from the General Fund to Local Improvement Fund. No.783,as a loan to be re-transferred back to the General Fund,when sufficient money has been collect- ed by the Tax Collector for the improvement -contemplated by Resolution of Intention No.783 and turned over to the Treasurer and deposited in said Fund and the Auditor and the Treasurer are hereby directed to affect the said transfer upon their respec- tive books. Mr.Spence seconded the resolution and it was adopted and passed by the follow- ing vote. Ayes:Councilmen Krumb,Mac Rae,Hammond,Spence,Morgenstern,Probst and Bullock,(7). Noes:None. Absent:Councilmen Walker and Ell (2). Alameda Daily Argus Advertising 23.45 Lir.Spence moved that the claims as read be paid,seconded by Mr.Mac Rae and carried by the following vote. A continuation certificate on the surety bond of Arthur D.Goldsworuhy Office manager of the 1unicipal Electric Light Plant,vias received from the United States Fidelity and Guaranty Company. Ordered filed. A report was received from the Poundmaster for the month of B'ebruary,1912. Ordered filed. A communication was received from ,:i.R.Scott acknowledging receipt of commun- ication from the Clerk relative to e tablishing service by the Southern Pacific Company on Lincoln, Avenue west f 1:1a, tick Station,and stating that he had referred the matter to General Superintendent Davis. Ordered filed. A communication was received, from the Board of Education had decided,in order to use to advantage the lot recently leased from C.G.Powell,to make certain alter- ations in the building now located on said lot,that Mr.Dowell had signified his willingness to allow such alterations to be made but requested that the Council enter into a written agreement with Mr:Powell so to do. Mr.Hammond moved that the matter be referred to the City Attorney,seconded by Mr.Probst and carried. A communication was received from the Police and Fire Commission recommend- ing the Ordinance regulating the manner in which nichelodeons,moving picture theaters,etc.,shall be conducted,be amended so as to allow the operation of moving picture shows in the public schools. Lr. ammond moved that the matter be re- ferred to the Judiciary CoMmittee in conjunction with the City Attorney and the Police and Fire Commission seconded byMr:Lorgenstern and carried. A communication was received from the Surf Beach Park Co.,requesting permis- sion to swing a banner across Webster Street at Santa Clara announcing the opening of said Park on April 20th and 21st 1912. An affidavit was presented showing due publication of Notice Inviting opo- sa for the Construction of Lamp Posts,Conduits and wiring to be done on Certain Streets under Resolution of Intention No.780,being Electrolier Lighting District No.4. Ordered filed. The Clerk reported that no bids had been presented and thereupon Mr.Krumb offered the following resolution and moved its adoption: WHEREAS,the Council of the City of Alameda on the 7th day of Nevember,1911, adopted its Resolution of Intention No.780 declaring its intention to order that iron pipe electric lamp posts each with a cast iron top and ground glass globe and 1 p and set up in a concrete base,be erected and constructed on both sides of the following streets and avenues in said city between the limits thereof.hereinafter mentioned;said lamp posts to be placed at intervals of 150 feet along each side of said streets and avenues,and arranged so that the lam posts on one side of any such street and avenue shall alternate with those on the other side thereof;and that said lamp posts shall be wired and connected by means of underground conduits of iron pipe for operation by the Municipal Electric Light Plant of said city;thar said improvement shall be made and constructed on the following named streets and avenues,to wit:-Willow Street from Encinal Avenue to the Bay of San Francisco; Walnut Street from Central Avenue to the Bay of San Francisco;Cedar Street from Clinton Avenue to the Bay of San Francisco;Laurel Street from Clinton Avenue to the Bay of San Francisco;Oak Street from Central Avenue to the Bay of San ancis- co;Park Street,east half,from Encinal Avenue to point opposite southern line of San Antonio Avenue;Park Street,both sides from San Antonio Avenue to the northern line of Bay Island. Avenue;Alameda Avenue from Willow Street to Park Street;San An- tonio Avenue from Chestnut Street to Park Street;San Jose Avenue from Chestnut Street to Park Street;Clinton Avenue from Willow Street to Park Street;and. WHEREAS,in accordance with the instructions contained in said Resolution of Intention No.780 adopted as aforesaid on the 7th day of November,1911,and in accor- dance with the provisions of an Act of the Legislature of the State of California entitled,"AN Act to provide for the lighting of public streets,lanes,alleys,roads and places in municipalities,and for the assessment of the costs and expenses thereof upon the property benefited thereby" adopted March 21,1905,and acts amend- atory thereof the Board of Electricity of the City of Alameda on the 7th day of November 1911,filed with the Clerk of said City Council its report in writing; and WHEREAS,after further proeeedings regularly had as provided by law,said Ci- ty Council of the City of Alameda did,on the 5th day of December,1911,:by resolution over-rule all protests against said improvement and the assessment for said im- provement,and thereupon confirmed the proposed assessment for said improvement, and thereupon adopted as a whole the said report of the Board of E ectricity of the City of Alameda;and, WHEREAS said Council did,upon said 5th day of December49ll,pass a resolu- tion ordering said improvement to be done and made;and 'EEREAS,pnrsuant to order of the said. Council of the City of Alameda the City Clerk of said City of Alameda advertised for bids for the construction of lamp posts,conduits and witing on Willow Street from Encinal Avenue to the Bay of San Franc co;Walnut Street from Central Avenue to the Bay of San Francisco;Cedar Street from Clinton Avenue to the Bay of San Francisco;Laurel Street from Clinton =Vier]. Avenue;Alameda Avenue from Willow Street to Park Street; San Antonio Avenue from Chestnut Street to Park Street;San Jose Avenue from Chestnut Street to Park Street;Clinton Avenue from Willow Street to Park Street,in accordance with the plans and specifications for the said work adopted by the City Council of the City of Alameda as aforesaid;said advertisement was published in the manner and for the time TTovided by law; and Thereas,it appears to said. Council that the time when sealed bids for said work was advertised to be received,was,to wit,up to the hour of Eight o'clock P.M.of Tues- day,the 12th day of March,1912;and WHEREAS,it further appears to said Council that that time has passed and that no bids have been received;now,therefore be it RESOLVED,that it be,and it is hereby ordered that said proposed contract be not made,and that the municipality itself execute the work embraced therein in accordance with the plans and specifications adopted for such work and employ the labor and pro- vide the material,appliances and supplies necessary therefor;and it is further RESOLVED,that the cost and expenses of such work shall be paid out of the funds which have been collected therefor by the Tax Collector of said City of Alameda by vir- tue of the proueedings heretofore had. under said Resolution of Intention No.780,and as provided by law for said improvement. Mr.Mac Rae seconded the resolution and it was adopted and passed by the follow- ing vote. Ayes:Councilmen Krumb,Mac Rae,Hammond,Spence,Morgenstern Probst and Bullock,(7). Noes:None.
