TUESDAY, APRIL 2ND1912. ,
The meeting convened with Mayor W. H. Noy presiding.
The roll was called and Councilmen Krumb, Walker, MacRae, Morgenstern, Probst
and Bullock (6) were noted present, and. Councilmen Hammond, Spence and Ells
absent.
The Minutes of the meeting of March 19th, 1912 were read and ordered approved.
A communication was received from the Police Pension Fund Canmission request-
ing that the sum of One Hundred and Eighty-two (0182.00) Dollars be set aside
to meet the pension demands of retired police officers, Joseph Lawrence and Dennis
Welch for the months of January, February and March, 1912. Ordered filed.
Councilman Spence arrived and was noted present.
Mr. Bullock offered the following Resolution and moved its adoption:-
Resolved, That the sum of One Hundred and Eighty-two (182.00) Dollars be
and the same is hereby transferred from the General Fund to the Police Pension
Fund, and the Auditor and the Treasurer are hereby directed to affect the said
transfer upon their respective books.
Jr. MacRae seconded the Resolution and it was adopted and passed by the
following vote:- Ayes:Councilmen Krumb, Walker MacRae, Spence Morganstern.

Mr. Bullock moved that the claims as read be paid, seconded by Mr. Spence and
carried by the following vote:- Ayes:Councilmen Krumb, Walker, MacRae, Spence,
Morgenstern, Probst and Bullock, (7).

A report was received from the Municipal Electric Light Plant for the month of
January, 1912. Ordered filed.
A continuation certificate was received from the American Surety Company on the
Noes:None. Absent: Councilmen Hammond
April End, 1912.
D. J. McQuarrie presened an application for a gratuitous license to do a junk
business. Mr. Spence moved it be granted, subject to the wagon license, seconded
by ]fir. Walker and carried.
The Clerk notified the Council that I. N. Chapman had been subpoeaned to give
testimony in the United States Court at Los Angeles an April 19th, 1912, and stated
that Mr. Chapman desired to be granted a leave of absence in connection therewith.
Mr. Krumb moved that Mr. Chapman be granted the required leave of absence, seconded
by Mr. Spence and carried.
A communication was received from the Secretary of the International Congress
on Hygiene and Demography to be held at Washington, D. C. in September, 1912. 'Mr.
Morgenstern moved that the matter be referred to the Board of Health, seconded by
Mr. Probst and carried.
Councilman Ells arrived and was noted present.
A communication was received from the Alameda Chamber of Commerce requesting
the Council to co-operate with them by influencing legislation favorably to a
Greater California Redwood Park. Mr. Walker moved that it be referred to the
Committee of the whole, seconded by Mr. Ells and carried.
A communication was received from the Alameda Chamber of Commerce requesting
the support of the Council in influencing legislation favoring the Borah-Jones
Bill, Senate Uo. 3367, requiring three years residence on a Homestead entry, allow-
ing a vacation of six months during the year. Mr. Walker moved that it be ref err-
ed to the Committee of the whole, seconded by Mr. Ells, and carried.
A conmunication was received from the Peoples Water Company acknowledging
receipt of a memoranda requesting certain data and information which the Council
thought necessary for the establishment of reasonable water rates for the fiscal
year ending June 30th, 1912. Mr. Walker moved that it be referred to the Finance
Committee, seconded by Mr. Spence and carried.
A communication was received from the Board of Health requesting the Council
to adopt an Ordinance to protect human beings and animals from rabies, by requiring
the muzzling of dogs or the prevention of same from running at large. Mr. Walker
moved that in view of the fact that at the present time there were no rabies in
the. City of Alameda and that the Southern Pacific Company and the Oakland Traction
Company were transporting no dogs into the city, that the communication be filed,
seconded by Mr. Ells and carried.
A communication was received from P. O. Bakke calling attention to the unsani-
tary condition of a shack located on the northwest corner of Mound and Washington
Streets and asking that the same be condemned. Ordered filed, and thereupon Mr.
Morgenstern offered the following Resolution and moved its adoption:-
WHEREAS, Complaint has been made against the unsanitary condition of a build-
ing located on the northwest corner of Washington and. Mound Streets and request
made that the same be condemned, and
WHEREAS, the Health Committee of this Council upon investigation believe that
the complaint is well founded, now therefore be it
RESOLVED, that the matter be referred to the Board of Health with the recommenda-
tion that said Board proceed to have the said building condemned.
Mr. Probst seconded the Resolution and it was adopted and passed by the following

Councilman Hammond arrived and was noted present.
A report was received from the Street Committee relative to the complaint
against a building located at the northwest corner of Lincoln Avenue and. Chestnut
Street stating that the health regulations complained of were being complied with,
that the owner of said building had agreed to give the necessary land to widen the
sidewalk provided the city would assume the expense of moving the building back,
and recommended that as there were no funds available for the purpose that the
Council drop the matter, unless the owner would remove the obstruction himself, stat-
ing further that it had ascertained that the expense of such moving would not ex-
ceed the sum of 5O.00. Er. Krumb moved that the report be adopted and the Clerk
be directed to notify the owner of the Council's action, seconded by 1dr. Bullock
and carried..
A communication was received from the Board of Electricity to which was attach-
ed. a communication from S. E. Biddle and the Board's reply to same, in which S. E.
Biddle offered to lease the Municipal Electric Li

t Plant for a period of twenty
years, said. Board stating that it awaited the instructions of the Council as to
what it desired done in the matter. Mr. Hammond moved that it be filed, seconded
by Mr. Probst and carried. Thereupon the Public Utilities Committee of the Coun-
cil presented a report, to which was attached an opinion from the City Attorney in
which he gave it that the city could not ma1 ce such leae. Mr. Probst moved that
the report be adopted, seconded by Mr. Ells and carried.
The Street Superintendent presented a report that the work of changing the
width of Oak Street between San Jose Avenue and Clinton Avenue and the improving
of said roaaway and street crossings had been completed. Mr. Krumb moved that the
report be approved and filed, seconded by Mr. Probst and carried.
An affidavit showing due publication of Notice Inviting Proposals or the con-
struction of lamp posts, conduits, and wiring to be done on certain streets in the
Cit:1, of Alameda under Resolution of Intention No. 782. Ordered filed. The Clerk
reportea that no bids had been received in response to said notification and thereupon
Krumb offered the following Resolution and moved its adoption:-
WHEREAS, the Council of the City of Alameda on the 6th day of February, 1912,
adopted. its Resolution of Intention No. 782 declarirg its intention to order that iron
pipe electric lamp posts each with a cast iron top and ground glass globe and lamp
and set up in a concrete base, be erected and constructed on both sides of the follow-
ing streets and avenues in said city between the limits thereof hereinafter mentioned;
said lamp posts to be placed at intervals of 150 feet along each side of said streets
and avenues, and arranged. so that the lamp posts on one side of any such street or
avenue shall alternate with those on the other side thereof; and that said lamp
posts shall be wired and connected by means of underground conduits of iron pipe for
operation by the Municipal Electric Light Plant of said city; that said improvement
shall be made and constructed on the following named streets and avenues, to wit:
Lincoln Avenue from Park Street to Chestnut Street; Pacific Avenue from Park Street
to Chestnut Street; Buena Vista Avenue from Park Street to Chestnut Street; Eagle
Avenue from Mulberry Street to Chestnut Street; Eagle Avenue from Park Street to
Oak Street; Clement Avenue from Park Street to Chestnut Street; Bland2ng Avenue
from Park Street to Oak Street; Park Street from Lincoln Avenue to the United. States

Buena Vista Avenue to Clement Avenue; Walnut Street from Lincoln Avenue to Clement
Avenue; Mulberry Street from Buena Vista Avenue to Clement Avenue; Willow Street from

Avenue; Chestnut Street from Lincoln Avenue to Clement Avenue; and
WHEREAS, in accordance with the instructions contained in said Resolution of
Intention NO. 782. adopted as aforesaid on the 6th day of February,1912, and in
accordance with the provisions of an Act of the Legislature of the State of Cali
fornia entitled , "An Act to provide for the lighting of public streets, lanes,
alleys, roads and places in municipalities, and for the assessment of the costs
and expenses thereof upon the property benefited thereby" adopted March 21, 1905,
and acts amendatory thereof, the Board of Electricity of the City of Alameda on
the 6th day of February, 1912, filed with the Clerk of said City Council its
report in writing; and
WHEREAS, after further proceedings regularly had as provided by law, said City
Council of the City of Alameda did, on the 5th day of March, 1912, by resolution
over-rule all protests against said improvement and the assessment for said improve-
ment, and thereupon confirmed the proposed assessment for said improvement, and
thereupon adopted as a whole the Said report of the Board Of Electricity of the
City of Alameda; and,
WHEREAS, said City Council di Upon said 5th day of March 1912, pass a
resolution ordering said improvement to be done and made, and
WHEREAS, pursuant to order of the said Connell of the City of Alameda, the
City Clerk of said City of Alameda advertised for bids for the construction of
lamp posts, conduits and wiring on Lincoln Avenue from Park Street to Chestnut
Street; Pacific Avenue from Park Street to Chestnut Street; Buena Vista Avenue
from Park Street to Chestnut Street; Eagle Avenue from Mulberry Street to Chest-
nut Street; Eagle Avenue from Park Street to Oak Street; Clement Avenue from
Park Street to Chestnut Street; Blanding Avenue from Park Street to Oak Street;
Park Street from Lincoln Avenue to the United States Tidal Canal; Oak Street
from Central Avenue to Blanding Avenue; Elm Street from Buena Vista Avenue to
Clement Avenue; Walnut Street from Lincoln Avenue to Clement Avenue; Mulberry
Street from Bueiia Vista Avenue to Clement Avenue; Willow Street from Lincoln
Avenue to Clement Avenue; Stanford Street from Buena Vista Avenue to Clement
Avenue; Chestnut Street from Lincoln Avenue to Clement Avenue, in accordance with
the plans and specifications for the said work adopted by the City Council of
the City of Alameda as aforesaid; said advertisement was published in the manner
and for the time provided by law; and
WHEREAS, it appears to said Council that the time when sealed bids for said
work was advertised to be received, was, to wit, up to the hour of Five o'clock
P. M. of Tuesday, the 2nd day of April, 1912; and
WHEREAS, it further appears to said Council that that time has passed and
that no' bids have been received; now, therefore, be it
RESOLVED, that it be, and it is hereby ordered that said proposed contract
be not made, and that the municipality itself execute the work embraced therein
in accordance with the plans and specifications adopted for such work and employ
the labor and provide the material, appliances and supplies necessary therefor;

funds which have been collected therefor by the Tax Collector of said City of
Alameda by virtue of the proceedings heretofore had under said. Resolution of In-
tention No. 782, and as provided by law for said improvement.

Affidavits were presented showing due publicationand posting of Eotice of
TIme set for hearing protests in the matter of the erection of electroliers under
Resolution of Intention No. 783. Ordered filed. The Clerk reported that no
protests had been presented and thereupon Mr. Hrumb offered the following Resolution
and moved its adoption:-
WHEREAS, the City Council of the City of Alameda did, on the 5th day of March,
1912, pass its REsolution of Intention No. 783 to order the following improvement
tj be made in said city, namely:-
That iron pipe electric lamp posts each with a cast iron top and ground glass
globe and lamp and set uplin a concrete base, be arected and. constructed on both
sides of the following described streets and avenues of said city, between the
limits thereof hereinafter mentioned; said lamp posts to be placed at intervals
of one hundred and fifty feet along each side of said streets and. avenues and
arranged so that the lamp posts on one side of any such street and avenue shall
be alternate with those on the other side thereof, and that said lamp posts shall
be wired and'connected by means of underground conduits of iron pipe for operation
by the Municipal Electric Light Plant of said city; that said improvement shall be
made and constructed on the folloy;ing named streets and avenues to wit:- Central
Avenue from 8th Street to 4th Street; Palace Court from 6th Street westerly to its
termination; Taylor Avenue from 9th Street to 3rd Street; Santa Clara Avenue from
9th Street to 3rd Street; Haight Avenue from 4th Street to 3rd Street; Lincoln
Avenue from 9th Street to termination west of 5th Street; Lincoln Avenue from
4th Street to 3rd Street; Pacific Avenue from 9th Street to Main Street; Buena
Vista Avenue from 9th Street to Webster Street; E agle Avenue from 8th Street
westerly to the Southern Pacific Right of Way; 9th Street from Pacific Avenue to
the northerly termination of 9th Street; Eason Street from P ci:fic Avenue to the
northerly termination of Eason Street; 8th Street from CEntral Avenue to the
northerly termination of 8th Street; Page Street from Central Avenue to Santa
Clara Avenue; Concordia Street from Lincoln Avenue to Pacific Avenue; 6th Street
from Haight Avenue to Pacific Avenue; 5th Street from Haight Avenue to Pacific
Avenue and 4th Street from Central Avenue to Pacific Avenue; and
WHEREAS, there were no protests presented a"gainst said improvement, or
against the assessment for said improvement; now therefore, it is hereby
RESOLVED, that the proposed assessment for said improvement be, and the
same is hereby confirmed; and be it further
RESOLVED, that the report of the Board. of Electricity of the City of Alameda
presented and filed on the 5th day of March, 1912, with the Clerk of said Council
be, and the same is hereby adopted as a whole.

Mr. Krumb offered the following Resolution and moved its adoption:-
RESOLVED, that, whereas, the City Council of the City of Alameda, did, on
the 5th day of March, 1912, pass its Resolution of Intention No. 783 to order the
hereinafter described work to be done and improvement to be made in said City of
Alameda; and. whereas, upon the filing of the report of the Board of Electricity
of the City of Alameda, the City Council by resolution appointed a time and place
for hearing protests relation to the proposed improvement, which time and place
were fixed as follows,to wit: Tuesday, the 2nd day of April, 1912, at the hour of
Eight o'clock F. Y., at the Council Chamber of the City Council at the City Hall
in the City of Alameda at the northwest corner of Santa Clara Avenue and Oak
Street; and, whereas, notice of said hearing was duly and regularly published
required by law and the resolution of said Council, as appears from the affidavits
of F. E. Browning and John S. Daveler, now on file in the office of the City Clerk
of the City of Alameda. and, whereas, notices of the passage of said. Resolution of
Intention No. 783 and of the filing of said report and of the hearing of the
protests against said improvement, as aforesaid, headed, "Notice of Local Improve-
ment," were duly and regularly posted along all streets, and parts of streets,
within the assessment district described in said Resolution of Intention, at not
• more than 300 feet in distance apart, in form and manner as required by law, as
appears from the affidavits of George N. Browning and P. E. Browning, City Clerk
of the said City of Alameda who, upon the completion of the posting of said
notices, forthwith filed said affidavits in the office of said City Clerk; and,
whereas, there were no protests presented to said Council against said improve-
ment or the as for said improvement; and
WHEREAS, said Council did then and there confirm the proposed assessment
for said improvement, and did then and there adopt as a whole the said report of
the Board of Electricty, therefore be it
RESOLVED, That the public interest and convenience require and the City
COuncil of the City of Alameda hereby orders the following improvement to be done
and made in said city, namely:-
That iron pipe electric lamp posts each with a cast iron topeand ground
gla. ss globe and lamp set up in a concrete base be erected and constructed on
both sides of the following described streets and avenues in said city between the
limits thereof hereinafter mentioned; said lamp posts to be placed t intervals
of 150 feet along each side of said streets and avenues and arranged so that the
lamp posts on one side of any such street or avenue shall be alternate with those
on the other side thereof; and that said lamp posts shall be wired and connected
by means of underground conduits of iron pipe for operation by the Municipal
Electric Light Plant of said city; that said improvement shall be made and con-
structed on the following named streets and avenues, to wit: Central Avenue from
8th Street to 4th Street; Palace Court from 6th Street westerly to its termination;
Taylor Avenue from 9th Street to 3rd Street; Santa Clara Avenue from 9th Street
to 3rd Street; Haight Avenue from 4th Street to 3rd Street; Lincoln Avenue from
9th Street to termination west of 5th Street; Lincoln Avenue from 4th Street
to 3rd Street; Pacific Avenue from 9th Street to Main Street; Buena Vista Avenue
from 9th Street to Webster Street; Eagle Avenue from 8th Street westerly to the

property benefited thereby," adopted. March 1, 1905.
Mr. Walker seconded the Resolution and it was adopted and passed by the

Mr. Hammond moved- that the Clerk be directed to advertise for proposals
for the construction of lamp posts, conduits, and wiring to be done on certain
streets inthe City of Alameda, as provided for under Resolution of Intention

Mr. Krumb brought up the matter of the condition of the roadbed of the track
maintained by the Oakland Traction Company on the west side of the Webster Street
roadway from the bridge which spans the slou0i which drains the marsh east of the
Webster Street road, a short distant norther of the road leading from the Webster
Street roadWay to 8th Street, to a point about one hundred feet north of said
bridge, and moved that the Clerk be directed to address a communication to the
Oakland Traction Company calling its attention to the matter and requesting that
the roadway be re-ballasted at said point, seconded by Mr. Probst and carried..
Mr. Probst reported that the Park and Playground. Committee would meet, in
the future, on Monday evening, prior to the first Council meeting of each month
between the hours of seven and eight o'clock in the Special Committee room, instead
of on Monday afternoon as had been the custom.
Councilman Probst addressed the Council stating that the Surf Beach Park
Company intended to invite small boys from neighboring cities to visit Alameda
and offering free use of their baths on Sunday mornings, and, for that purpose
requested that permission be granted to allow the said. boys to wear bathing
trunks, instead of a full suit as called for by the Ordinance, Mr. C. R.
Smith, Manager of the said. Baths also aciressed the Council on the matter,
and thereupon 41x. Probst introduced a Bill entitled "A Bill for Ordinance No.
To Amend Section 4 of Ordinance No. 148 of the city of Alameda Relating to De-
fining Certain Misdemeanors and. Providing Penalties for Violation", which was
laid over under the provisions of the Charter.
Mr. Morgenstern moved that the Clerk notify the owner of the building used
for dairy purposes obstructing the roadway of Atlantic Avenue, between Chestnut
and. llow Streets to comply with his agreement to move the same by the first
of May, 1912, seconded by Mr. 'faiker and carried.
There being nof ruther business to transact Er. Probst moved that the Coun
cil adjourn, until Tuesday evening, April 9th, 1912, at 8 o'clock.
