REGULAR MEETING OF TEE COUNCIL OF THE CITY OF ALAMEDA,
TUESDAY,MAY 7TH 1912.
The meeting convened, with Council President E.B.Bullock,presiding.
The Roll was Called and Councilmen Walker,Mac Rae,Hammond,Spence,Morgenstern
and Bullock were noted present and Councilmen Krumb,Ells and Probst absent.
The minutes of the meeting of April 16th 1912,were read and ordered approved.
Councilmen Krumb and Ells arrived during the reading of the minutes and, were
noted present.
Mr.Mac,Rae offered the following resolution and moved its adoption:
WHEREAS,the work of constructing the East End. Intercepting Sewer has been com-
pleted and, all claims for the work of said construction have been paid and there re-
mains a balance in the fund set aside for the payment of said claims,therefore be it
RESOLVED,that the said balance,amounting to the sum of Seven Thousand,seven
hundred and eighty-four and 63/100 (07,784.63) Dollars,be and the same is hereby
transferredfrom tne East End Sewer Fund to a fund to be known and, designated as Spe-
cial Sewer Fund,and said. Special Sewer Fund only to be dram, on for the payment of
claims for maintaining the main sewer system of the City of Alameda,and the Auditor
and the Treasurer are hereby directed to make the said transfer upon their respective
books.
Mr.Spence seconded the resolution and it was adopted and passed by the follow-
ing vote. Ayes:Councilmen Krumb,Walker,Hammond,Mac Rae,Spence,Ells,Morgenstern
and Bullock,(8). Hoes:None. Absent:Councilman Probst,(1).
Mr.Spence offered the following Resolution and moved its adoption:
Resolved,That the sum of One Thousand Two Hundred and Fifty (1250) Dollars be
and the same is hereby transferred from the General Fund to Local Improvement Fund
Mo.784,as a loan to be re-transferred back to the General Fund,when sufficient money
has been collected by the Tax Collector for the improvement,contemplated by Resolu-
tion of Intention No.784,and turned over to_the Treasurer and deposited in said Fund,
and the Auditor and the Treasurer are hereby directed to affect the said transfer
upon their respective books.
Mr.Mac Rae seconded the resolution and it was adopted and passed by the follow-
ing vote. Ayes:Councilmen Krumb,'aalker,Hammond,Mac Rae,Spence,Ells,Morgenstern
and Bullock,(8).
Noes:None. Absent:Councilman J2robst,(1).
Mr.C.P.Magagnos addressed the Council relative to a conference with the Cham-
ber of Commerce regarding changes in the Ordinance relative to business licenses.
Mr.Walker moved that the matter be referred to the Committee of the Whole,seconded
by Mr.Hammond and carried.
Claims amounting to 01762.30 against the General Fund; against the Police Fund
amounting to 013.65:against the Fire Fund, amounting to 096.00:against the Street Fund
amounting to $3040.17:against the Electric Light Fund amounting to 05709.37:against

Councilman Probst arrived daring the reading of the Claims and was noted •
present.
Mr. Hammond moved that the claims as Tead be paid, seconded by Mr. Probst and
carried by the following vote:- Ayes:Councilmen KruMb, Walker, Hanmond, MacRae,
Spence Ells Morgenstern, Probst and.Bullock, (9). Noes:None. A.13sent:None.
A report was received from the Mayor, Auditor and. City Clerk certifying that
they had on April 24th, 1912 counted the money in the custody of the City Treasurer
and found the amount to be 0103,917.52, and found that the same agreed with the bal-
ance as shown b:; the Auditor's books. Ordered filed.
A report was received from the Auditor showing the balances'in.the various funds
on Apri1,50th, 1912. Ordered. filed.
A report was received from the Municipal Electric Light Plant for the month of
February, 1912. Ordered filed.
A report was received from the Poundmaster for the month of April 1912.
Ordered filed.
A Bond was received from the United. States Fidelity and Guaranty Company bond-
ing H. P. Wichman as Collector and Clerk in the service of the Municipal Electric
Light Plant, in the aim of 01,000.00. Ordered filed.
C. E. Foster presented an application for a gratuitous licence to peddle fruit
and vegetables; Samuel S. Green, to peddle notions, etc; F. Miller to peddle, from
house to house, bananas, oranges and other fruits. Mr. Walker moved that they be
granted, seconded by Mr. Probst and carried.
The Crescent Manufacturing Company presented a petition for a gratuitous license
to demonstrate and take orders for Crescent Baking Powder, the said orders to be
made on local gorcers. Ivll. Krumb moved that it be granted, seconded by Mr. Hammond
and carried.
Mrs. Annie L. Abbott presented a petition for a gratuitous license to conduct
a public bathing business at 448 Central and Mrs. Barbara_ Thompson presented a peti-
tion for a gratuitous license to conduct a bathing business at 604 Central Avenue.

A communication was received from Dr. Halpruner of Elmhurst giving his advice
as to how the Electric Light Plant should be conduCtea. Ordered filed.
A communication was received from the Board of Electricity reporting that, on
account of an opinion given by the City Attorney, the city had no legal authority
to enter into a contract to purchase electric power from an outside source,and-that
therefor it had rejected all the bids and returned the certified rthecks. Ordered
filed.
An Affidavit was presented showing due publication of Ordinance No. 598 calling
and providing for a Special Municipal Bond Election in the City of Alameda on April
30th, 1912. Ordered. filed.
L-:-An Affidavit was presented showing due posting of Ordinance No. 598 calling and
providing for a Special Municipal Bond. Election to be held in the City of Alameda on
Aril 30th, 1912 in the twenty-five municipal election precincts established by the
said. Ordinance. Ordered filed.
A report was presented by the City Clerk giving a statment of the cost of the
Special Municipal Bond. Election held on the 30th day of April, 1912, as 2,237.62.
Oraered filed.
Mr. MacRae moved that the Council now proceea to canvass the votes cast at
the Special Municipal Bond. Election which was held in the City of Alameda on April
30th, 1912, at which was sUbmitted the following propositions:-
Proposition One. To incur a bonded indebtedness by the city of Alameda to the
amount of One hundred and fifty thousand (150,000) Dollars for the acquisition, con-
struction and completion of a building to be used as a power house for the Municipal
Electric Light Plant, and the acquisition and installation of machinery and apparatus
for said. Plant to be usea in generating electricity, and the acquisition of wire for
said. Plant to be used in increasing the distributing system of said. Plant. Bonds
issued for such purpose shall bear interest at the rate of 5 per centum per annum,
payable semi-annually.
Proposition Two. To incur a bonded indebtedness by the City of Alameda to the
amount of Eight Thousana (8,000) Dollars for the purpose of the acouisition, construc-
tion and completion of a fire alarr and police telephone and signal system for said. •
City. Bonds issued for such purpose shall bear interest at the rate of 5 per-centmn
per annum, payable semi-annually .
Proposition Three. To incur a bonded indebtedness by the City of Alameda to
the amount of Forty-two thousand (42,000) Dollars for the purpose of the acquisition
of automobile fire apparatus, including one automobile fire engine, one automobile hook
and ladder fire truck, six automobile chassis to be used in converting horse-power
fire apparatus to motor driven fire apparatus, one automobile tractor for steam fire
engine, one automobile tractor for hook and ladder fire truck, one automobile for
use of the Chief of the Fire Department, also the acquisition, construction and com-
pletion of water pumping stations, and also the construction and completion of repairs
and additions to the ,Jebster Street fire house, known and designated as Fire Station
No. 2, Bonds issued for such purpose shall bear irterest at the rate of 5 per centum
per annum, payable semi-annually.
The motion was seconded by Mr. Spence and carried, and thereupon the Council
proceeded to canvass the said returns and to eatfmate the vote of each precinct for
and agqinst each of said. Propositions, from which it appeared that Proposition No.
May 7th, 1912,
votes and 1224 negative votes; that Proposition No. Three, above mentioned receiv-
ed a total of 2483 affirmative votes and 1392 negative votes and that the total num-
ber of voters voting at and ballots cast at said election were 3991; that no votes
wore cast thereat, which by reason of non-compliance with the Election Laws were
not counted, and thereupon Mr. _ offered the following Resolution and moved
its adoption.
RESOLVED, That it be and hereby is declared from the canvass of the votes
cast at the special election held. April 30th, 1912, that the first and second only
of the three propositions submitted received an affirmative vote of more than two-
thirds of all the voters voting at said special election, and that said first and
second propositions and each of them be declared to have carried, and that the re-
maining proposition, to wit: the third proposition submitted failed to receive an
affirmative vote of more than two-thirds of all the voters voting at said special
election, and that said third proposition be, and the same is hereby declared to
have been defeated, and that the Clerk be directed to enter upon the minutes of the
Council the following statement of the result of said canvass in accordance with
the provisions of Section 1282 of the Political. Code of the State of California:-

Mr. MacRae seconded the Resolution and it was adopted and passed by the follow-
ing vote:- Ayes:Councilmen Krumb, Walker, Hammond, MacRae, Spence, Morgenstern,
Probst and Bullock, (8). Noes:None. Absent:Councilman Ells, (1).
Mr. Spence introduced A Bill entitled "A Bill for Ordinance No. Determining
and Declaring that the Special Municipal Election held in the City of Alameda,
California, on the 30th day of April, 1912, Pursuant to the Provisions of Ordinance
No. 598 of said City, was duly and regularly called, held and conducted, that Notice
thereof was duly given, that the Returns thereof have been duly Canvassed, and to
Determine and Declare the Resolut of said Election and Canvass; Providing for the
Incurring of a Bonded Indebtedness by said city in the sum of One Hundred and Fifty-
eight Thousand (158,000) Dollars, in Lawful Money of the United States, Payable in
Forty (40) years, in equal annual Installments, with interest at Five per cent per
annum, Payable Semi-annually, to Provide for the Issuance of Bonds of said City,
Evidencing said Indebtedness, and Providing for the Payment of said Indebtedness'!
etc.,which was laid over under the provisions of the Charter.
A communication was received from the City Clerk calling the attention of the
Council to a vacancy. in the Board of Heatlh, caused by the resignation of J. S.
Hanley, whose term of office would have expired had he continued to hold office on
April 22nd, 1912, also that the term of office of N.; C. Hawks, as Library Trustee
expired on April 22nd, 1912. Mr. Probst moved that the matter be referred to the
Committee of the whole, seconded by Mr. Spence and, carried.
A communication was received from.J. W. Byrne, Janitor of the City Hall, ask-
ing for his annual vacation at this time in order to make arrangements for the
care of his brother, who was lying ill at Sacramento. Mr. Walker moved that it be
granted, seconded by Mr. Hammond and carried.
A communication was received, from W. A. WhYtney, Superintendent of the Western
Division of the Southern Pacific Company, stating that the station in Lincoln Park
on Fernside Boulevard was now receiving proper janitor service. Ordered_ filed.,
A communication was received from the Alameda Free Library requesting the
Council to advertise for bids for the work of replacing the present glass windows
in the Library building, by wired glass windows in accordance with the specifications
for fire-proofing the said windows, as attached to the said communication. Mr.
MacRae moved that the coinnunication be f ile d an d the specifications adopted and that
the Clerk be directed to advertise for bids in accordance therewith, seconded. by

A communication was received from the Secretary of the Board of Health stating
that they had taken up the matter of the reciuest to c on demn. t he building located on
the northwest corner of 1.,iashin.gt on and_ Mound_ Streets and that the matter was now in
the hands of the City Attorney. Ordered filed.
A communication was received from John Johnson, giving his address as Box 47,
Reno, Nevada, asking information relative to the complaint against the building owned
by him at the northwest corner of Washington and Mound_ Streets. Mr. 1,y

A communication was received from Norman Rushton Attorney, relative to the
provisions of the Roseberry Employers Liability Act where the same might affect
cities and counties throughout the State. .Mr. Balker moved that the matter be re-
ferred to the City Attorney, seconded by Mr. Hammond and carried.
A cannunicationwas received from Mayor Nilson of Berkeley, relative to the
forming of a water district for the municipalities on the east side of the San
Francisco Bay, and requesting that Alameda co-operate. Mr. Krumb moved that the
matter be referred to the Mayor seconded by Mr. Morgenstern and carried.
A _Deed., properly recorded was received from Edwin Be Robinson to a str±p of
land to be used for street purposes on the south side of Central Avenue, immediate-
ly west of Washington Park. Mr. Krumb moved that the same be received and filed
and that the Clerk be directed to convey the thanks of the Council to Mr. Robinson,
seconded by Mr. Hammond and carried.
A communication was received from the Street Superintendent calling the
attention of the Council to the bad condition of the crossing of Park Street and
Lincoln Avenue, stating that he had notified the railroad companies. Who had recent-
ly raised:their tracks to grade, to repair the same but that he had been unsuccess-
ful in having the necessary work aone, and requesting that the City Council instruct
the Clerk to notify the said. Companies to bituminize the said crossing to his satis
faction and that failing so to do ,the Council advertise for bids to have the work
done at their expense. Mr. Walker moved that the request be wmplied With, second
ed by Mr. Frobst and.carried.
Protests Were presented from Mrs. Eary P. Murphy amd M. A. Victors agains± the

ro. 783. Mr. Walker moved that they be filed and. reSerred to the City Attorney,
seconded by Mr. Krumb and carried.
An affidavit was presented showing due publ±cation of Notice Inviting Proposals
for the construction of lamp posts, conduits and wiring to be done on certain streets
in the City of Alameda, undor Resolution of Intention No. 783. Ordered -filed.
The Clerk reported that no bids had been presented in answer to the said adver-
tisement and thereupon Yr. Krumb offered the following Resolution and moved its
adoption:-
WiERiLS, the Council of the City of Alameda on the 5th clay of March, 1912,
adopted it Resolution of Intention No. 783 declaring its intention to order that
iron pipe electric lamp posts each with a cast iron top and ground glass globe and
lamp set up in a concrete base, be erected and constructed on both sides of the
following stroots and avenues in said City between the limits thereof hereinafter
mentioned; said lamp posts to be placed at intervals of 150 feet along each side
of said streets and avenues, and arranged so that the lamp posts on one side of any
such street or avenue shall alternate with those on the other side thereof; and that
said lam posts shall be wired and connected by means-of underground conduits af iron
pipe for operation by the municipal -electric light plant of said city; that said im-
ffoOVOMMat shall be made and constructed on the following named streets and avenues,
to wit: Central Avenue from 8th to 4th Street; Palace Court from 6th Street wester-
ly to its terMination; Taylor Avenue from 9th Street to 3rd. Street; Santa Clara

with the provisions of an Act of the Legislature of the State of California entitled,
"An Act to provide for the lighting of public streets, lanes, alleys, roads and
places in municipalities, .and for the assessment of the cost and expenses thereof
upon the property benefited thereby" adopted March 21, 1905, and acts amendatory
thereof, the Board of Electricity of the City of Alameda on the 5th day of March
1912, filed with the Clerk of said City Council its report in writing; and,
WH'EREAS, after further proceedings regularly had as required by law, said City
Council of the City of Alameda did on the 2nd day of April, 1912, by resolution
over-rule all protests against said improvement and the assessment for said improve-
ment, and, thereupon confirmed the .proposed assessment for said improvement, and there-
upon adopted as a whole the said report of the Board of Electricity of the City of
Alameda i and
WHEREAS, said City Council did, on said 2nd day of April, 1912, pass a resolu-
tion ordering said improvement to be done and made; and,
WHEREAS, pursuant to order of the said Council of the City of Alameda, the
City Clerk of said City of Alameda advertised for bids for the construction of lamp
posts, conduits and wiring on Central Avenue from 8th Street to 4th Street; Palace
Court from 6th Street westerly to its termination; Taylor Avenue from 9th Street
to 3rd Street; Santa Clara Avenue from 9th Street to 3rd Street; Haight Avenue from
4th Street to 3rd Street; Lincoln Avenue from 9th Street to termination west of 5th
Street; Lincoln Avenue from 4th Street to 3rd Street; Pacific Avenue from 9th Street
to Main Street; Buena Vista Avenue from 9th Street to Webster Street; Eagle Avenue
from 8th Street westerly to the Southern Pacific Right of Way; 9th Street from Pacific
Avenue to the northerly termination of 9th Street; Nason Street from Pacific Avenue
to the northerly termination of Nason Street; 8th Street from Central Avenue to the
northerly termination of 8th Street; Page Street from Central Avenue to Santa Clara
Avenue; Concordia Street from Lincoln Avenue to Pacific Avenue; 6th Street from Haight
Avenue to Pacific Avenue; 5th Street from Haight Avenue to Pacific Avenue and 4th
Street from Central Avenue to Pacific Avenue, in accordance with the plans mid speci-
fications for the said work adopted by the City Council of the City of Alameda as
aforesaid; said advertisement was published in the manner and for the time provided
by law; and
WHEREAS, it appears to said Council that the Admewhen sealed bids for said
work was advertised to be received, was, to wit, up to the hour of Eight o'clock,
P.P. of Tuesday, the 7th day of May, 1912; and

that no bids have been received; now, therefore, be it
RESOLVED, that it be, and it is hereby ordered that said proposed contract be
not made, and that the municipality itself execute the work, embraced therein in accord-
ance with the plans and specifications adapted for such work and employ the labor and
provide the material, appliances and supplies necessary therefor; and it is further
RESOLVU, that the cost and expenses of such work shall be paid out of the funds
which have been collected therefore by the Tax Collector of said City of Alameda by
virtue of the proceedings heretofore had under said Resolution of Intention No..783, and
as provided by law for said improvement.

10±. Kruinb offered the following Resolution and'maved its adoption:-
RESOLVED, That the public interest and convenience require and that it is the
intention of the Council of the City of Alameda to order the following street work
to be done in said city, namely: That a salt glazed, vitrified iron stone sewer,
six inches in inside diameter, with four-inch Y branches and without house
connections, be constructed in the north ,side of Central Avenue in a right line
from the existing manhole, at the crossing of Eighth Street and. Central Avenue to a
new manhole to be constructed at a point three hundred and forty (340) feet westerly
from the western line of Eighth Street; thence in a right line to the exfsting-manhole
in the crossing of Page Street and Central Avenue.
Said manhole to be constructed hereunder shall be of brick masonry with cast iron
top and cover and eight (8) inch walls and botton in accordance with "Plan of Brick
Manhole" adopted by the Board of Trustees of the City of Alameda, January ilth, 189
and on file in the office of the City Clerk of saidcity, which plan is hereby referred
to and made a part hereof.

A communication was received from W. R. Scott, of the Southern Pacific Company,
relative to the demand o± the Council to remove the high tension power lines along
the lines of their electric railway in the City of AlEmeda. Mr. Walker addressed
the Council on same stating that at a meeting of the Committee of the whole on
Friday evening last, Mr. Hoover and. Mr. Clapp of the said Company had stated that
they would remove the wires complained of in the near future, and that they would
have something more definite regarding the exact time, to present at the next meet-
ing of the Council CoMmittee and therefore moved that the Railroad Company be granted
further time in which to have the said wires removed, seconded by Mr. ,Krnmb and.
carrie d.
Mr. Walker brought up the request, presented verbally, by Mr. Hartley, Secretary
of the Alameda Improvement Club requesting that a flag-man be stationed at the corner
of Webster Street and. Lincoln Avenue, and moved that the Clerk be. directed to request
the Southern Pacific Company to have a flagman placed. at said corner, seconded by Mr.
Probst and. carried.
MR. Krumb addressed the Council on the matter of the peculiar Construction of
the flooring of certain cars of the Oakland Traction Company. whereby a sbort RI;An

and was liable to injure some of the patrons and moved that the Clark be directed
to recuest the said Traction Company to discontinue the running of such cars on
the Alameda lines, seconded by Mr. Walker and carried.
Mr. Probst brought up the matter of the transportation of residents of
Alameda on the loca lines, and_ moved that the Clerk be requested to make demand
on the Southern Pacific Company to fix the fare on either the north or south side
lines to the station in Lincoln Park at two and one-half cents, seconded by Mr.
Kriamb and carried.
There being no further business to transact the Council adjourned until the
next regular meet ing, Tuesday, May 21st, 1912 at rt:.30 P.M.
