WEDNESDAY, SEPTEMBER 4TH, 1912.
The meeting convened with Council President E. B. Bullock presiding
The roll was called and Councilmen Krumb, Walker, MacRae, Spence, 1311s and
Bullock, (6) were noted present, and Councilmen Hammond, Morgenstern and Probst,
(3) absent.
Mayor Noy arrived and took the Chair as Presiding Officer.
The Minutes of the meeting of August 20th, 1912 were read and ordered approved.
Councilman Morgenstern arrived during the reading of the Minutes and was noted
present.

A report was received from the Mayor,Auditor and City Clerk certifying that they
had on August 31st counted the money in the hands of the City Treasurer and found the
amount to be $109,008.02 and that the said amount agreed with the Auditor's books.

A report a receaved from the Muiicipa1 Electric Light P1 or the fiseal
year ending June 30th 1912. Ordered filed.
W.F.Davis presented an application for a gratuitous license to peddle fruit and
vegetables. Mr.Spence moved that it be granted the same to include the wagon license,
seconded by Mr.Krumb and carried.
G.W.Christensen,City Hall Deputy presented an application for a vacation of two
weeks to commence September 4th 1912. Mr.Krumb moved that it be granted,seconded by
Mr.Bullock and carried.
A communication was received from Wilsie M.Martin.thanking the Council for its
action in denying a permit to the Alameda Athletic Association to hold a boxing contest
in the Wigwam at the south end of Webster Street. Ordered filed.
A communication was received from the League of Cala.Municipalities requesting
that delegates be appointed from Alameda to attend the convention of s e to be held
in Berkeley from September 23 to 28,1912. Mr.Krumb moved that the Mayor be authoriz-

A report was received from the Superintendent of the Municipal ifleetric Light
Plant regarding the complaint that hadbeen made against the maintenance of a guy
wire in front of the residence of Mr.H.H.Mc Lellan at 1544 Court Street,in which
he stated that it was absolutely necessary to hold the pole in position and that
the guy wire complained of was the most presentable that the said pole was maintain-
by the Telephone Company and used jointly. Mr.Walker moved that the matter be
referred to the City Clerk to take up with the Telephone Company in an effort to
obtain relief for the complaining party,seconded by Mr.Hammond and carried.
A communication was received from the Board of Electricity stating that it
was taking up with the Electrical Contractors Association the complaint against
the maintenance by the said. Board of a place of business to sell electrical sup-
plies. Ordered filed.
A report was received from the Finance Committee on the estimates that had
been filed by the various City Departments in which it estimated the amount nec-
essary to carry on the City business for the ensuing year at ';205306.00 and that
the tax rate would be on each 4100.00 the sum of $1.09. Mr.Hammond moved that
the report be filed,seconded by Mr.Walker and carried and thereupon Mr.Bullock
offered the following resolution and moved its adoption:-
RESOLVED,That the taxes for the City of Alameda,be and are hereby levied for
the current fiscal year as follows:-
On each $100.00 of the assessed valuation of all property both real and per-
sonal,in therCity of Alameda,and all property assessed on the Assessment roll of
said City for the current fiscal year a tax of 0..09 which is hereby apportioned
as follows:-

stern and. Bu lock,(8). Noes:None. Absent:Councilman ?robst,(1).
A communication was received from H.Krusie,Chairman of the Harbor Commission
to whom had been referred the petition of the Crowley Launch and Tow-boat Co.,for
permission to lease the water front property on the Oakland. Harbor east of Webster
Street and owned by the City,requesting information as to the legality of the
City's right to lease the said property for a term of ten years. Mr.Krumb moved
that the matter be referred to the City Attorney,seconded by Mr.Hammond and carried.
A communication was received from the Board of Free Library Trustees recom-
mending that the contract for installing the metal wire glass windows in the Libra-
ry Building be awarded to the Rulofson Metal Window Works,it being the only bid-
ders for the sum of $1158.00--Specification A. Mr.Mac Rae moved that the recom-
mendation be adopted,seconded by Mr.Hammond and carried by the following vote.

September 4th 1912.
Army,reporting that the trestle formerly used by the Railroad across the San Leandro
bay had been removed. Ordered filed.
A protest was received from Geo H.Mastick and several others against the grant-
ing of permission to allow the Railroad Company to run a power line along Pacific
Avenue without first having a chance to be heard in opposition. Mr.H : iond moved
that the matter be referred to the Board of Electricity,seconded by Mr.dalker and
carried.
A signed contract was presented from D.J.Lynch for the boring of a well in
Lincoln Park. Ordered filed.
A communicationilwas received from the Board of Health reporting that it had
complied with the provisions of Ordinance No.604,Section 2,by selecting the style
of muzzles to be provided for dogs. Ordered filed.
Two bonds were presented by the Argus Publishing Co.,to take the place of
the two now on file to cover the contmacts now held by the said Company for do-
ing the City Advertising and. Job Printing,with the United. States Fidelity and.
Guaranty Co.,as surety. The City Attorney reported that they were in due form
and thereupon Mr.Ells,offered the following resolution and moved its adoption:-
WHSREAS,the Argus Publishing Company entered into a contract with the City
of Alameda on the 15th day of February,1912,to do the city job printing;and.
WHEREAS,accompanying said contract was a bond for the sum of Five Hundred
Dollars conditioned for the faithful performance of said contract,and,whereas,T.G.
Daniells and Ed.R.Allen,the sureties upon said bond,desire to withdraw and be re
lieved of all responsibility therefrom,and,whereas,said Argus Publishing Company
offers a new bond of the United. States Fidelity and. Guaranty Company,a corporation,
conditioned the same as,and to take the place of and be accepted in lieu of said
bond upon which said T.G.Daniells and. Ed.R.Allen are sureties;and,whereas,it appe-
ars that said new bond is in due form and the surety thereon satidfactory,therefore
be it
RESOLVED,that said. T.G.Daniells and. Ed.R.Allen,and each of them,be and they
are hereby released and exonerated from all liability upon said bond heretofore
executed by them;and be it further
RESOLVED,that said bond of the United. States Fidelity and. Guar:, ty Company,
a corporation,be and the s e is hereby accepted in lieu of said bond upon which

Mr.Ells offered the following resolution and moved its adoption:-
WHEREAS,the Argus Publishing Company entered into a contract with the City
of Alameda on the 16th day of February,1912,to do all the advertising and publish-
ing,including all street work advertising,which may be required by said city,for
the year commencing February 16th,1912,upon the terms contained in said contract;
WHEREAS,accompanying said contract was a bond for the sum of Five Hundred.
Dollars conditioned for the faithful performance of said contract,and,whereas
T.G.Daniells and Ed R.Allen,the sureties upon said bond,desire to withdraw and be

Mr.Walker seconded the resolution and it was adopted and passed by the fol-

stern and Bullock,(8). Noes:None. Absent:Councilman Probst (1).
A petition was received from the residents and property owners of property
fronting Liberty Avenue requesting that permission to lay concrete curbing along
the edge of the sidewalks of said Avenue in such a manner as to not remove the
trees bordering them. Ordered filed. A report was received from the Street
Committee on the same matter in which it recommended that the trees be removed
before any concrete curbing is constructed. Ordered filed and thereupon Mr.
Hammond moved that the matter be re-referred back to the Street Committee for
further investigation,seconded by Mr.Spence and carried.
A report was received from the Street Committee in which it recommended
that the petition of John Goldstone for the City to pay for the construction of
a cement sidewalk in front of his property on Lincoln Avenue at the northeast
corner of Schiller Street provided that he deed the necessary property for the
said sidewalk,be denied. Mr.Hammond moved that the recommendation be adopted
seconded by Mr.Ells and carried.
A communication was received from the Street Committee recommending that the
City pay for the construction of a cement coping on the west side of Washington
Park between the said park and the property owned by U.H.Robinson,providing that
he do the street work of a street that he contemplated opening into his property.
Mr.Hammond moved that the recommendation be adopted,seconded by Mr.Bullock and
carried.
Mr.Krumb offered the following Resolution and moved its adoption:-
Resolved,That the public interest and convenience require and that it is the
intention of the Council of the City of Alameda to order the following improvement
to be done in said city,namely:
That iron pipe electric lamp posts each with a cast iron top and ground glass
globe and lamp and set up in a concrete base,be erected and constructed on both
sides (except as hereinafter specifically described),of the following described
streets and avenues in said city between the limits thereofhereinafter mentioned;
said lamp posts to be placed at intervals of 150 feet along each side of said
streets and avenues,and arranged so that the lamp posts on one side of any such
street or atenue shall be alternate with those on the other side thereof;and that
said lamp posts shall be wired and connected by means of underground conduits of
iron pipe for operation by the Municipal Electric Light Plant of said city;that
said improvement shall be made and constructed on the following named streets and
avenues to wit: the south half of Harrison Avenue from Park Street to a point three
hundred fifty-eight and 23/100 (358.23) feet east of Pearl Street;BlandingAvenue
September 4th 1912.

trict to be benefited by said improvement and to be assessed to pay the costs and
