The roll was called and Councilmen Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst and Stewart, (7) were noted present and Councilmen Hammond and Roth, (2), absent. Councilman Hammond arrived later and was noted present. ■J A communication was read from the Board of Police and Fire Commissioners under date of June 27th, 1913, in which request was made that the Council set aside 1416.68 to settle claims against the Fire Department. Ordered filed. In conformity with the request made in the communication Mr. Bartlett introduced the following Resolution and moved its;adoption:- RESOLVED that the sum of One Thousand Four Hundred Sixteen and 68/100 (1416.68) Dollars, be and the same is hereby transferred from the General Fund. Contingent, to the General Fund, Fire being for expenses incurred and contract- ed for by the Police and Fire Commission and not provided for in the Budget allow- ance for the fiscal year 1912-1913. Notice to all concerned. The attention of a].1 persons interested is called to the following quot- ed action of the ,ilar Department on June 3, 1913, affecting the harbor lines along the Oakland. Tidal Canal, between Oakland Harbor and. San Leandro Bay, pre- scribed by the Var Department under date of January 20, 1913: L2 (5 June 27th, 1913. The owners of property abutting the lands included in the right of way acquired by the United. States for the Oakland Tidal Canal shown on accompanying sheet No. 5 are hereby authorized and permitted to occupy, with open-work, non-permanent structures for wharf purposes, the portions of the strip of U. S. property fronting their respective propoerties and sitated between the pierhead and bulkhead lines approved Jan. 20, 1913, without special lease or charges of any kind, it being expressly understood that this permission is revocable at any time when this area may be again re- quired for purposes of navigation and shall not be construed as'a relinquish- ment of the Government title to the said right of way. Pryal, der date of June a4 1 1 addressed to the iater Committee of the City Council, relative to an inde- pendent water plant for the City was received and ordered filed. The Clerk was directed to return the clipping enclosed with the communicationlas per request in the communication. Later in the meeting the communication was read at the request of Mr. S. Miller. e\ A communication from the City Attorney was read under date of June 25th, 1913, in which he asked for permission to subscribe for the decisions of the Railroad. Commission for the use of the City. Mr. Morgenstern moved that the request be granted, seconded by Hr. Bullock and carried bY the follow- ing vote:- Ayes:Councilmen Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst and Stewart, (7). Noes:None. Absent:Councilmen Hammond and Roth, A communication from G. Schumacher was received, under date of June 23.st, 1913, relative to a plan that the writer had of disposing of garbage from Oakland on his land on Bay Farm Island. Ordered filed. A communication was received from the Railroad Commission of the State of California, under date of June 20th, 1913, addressed to the City Clerk, asking for information regarding the fixing of local rates for gas and electric utilities. The Clerk announced that he had answered the communica- tion and it was ordered filed. Oaths of office were received from the following and ordered filed:- G. Christensen, as Deputy Assessor. G. W. Christensen, as City Hall Deputy. Mayrisch, as Deputy Auditor. A communication under date of June 27th 1913 was read from the Board June 27th, 1913, entered into a contract with Mr. F. Kahn of the Alameda Garage for 1,000.00 to repair the automobile fire engine of the City. Ordered filed. _A communication under date of June 21st 1913 from the Board of Police and Fire Commissioners having annexed thereto a letter from the Vlaterous Engine Works Company of St. Pau1,IIinnesota, was read in which an offer to sell the City an automobile fire engine for 5,000 was made. Mr. Bartlett moved that the matter be referred to the Police, Fire and Water Committee of the Coun- cil, seconded by Kr. Morris and carried. A communication from the Encinal Yacht Club under date of June 2 1913 was read which request was made that the Council deny the application of the Bay Shore Club to hold 3lueRock shoots off the south end of Ninth Street on Sunday mornings. Mr. Morgenstern moved that the matter be referr- ed to the Police, Fire and .iater Committee, seconded by Mr. Morris and carried. A communication under date of June 19th, 1913, from G. A. L;iel was read in which he asked that the City refund certain moneys collected on electrolier assessment. Mr. Bartlett announced that he had taken the matter up with :rr. Ziel. Mr. Probst moved that, the communication be filed, second- ed by Er. Bartlett and carried. Affidavits were presented showing due posting and nublication of Notice of Award of Contract in connection with work to be done under Resolntion of Intention No. 12, New Series. Ordered fil- ed. \Mr. Bullock introduced a Bill for e. proposed Ordinance entitled, "An Ordinance Placing the Control and Management of the Parks and Playgrounds in the Coundil Park and Playground Committee". Mr. Bullock moved that the Bill be referred to the Committee of the iihole to be taken up in conjunc- tion with proposed Ordinance designed to create a Recreation Comrniseion, in- troduced by Mr. Bartlett, May 6th, 1913. Mr. Probst seconded the motion and it was defeated by the following vote:- Ayes:Councilmen Bullock and Probst, Stewart, . Absent:Councilmen Hammond and Roth, Mr. Bullock's Bill for proposed Ordinance was then laid over under the provisions of the Charter. A communication under date of June 20th, 1913 from H. Theresa Speady a member of the Board of Education was read in which the writer made formal protest against the ,,' nting of an application for a liquor license at Wal- nut Station and in which she alleged that the management of the place has not conducted the saloon properly. Mills to sell liquor at 2170 Encinal Avenue, near Walnut Station be denied. June 27th, 1913. be given a full hearing and an opportunity to clear himself of the charges embodied in Mrs. Speddy's communication. Arguments against the granting of the license were made by various personspincluding men and women. A protest against the granting of the license containing upwards of three hundred names was pre- sented by F. A. Berlin and filed with the Clerk, who read the introduction. Mr. Mills spoke on his own behalf. Several arguments in favor of granting the license were made by supporters of the applicant. Mr. Hammond after asserting that he believed the applicant had not been given a fair hearing,moved that the entire matter be referred to the Committee of the Whole to be taken up in Exe- cutive session, seconded by Mr. Probst and lost by the following vote:- Ayes: Bullock, Hammond and Probst (3). Adams, a member of the Board of Electricity, in which he asked for a leave of absence for thirty days beginning June 26th, 1913. Mr. Probst moved that the leave of absence be granted, seconded by M. The Clerk called up for ction the communication from Mayor Frank Otis under date of June 13th, 1913 in which he returned his veto of the Resolution passedby the Council June 3rd, 1913, which Resolution rescinded another Resolution passed by the Council, February 21st, 1913, having to do with an automobile, which was later delivered to the City by the Osen and. Hunter Auto Company for the use of the Fire Chief. Mr. Hammond moved that the Mayor's veto be sustained, seconded by Mr. Probst and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock', Hammond, MacRae, Morgenstern, Morri s, Probst and Stewart, (8). Mr. Bullock moved that the demand of the Osen and Hunter Auto Company for 01474.0(Yfor an automobile be paid, provided, that the amount settle in full all claims of the Company against the City, seconded by Mr. Hammond and carried by the following vote:-. Communications protesting against the proposed change in the method of conducting the BuildinF Inspection Department. as set forth in 8.7 Bill for an 14 50 June 27th, 1913. Improvement Club, Cunningham and Politeo,and a joint Petition from L. Swenson, Leard and Gates and D. M. Etter. Communications approving of the proposed change were read from the following and ordered filed:- Young Men's Civic League, East End Improvement Club, W. A. Eichenberg and A. W. Pattiani. A communication under date of June 27th, 1913 was read from the North Side Improvement Club in which that organization let it be known that it does not deem wise or expedient the movement for a new Charter. Accompanying the communication was a set of Resolutions adopted by the North Side Improvement Club setting forth its position in regard to the new Charter project. The communication and Resolutions were ordered filed. The Public Utilities Committee submitted the following report:- "'l meda, California. June 27th, 1913. Gentlemen:- Your Committee on Public Utilities to which was referred a communi cation from the Board of Electricity recommending the adoption of certain special rates for electric sign lighting, reports that in its opinion the following rates should be adopted:- Meter rate four (4) cents per thousand watt hours; provide6 the sign is operated for not less than 28 hours per week during the months of April May, June, July, August and September and for not less than 42 hours per week during the months of October, November, December, January, February and March. Minimum Bill .50 per meter per month . Installation of all sign service connections to be made by the Department of Electricity and billed to the Consumer at cost. Respectfully submitted, F. J. Gentlemen:- Concerning the property oveclap on the sidewalk on the southeast corner of Santa Clara Avenue and. Webster Street. According to the official records of the County of Alameda, the title to the property in question is in Marie Felicity DeChesne and. Harry A. M. DeChesne, Jr. The property can be taken for public use by condemnation and we recommend that the City Attorney and. City Engineer be instructed to prepare the necessary Resolution of Intention to commence the work under the s1 1pwR nf the State of California appertaining to the opening, widening June 27th, 1913. Your Committee on Licenses to which was referredthe communica- tion from City Justice, R. B.'Tappan asking that the .Council enact an 'Ordinance authorizing the Chief of Police to confiscate and destroy all liquors taken from persons arrested for selling liquor without a license in this city, recommends that, the City Attorney be directed. to prepare such an Ordinance. Hoes:'Zone. Abseht:Councilman Roth, (1). The License Committee submitted the following report:- "Alameda, Cal. June 26th, 1913. Gentlemen:- Your License Committee, to whom was referred the protest made by T. H. B. Varney against the license imposed for maintaining bill boards in this city, and also against the restriction contained in the ordinance as to the height of bill boards, reports as follows:- In the ordinance passed 1)-/ the Council on January 14th, 1913, the annual license for bill boards was fixed as follows:- "For each square foot of surface used at the time of issuing the license, the sum of two cent ner annum." Last year Mr. Varney paid a license tax of two hundred and forty dollars . From representations made to your committee by Mr. Varney, your committee believes that the tax imposed by the present ordinance is unreasonable. The bill board business in Alameda has not increased during the past year, but we do think that a license of three hunared dollars would be fair to all parties concerned and we therefore recommend that the ordinance fixing the license tax upon bill boards be amended so that the annual license shall be three hundrea dollars. 15 52 June 27th, 1913. city "which shall exceed ten feet in height above the ground" etc., which permits a space of only six feet in height upon which to display printed matter. We are advised that printed advertisements for display on bill boards are made a uniform size all over. the United States, to wit: ten feet in height, and an enforcement of the present ordinance would nut Mr. Varney to great expense and inconvenience, if it did not destroy his business in the City of Alameda. We are therefore of the opinion that the ordinance should be amended so that the height of the boards shall be twelve feet above the ground, which is the present height of all hill boards naa main tadned in the city. All other restrictions in the ordinance to remain. With this report we submit two ordinance prepared by the Cit Attorney in accordance with the suggestions herein contained. In connection with the report Mr. Stewart introduced two Bills for Ordinances, one entitled "A Bill for Ordinance No. New Series, to Amend Section 548 of Article III, Chapter VII of Ordinance NO. 1, New Series, known as The Municipal Code of the City of Alameda, approved January 14th, 1913, bL> Re-enacting said Section as amended" and the other entitled "A Bill for Ordinance No. , New Series, to Amend Section 744 of Article VI I Chapter IX, of Ordinance No. 1, New Series, known as the Municipal Code of the City of Alameda, approved January 14th, 1913, by Re-ena-cting said Section as amended". Both were laid, over under the provisions of the Charter. The City Attorney submitted a written opinion as to the right of the Water Company to make a charge of '10.00 for service connection. The opinion was read by the Clerk and upon motion of Mr. Bartlett, seconded by Mr. Hammond ordered filed. A Bill entitled "A Bill for Ordinance No. , New Series Determining Water Rates and Fixing the Compensation for water furnished for Private and Public Purposes in the City of Alameda during the Year Commencing July 1st, 1913 and ending June 30th, 1914" introduced by Mr. Morris June 3rd, 1913 was called RD for passage and read by the Clerk. Mr. Bartlett moved that the Ordinance be adopted, seconded by Mr. Hammond and it was adopted and passed by the following vote:- Ayes:Councilmen Bartlett, Bullock Hammond, MacRae, Morgenstern, Morris, Probst and Stewart, (8). At this stage of the meeting Mr. Hammond,was,at his request, excused Sections 320 and June 27th, 1913, d Chapter V of Ordinance No. 1, New Series, known as the Municipal Code of the City of Alameda, approved. January 14th, 1913, by Re-enacting said. Sections as amended" introduced by Mr. Morris, June 17th, 1913 was called up for passage and was read by the Clerk. A Bill entitled !!A Bill for Ordinance No. New Series, Creating a Recreation Commission in the City of Alameda and Placing Under the Con- trol and Management of said Commission all Playgrounds an Recreation Facili- ties now and hereafter acquired or owned by the City of Alameda and Pro- viding for the Maintenance of the same", introduced by Er. Bartlett, May Gth, 1913, was called up for passage and was read by the Clerk. Mr. Bartlett moved that the Ordinance Be adopted, seconded by Mr. Stewart and it was passed and adopted by the following vote;- Ayes:Councilmen Bartlett, Mac- Rae, Morgenstern, Morris and Stewart, . Noes:Councilmen Bullock and Probst (2). Absent:Councilmen H mond and Roth, 2). Mr. Stewart asked that his Bill for an Ordinance having to do with proposed change in the Building Inspection Department which Bill was at the meeting of June 17th, 1913)laid over to be taken up by the Com- mittee of the Whole,be called up for action. Mr. Probst objected to such proceeding declaring that it would be unfair to the members of the Coun- cil who were absent, and to others who understood that the Bill was to be again considered in Committee of the ihole before final action wqs taken. The Mayor and City Attorney held that the Council had the power to recall the Bill from the Committee of the Whole thereupon Mr. Bartlett moved that the 13111 be recalled seconded by Mr. Morris and carried by the follow- ing vote:- Ayes:Councilmen Bartlett, MacRae, Morgenstern, Morris and Stewart, (5). The Clerk than read the Bill) which had been introduced.by Mr. Stewart, June 3rd, which was entitled' Bill for Ordinance No. New Series, to Amend Sections 10, 11 and 12 of Chapter II, of Ordinance No. 1, New Series, known as The Municipal Code of the City of Alameda, approved Jarivary 14th 1913, by re-enacting said Sections as amended,". Mr. Stewart moved the adoption of the Ordinance, seconded by Mr. MacRae)and the Ordinance was adopted and pqssed by the following vote:- Ayes:Councilmen Bartlett, MacRae, Morgenstern Morris, and Stewart, (5). Noes:Councilmen Bullock andProbs (2). Absent:Councilmen HAmmond and Roth, (2). Mr. Stewart moved that the Olerk be instructed to notify the Board of Health of the action taken, seconded by Mr. Bartlett and carried. 1ayor Otis reported that he had been waited upon by the Publicity Committee of the Oakland Commercial Club and that on behalf of the City he had assured the Committee that Alameda would join with Oakland in in- VifiTler 54 June 27th, 1913. Mayor Otis also reported that he had discussed the Subway project with per- sons interested,including County Surveyor, Perry Haviland. Mr. Morgenstern moved that the Mayor be requested to invite Mr. Haviland to address the Council at his convenience on the proposed subway, seconded by Mr. Bartlett and carried. Mr. Probst asked when the Special Committee appointed by Mayor Otis on May 6th, 1913, to investigate published charges on alleged over taxation in electrolier assessments expected to make a report. Mr. Stewart, Chairman of the Committeelreplied that some progress was being made. Mr. Bartlett, another member of the Committee) stated that in his opinion such investigations should be made by an expert and that the work was too much for the Committee. President Morgenstern submitted a new list of Committees of the Council. Mr. Bartlett moved that the old Committees be dismissed, seconded by Mr. Probst and carried. The Clerk then read the new list of Committees as submitted by President Morgenstern as follows:- Police, Fire and dater. - Councilmen Morris, Bartlett and. Roth.
