TUESDAY EVENING,DECEMBER 2ND, 1913.
The Council convened with Mayor Frank Otis presiding.
The Roll was called and Councilrnon Bartlett, Bullock, MacRae, Morris
Probst, Roth and Stewart, (7) answered present. Councilman Hammond and
Morgenstern (2) were noted absent. Councilman Morgenstern arrived during
the reading of the Minutes and was noted present.
The Minutes of the regular meeting held. November 18th were approved
as read.
(241 report from the Auditor under date of November 29th, 1913 showing
apportionment of taxes for 1913-1914 was received and filed.
`I Mr. Bartlett introduced the following Resolution and moved its adoption:-
RESOLVED, That the sum of Five Hundred ($500.00) be and the same is
hereby transferred from the Recreation Fund to the General Fund, the same
having been transferred by resolution October 7.. 1913, from the General
Fund to the Recreation Fund, as a loan, to be repaid upon apportionment
of the taxes; and the Auditor and the Treasurer are directed and authorized
to make the said transfer upon their respective books.
Mr. Stewart seconded the motion to adopt the Resolution and it was
passed and adopted. by the following vote:- Ayes:Councilmen Bartlett Bullock
MacRae, Morris, Morgenstern, Probst Roth and. Stewart, (8). Voes:Uone.
Absent:Councilman Hammond (1).

the action taken by the City Council November 18th, 1J1, 1j adjourning out
of respect to the memory of her late husband, Frank Sumner Loop, at one time
a member and President of the Council was received and filed.
--A A communication from the Alaska Packers Association acknowledging re-
ceipt of a letter from the Clerk informing the Association that the complaint
with regard to the sewer emptying into the basin at the Association's yards
on the Estuary had been referred to the Street and Finance Committees, was
received and filed.
`11. communication was received from City Tax Collector Oswald Lubbock
asking the Council to ratify his action in appointing an assistant in his
office for two weeks during an illness which confined him to his home. Mr.
Bullock moved that the action of the City Tax Collector be ratified, second-
ed by Mr. Bartlett and carried, by the following vote:- Ayes:Councilmen
Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst, Roth and Stewart,
(8). Noes:None. Absent:Councilman Hammond, (1).
A communication was received and filed from the Waterous Engine Works
Company in which the Company gave notice of receiving its certified check
for 200.00,retnrned bz- the Gity Clerk after the Company had entered into
a contract with the City to furnish a motor driven fire engine.
A communication was received from Joseph Milburn, 1510 Schiller Street,
Alameda, soliciting a share of insurance on the Alameda City Hall, when next
placed. Ordered filed.
A communication was received from the City Council of the City of
Richmond asking that the City Council of Alameda adopt a Resolution, a copy
of which was attached to the communication, said Resolution having to do
with proposed improvements for the harbor of the City of Richmond. Mr. Probst
moved that the Resolution be adopted as requested and returned to the City
Council of Richmond, seconded b- Mr. Bartlett and carried.
A report was received from City Engineer I. N. Chapman relative to
a request made by the East End Improvement Club to the City Council that
tests be made to ascertain if a local underground water supply con1d not
be obtained for general and municipal use. Mr. Bullock moved that the re-
port be received and accepted and that a copy of the same be sent by the
Clerk to the East End Improvement Club, seconded by Mr. Bartlett and
carried.
4 A communication was received from the Board of Electricity to which
was attached a copy of a letter from the Adjutant General s ofi'iee having
to do with the action of the City in discontinuing free electric lighting
service in the Armory of Co. G, Fifth Infantry, N. G. C. Mr. Morgenstern
moved that the matter be referred to the Public Utilities Committee to in-
vestigate and report back at an eraly date, seconded by Mr. Probst and
carried.

construction of a garbage incinerating plant for the disposition of

Council relative to a garbage incinerator manufactured by a firm that he re-
presented. Mr. Morgenstern moved. that Mr. Briggs be invited to address the
Health Committee of the Council at a future date to give him an opportunity
to explain his proposition in further detai l, seconded by Mr. Probst and
carried.
A communication under date of December 2nd 1913, from the Board of
HeWth was read in which that body gave notice that it did"not approve
of the dumping of garbage in Peach Street in violation of the City Ordinance".
Following the reading of the communication Mr. Morgenstern moved:-
"That the Board of Health be advised by the City Council to see that the
sanitary laws of the City are obeyed and that if the Board has any knowledge
of the violation of the same it proceed immediately to apprehend and prosecute
the violators," seconded -by Mr. Roth and carried.
A communication was received from the Board of Health under date of
December 2nd, 1913, giving notice of the resignation of Henry L. Alves as
City Chemist and the appointment of Walter C. Leigh as his successor; also,
of the resignation of W. H. Carpenter, Assistant to the Veterinary and Food.
Inspector and of the appointment of Melville Herspring to succeed him. Ordered
filed.
A report was received from the Street Superintendent certifying that the
work of gmding,curbing, macadamizing and otherwise improving Jose Avenue
from the eastern line of Post Street to the western line of Peach Street, done
by Hutchinson Company under private contract had been completed to the satis-
faction of the Street Superintendent, Ordered filed.
An Affidavit was presented showing duo posting of Notice of Award of
Contract in connection with street work to be done under Resolution of Intention
No. 15, New Series. Ordered filed.
4 An Affidavit was presented showing due publication of Notice of Award
of Contract in connection with street work to be done under Resolution of In-
tention No. 15, Nev' Series. Ordered filed.
An Aereement,with Bond attached, between the City of Alameda and the
American Dredging Company relative to a hydraulic pipe that had been laid across
Webster Street with the permission of the City Council was received, said agree-
ment having been signed on behalf of the City by Frank Otis,Mayor,and T. C.
Coughlin, City Clerk, and by Marshall C. Harris and N. R. Harris on behalf of
the American Dredging Company. Mr. Probst moved that the action of the Mayor
and City Clerk in signing the Agreement be approved and that the Agreement
and Bond be filed, seconded by Mr. Bartlett and carried by the following vote:-
Ayes: Councilmen Bartlett ullock, MacRae, Morgenstern, Morris, Probst, Roth
and Stewart, (8). Noes:None. Absent:Councilman Hammond, (1).
An application for a license to conduct a liquor business at 1205 Lincoln
Avenue was received from H. A. Borchert who addressed the Council. Mr. Morris
moved that the application be referred to the License Committee, seconded by
Mr. Stewart and carried.

looking to the vacation and abandonment of a certain alley sixteen feet in width
running between Pacific and Buena Vista Avenues in the block bounded by Palm
and Hibbard Streets, (known as Block 40). Attorney W.T. Hess addressed the
Council on the situation. Mr. Morgenstern moved that the matter be left with
the City Attorney and with Mr. Hess,and to empower the Mayor and. City Clerk
to sign a Quitclaim Deed from the City to the alley in question, in the event
that the City Attorney advised that the same would be legal and proper, second-
ed by Mr. Stewart and carried by the following vote:- Ayes:Councilmen
Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst Roth and Stewart, (8).
Noes:None. Absent:Councilman Hammond (1).
A communication was received from the City Attorney relative to the
question as to whether or not motor vehicles of the City will be liable to
license tax under a new State law, to become effective January 1st 1914.
Mr. Probst moved that the matter be ' left with the City Attorney for
observation as to the operation of the law, seconded by Mr. Roth and carried.
A communication, under date of November 28th, 1913, was received from
the Board of Police and Fire Commissioners in which notice was given that
the Commissioners had accepted,as repairedlanto fire engine of the Fire De-
partment. The Commissioners also recommended in the communication the pay-
ment of the demand of the Citizens Nationsl Bank, Assignee of Fred Kahn for
1,000.00 said amount being the amount of the contract entered into by said
Kahn with the Police and Fire Commissioners to repair said engine. Follow-
ing the approval of the demand by the Finance Committee Mr. Morris moved that
the claim be pait9, seconded by Mr. Stewart and carried by the following vote:-
Ayes:Councilmen Bartlett Bullock, MacRae, Morgenstern, Morris, Probst,Roth
and. Stewart, (8). Noes:None. Absent:Councilman Hammond, (1).
A,. was received from the Board of Police and Fire Commission-
ers to which was attached specifications and advertisement inviting proposals
for Tractor for Hook and Ladder Truck No. 1, and which also contained the
request that the specifications be adopted and the advertisement ordered
published. Mr. Probst moved that the specifications be adopted and the Clerk
authorized to advertise for bids for desired Tractor, seconded by Mr. Bullock
and carried b the followin g vote:- Ayes:Councilmen Bartlett, Bullock,
MacRae,,Morgenstern, Morris, Probst, Roth and Stewart, (8). Noes:None.
Absent : Councilman Hammond, (1).
A report was received from the Street Committee recommending that
the bid of the Howard. Automobile Company of 1250.00 for furnishing
a motor truck for the 3treet Department, be accepted. Mr. Bartlett moved
that the report be approved and that the bid of the Howard Automobile
Company be accepted and the contract awarded that firm, seconded by Mr.
Probst and carried by the following vote:- Ayes:Councilmen Bartlett,
Bullock, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (8).
Noes:None. Absent:Councilman Hammond, (1).
\, Mayor Otis called the attention of the Council to the need of a
board walk along the bay frontage embankment at Lincoln Park and suggested.

President Morgenstern of the Council also spoke in connection with the same
matter.
\I Mr. Bartlett moved that the Council, through the City lerk, request
the County Board of Supervisors to see that the approaches to and the floor of
the Webster Street bridge are kept in a cleaner and safercondition, particular-
ly during the wet weather seconded by Mr. Probst and carried.
There being no further business to transact the Council adjourned until its
next regular meeting time, Tuesday evening, December 16th, 1913 at 7:30 p. m.
