TUESDAY EVENING, FEBRUARY 16TH, 1915.
The meeting convened with Mayor Frank Otis Presiding.
The roll was called and. Councilmen Bartlett, MacRae, Morgenstern,
Morris, Roth and Stewart, (6) were noted present. Quorum present. Coun-
cilmen Bullock, Hammond and Probst arrived 1;1.ter and were noted present.
The Minutes of the previous meeting were approved as read.
Claims against the General Fund amounting to 311.72; against the
Police Fund amounting to ;153.75; against the Fire Fund Amounting to 969.46;
atainst the Electric Light Fund amounting to 5132.37; against the Street
Fund amounting to 856.37; and against the Recreation Fund amounting to
108.00 having been approved and audited by the proper officials were
read as follows:-

The semi-annual and annual report of the Police Department. Ordered

The following communications were received:-
L From Mayor Frank Otis, in which he apponted E. Howard Baxter, as
member of the BOard of Electricity for the unexpired term of Charles Adams,
resigned. Mr. Morgenstern moved that the appointment be donfirmed, seconded
by Mr. Morris and carried by the following vote:- Ayes:Councilmen Bartlett,
Bullock, MacRae, Morgenstern, Morris, Roth and Stewart, (7). Noes:None.
Absent:Councilmen Hammond and Probst, (2). The Clerk immediately ad-
ministered the Oath of office to Mr. Baxter which Oath was ordered filed.
2 From the Pacific Telephone and Telegraph Company containing a state
ment of gross revenue for the years 1913 and 1914. Referred to the Finance
Committee for investigation.
From Mrs. Charles S. Neal thanking the Council for its expression
teem and respect to the memory of Mr. Neal. Ordered filed.
4 From J. G. McPherson, stating that the Southern Pacific Company
will erect a station at Fifth Street and Lincoln Avenue in the near future.
Ordered filed.
5 From C. Y. Halsey, complaining of the condition of the tennis courts
in the parks.. Referred to the Recreation Commission.
6 From about twenty residents on Pearl Street, requesting the removal
of two eucalyptus trees. Referred to the Street Committee.
7 From the Police and Fire Commission requesting a sum not to exceed
200.00 to repair the police patrol wagon. Mr. Bartlett moved that the
request be granted, seconded by Hr. Hammond and carried by the following
vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae. Morgenstern,
Norris, Probst, Roth and Stewart, (9). Noes:None. Absent:None.

From the Police and Fire Commission submitting specifications
for two automobile chassis for the Fire Department. dr. ILnmond moved,
seconded by Mr. Bartlett and carried, that the specifications be amend-
ed to require from all bidders a test of their machines with a load of
4,500 pounds, the same to take place before the Committee of the
Council and the Police and Fire Commission. Subsequently Mr. Latham
presented a modified form of specifications which required that the
successful bidder give a demonstration of his machine over a two
mile course to be selected by the Police and Fire Commission, where-
upon Mr. Stewart moved, seconded by Mr. Morris that the amended
specifications be adopted and the Clerk advertise for bids. After
some discussion Mr. Bartlett moved, seconded by Mr. Hammond and duly
carried, that all specifications and action taken be rescinded. Er.
Hammond then moved that a test be made before the Committee of the
Council and the Police and Fire Commission requiring all bidders
on chassis to give a demonstration with a load of 4500 bounds. Mr.
Stewart moved to amend that no test be made before the purhcase of
the machine, that the specifications as amended be adopted and the
Clerk advertise for bids seconded by Ur. Morris and, carried by the
following vote:- Ayes:Councilmen, Bullock, MacRae, Morgenstern,
Morris, Roth and. Stewart, (6). Noes:Councilmen Bartlett, Hammond
and Probst, 0
10 From City Engineer Sutton and. Street Superintendent Frodden
in which the stated that they had received three bids for the laying
of a sidewalk in Lincoln Park along Fernside Boulevard and that the
bid of L. McKinney for eight cents per square foot was the lowest

he be awarded the construct, seconded by Mr. Bartlett and carried
by the following vote:- Ayes:Councilmen Bartlett, Bullock, HAmmond,

None, Absent:None.
11 V From C. J. DuFour, Secretary of the Board of Education,
submitting a Resolution of the Board of Education requesting the Coun-
cil to place on the ballot in the election of April 14th, the propo-
sition to raise 000,000 for the purchase of additional school
facilities to be divded as fol/ows:- $270,000 for elementary school
purposes and 00,000 for high school purposes. Mr. Bullock gloved
that the recommendation be adopted, seconded by Mr. Bartlett and
carried by the followihg vote:- Ayes:Councilmen Bartlett, Bullock,
Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9).
Noes:None. Absent:None.
12 v City Attorney Poorman having been requested for information
as to proper proceedings in bond matters, advised the Council that
some irregularities had been made and that it would be better to
rescind all action on bond matters taken heretofore. Er. Morgenstern

13 / Mr. Morgenstern then moved, seconded by Mr. Bartlett and carried, that
the school bond matter be referred to the Public Buildings and Grounds Com-
mittee to get the necessary data as to the amount of money to be spent for
purchase of ground and the amount to be used in the construction of buildings
and, also, to determine the rate of interest.
14 v Mr. Bartlett then moved that all action heretofor taken on the harbor
improvement bonds be rescinded and that the matter be referred to the Harbor
Advisory Board to procure figures showing where and how much money was in-
tended to be spent at the various places along the harbor front, seconded
by Mr. Hammond and carried by the following vote:- Ayes:Councilmen Bartlett,
Bullock, HAmmond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart,
(9). Noes:None. Absent:None.
15 / A claim of 1420.00 of the Kissel Kar Branch was presented and Mr.
Haa.lond moved that the same be paid, seconded by Mr. Bullock and carried
by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae,
Morris, Probst, Roth and Stewart, (8). Noes:None. Temporarily Absent:,
Councilman Morgenstern, (1).
16 From the Police and Fire Commission requestibg a number of telephones
for the police department and the fire department. Referred to the Public
Buildings and Grounds Committee.
17 From F. J. Croll, .caditor and Assessor, stating that he had appoint-
ed Wm. Varcoe, Deputy Assessor at a salary of $85.00 per month. Mr.
Bartlett moved that the appointment be confirmed, seconded by Hr. Morris
and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock,
Hammond, MacRae, Morris, Probst, Roth and Stewart (8). Noes:None.

18 e' From JohnGoldstone, requesting an opinion from the City Council
relative to the building of 20,000 gallon tanks for gasoline, distillate
and kerosene on Harrison Avenue. Referred to the Police, Fire and Water
Committee and to the Police and Fire Commission and Fire Marshal.
19 From H. Theresa Speddy, relative to a leave of absence, Ordered
filed, inasmuch as she had requested thesame to be over looked.
The Clerk called attention to the fact that it was necessary for
the Councilmen to appoint officers for the coming municipal and bond
elections. No action taken.
20 Mr. Bartlett introduced the following Resolution and moved its
adoption:-
RESOLUTION REQUESTING CONGRESS TO PENSION
RET[RED CIVIL SERVANTS.
V,HEREAS a measure is now pending in Congress, known
as House Bill 5139, otherwise the Hamill Bill; and.
WHEREAS every civilized country of the world has
made pensions for the retirement of its superannuat-
ed and disabled civil servants, except our own; and

and industrial concerns have inaugurated retire-
ment systems for those who have spent the best
years of their lives in the service; and
WHEREAS almost every city in the United States
retires upon an annuity their police, their fire-
men and their school teachers; and.
WHEREAS the Civil Service of the United. States
is today seriously hampered because of the fact that
a large number of men and women are on its pay
rolls who are no longer able, on account of the
ravages of disease and old age, to perform a
reasonable day's work. To dismiss them from the
service would be cruel and iauman and in many in-
stances like sentencing them to death. The separa-
tion from the service of these superannuated employees
would mean that those discharged would have to appeal
to charity or become public charges;
THEREFORE, BE IT RESOLVED, that the City Council
of the City of Alameda in meeting assembled heartily
endorse and request the Senators and Representatives
from the State of California to take such steps as
will be necessary to secure the passage of this
measure.
BE IT FURTHER RESOLVED that a copy of these resolu-
tions be sent to the Representatives in Congress from
this district and a copy spread upon the minutes of
this body.
Mr. Hammond seconded the motion to adopt the Resolution and it
was passed and adopted by the following vote:- Ayes:Councilmen Bartlett,
Blalock, Hammond, MacRae. Morgenstern, Morris, Probst, Roth and Stewart,
(9). Noes:None. Absent:None.
21 Mr. Hammond introduced the following Resolution and moved its
adoption:-
RESOLUTION FIXING SALARY OF W.O.JACOBY
AS CLERK OF POLICE COURT AT 25 PER MONTH.
RESOLVED, That from and after the adoption and
approval of this resolution, Walter O. Jacoby,
be paid the sum of Twenty Five (25.00) Dollars
a monthfor acting as Clerk of the City
Justice's Court, provided he first file a writ-
ten waiver with the Auditor of the City of
Alameda of any and all compensation over and
above Twenty-five ($25.00) Dollars a month for
acting as said Clerk.
Mr. Bullock seconded the motion to adopt the Resolution and it
was passed and adopted by the following vote:- Ayes:Councilmen Bartlett,
Bullock, Hammond, MacRae. Morgenstern, Probst and Roth, (7). Noes:
Councilmen Morris and Stewart, (2), Absent:None.
City Attorney Poorman gave the opinion that the Resolution could
be adopted but if he found upon investigation that it were contract
to law the Resolution would be null and void. In the meantime, however,
it could stand in effect.
22 v/ The Street Committee submitted a report stating that W. N.
Whitmore was the lowest bidder for the improvement of San Jose Avenue,
between High Street and Post Street, whereupon Mr. MacRae introduced
the following Resolution and moved its adoption:-
RESOLUTION OF AWARD.
WHEREAS, the Council of the City of Alameda
did, in open session, on the 2nd day of
February, 1915, publicly open, examine, and
declare all sealed proposals or bids for do-
ing the following work in said city, towit:
That Sat Jose Avenue, from the center line
February 16, 1915.
That a six inch, vitrified, iron-stone sewer
with 4 inch Y branches and 4 inch house con-
nections, be constructed along the center
line of San Jose avenue, in a right line from
the existing manhole in the crossing of High
Street with San Jose Avenue to the existing
manhole in the crossing of Post Street with
San Jose avenue.
That the entire width of said San Jose avenue,
from the easterly line of High Street to the
uesterly line of Post street, be graded to the
official grade; that concrete curbing, eight
inches by fourteen inches in cross-section
dimension, be constructed along the curb lines
of said street, between said last named limits;
that concrete gutters, of the "flat" pattern,
three (3) feet in width and six (6) inches
in thickness, be construdted along the road-
way side of and contiguous to said curbing;
that the remaining portion of the roadway,
between said limits, be macadamized with a
layer of broken trap rock, eight inches in
thickness; and by oiling the macadam of said
roadway,
RESOLVED, that the said Council hereby re-
jects all of said proposals or bids except
that next herein mentioned, and hereby
awardes the contract for doing said work
and improvement to the lowest responsible
bidder, to wit: W. N. Whitmore at the prices
named in his bid. The City clerk is hereby
directed to post notice of this award con-
spicuously for five days, on or near the
chamber door of the said Council and also
publish said notice by two insertions in the
EVening Times Star and Alameda Daily Argus,
a daily newspaper published and circulated in
said city, and hereby designated for that
purpose by said Council.
Mr. Bullock seconded the motion to adopt the Resolution and it was
passed and adopted by the following vote:- Ayes:Councilmen Bartlett,
Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and
Stewart, (9). Noes:None. Absent:None.
23 /' The Printing Committee submitted a report in which they stated that
the bid of the Times Star Company was the lower bid for the city print-
ing and recommended that the Times Star Company be awarded the contract.
Mr. Bullock moved that the report be adopted, seconded by Mr. Probst
and carried by the following vote:- Ayes:Councilmen Bartlett, Bullock,
Hammond, Iviac Rae, Morgenstern, Morris, Probst, Roth and Stewart, (9).
Noe :None. Absent:None. Attached to the report was a comparative
statement of bids submitted.
24 From the Street Committee recommending that the City Clerk
write the owners of property abutting Liberty and Garfield Avenues,
wast of Fernside Boulevard, requesting them to contribute their prorata
share for the completion of the electroliers at the bulkheads at the
ends of the avenues. The cost is estimated at 030.00 for the whole.

and carried.
25: From City Engineer Sutton, submitting plans and specifications
for the construction of a municipal garage. Mr. Bartlett moved that
the plans and specifications be adopted, seconded by Mr. Hammond and

Cement or Concrete Work on Public High-ways
in the City of Alameda; and requiring its
Proper Perform ce; and Providing a Penalty for
violation of such ordinance,

Changing, Modifying and. Re-establishing the
official Curb Grades on Park Street in the
City of Alameda from the Northerly line of
Blanding Avenue to the Southerly Line of the
United States Tidal Canal, and also on
Harrison Avenue in said City from the Easter-
ly line of Park Street to a Line Crossing
Harrison Avenue and Parallel with said East-
erly line of Park Street and Distant 261.88
easterly therefrom,.
Introduced by Mr. MacRae, Chairman of the Street Committee
and. was laid over under a provision of the Charter.

FOR ORDINANCE NO. NEW SERIES.

Prohibiting the Erection Or riaintenance of
any Movable Structure, or any Tent, Cloth-
House, or any Structure having Walls or Roof
of Paper, Felt, Cloth, or other Similar Materials,
without a Permit; Providing for Application for
Such Permit and the Granting Thereof; and Im-
posing a Penalty for Violation of said Ordinance,
Introduced by Mr. Hammond
and ", was laid over under a provision of the Charter.
27 V City Engineer Sutton called the Council's attention to a provision
in the State law by which an Ordinance could be passed requiring street
car companies and the like to improve the street between the tracks
owned by the company, in a manner better and more substantial than the
adjoining portion of the street. Mr. Probst moved, seconded by Mr.
Hammond and carried that the City Engineer take up with the City
Attorney the matter of preparing an Ordinance in accordance with the
above.
28 v / Mayor Otis called attention to the proposed initiative Ordinance
providing a Re-construction Fund for street improvements and suggested
a few changes. Mr. Hammond moved, seconded by Mr. Morris that the change
be made as suggested by Mr. Otis. Mr. MacRae moved to amend, seconded
by Mr. Bartlett and carried, that the matter lay over for two weeks
for consideration.
29 `1/ Mr. Stewart called attention to the advisability of holding the
Freeholders' election with the Municipal election and moved, seconded
by Mr. Morris and carried, that the City Attorney draw up the necessary
papers.
30 1 Mr. Stewart called attention to an alleged violation of an Ordi-

cussion, Ur. ::orgenstern moved, seconded by Mr. Hammond and carried, thrt the matter
be referred to the Police and Fire Commission for investigation and to report
back to the Council. Council President Morgenstern called attention to the
fact that the vote was recorded as unanimous. Mr. Latham stated thet the Police
and F:re Commission were investigating the matter and would submit a report in
the near future. Mr. Stewart moved that the proprietor of the Crescent Hotel
be required to appear before the Council and show why his license should not
be revoked, seconded by Mr. Morris and lost by the following vote:- Ayes:
None, Noes:Councilmen Bartlett, Bullock, Hammond, MacRae, Horgenstern, Morris,
Probst, Roth and Stewart, (9). Abeent:None. Mr. Stewart stated that he wished
to have it recorded that the Council refused to hear the matter of the Crescent
Hotel license.
31 Mr. Bartlett called attention to a decision of the Supreme Court of the
State of California which compelled the Spring Valley Water Company of San
Francisco to lay water mains in the Richmond District. He, moved, seconded
by Mr. Hammond and carried, that the City Attorney ascertain if in accordance
with the said decision, the Peoples Water Company could be compelled to ex-
tend its mains similarly in districts not now provided.
32 V Mr. Hammond moved, seconded'by Mr. Bartlett and carried, that the
matter of having the Southern Pacific Company continue its late horseshoe
train to Alameda, be referred to the Public Utilities Committee.
33 ' Mr. Probst called attention to the fact that the Council had
agreed to remove the license on delivery wqgons and moved, seconded by Mr.
Stewart and carried, that the City Attorney draw up the necessary ordinance
to repeal the same.
34 Mr. Probst called attention to the desirability of filling in the
depression on the north side of the Southern Pacific tracks near Fourth
Street and Central Avenue, and moved, seconded by Mr. Hammond and carried,
that the netter be referred to the City Planning Commission to ascertain
if the same can be done and Central Avenue be continued in a curved line
parallel to the tracks to Pacific Avenue.
Mayor Otis called attention to the procession Saturday morning and
invited all the officials to be present and participate.
Yr. Bullock moved that when the Council adjourn it adjourn to meet
in adjourned regular session February 23rd, seconded by Mr. Hammond and
ried by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond,
MacRae. Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None.
Absent:None.
There beine: no further business to transact, the Council adjourned
to meet in adjourned regular session, February 23rd, 1915 at 7:30 o'clock,
