1915-03-02 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA, TUESDAY EVENING, MARCH 2ND, 1915. The meeting convened with Mayor Frank Otis presiding. The roll was called and Councilmen Bullock Hammond, MacRae, Morgen- stern, Probst and Stewart, (6) were noted present. Quorum present, Coun- cilman Roth arrived later and was noted present. Councilmen Bartlett and Morris were noted absent. The minutes of the regular meeting of February 16 were approved as 0 The minutes of the adjourned regular meeting of February 23 were approved as read. Mr. Morgenstern introduced the following Resolution and moved its adoption:- RESOLUTION TRANSFERRING 07759.78 PROM THE ELECTRIC LIGHT FUND TO THE GENERAL FUND. RESOLVED, by the council of the city of Alaneda that there be transferred from the Electric Light Fund to the General Fund the sum of Seven thousand, seven hundred and fifty-nine and 78/100 (7759.78) Dollars, same being an amount equal to the city lighting bill for the three months ending December 31st, 1914. The Auditor and the Treasurer are hereby authorized to make said transfer upon their respective books. Mr. Hammond seconded the motion to adopt the Resolution and it was adopted and passed by the following vote:- Ayes:Councilmen Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (W). Noes: None, Absent:Councilmen Bartlett and Morris, (2). The following communications were received:- From Mayor Frank Otis, submitting a petition received by him re- questing that fire alarm boxes and fire hydrants be placed in Waterside Terrace Tract. On motion of Mr. Morgenstern, seconded by Mr. Hammond and carried, the matter was referred to the City Clerk, City Attorney I March 2nd, 1915. Terrace Tract. Mr. Hammond also moved, seconded by Mr. Morgenstern and carried, that the matter of placing the fire alarm boxes be re- ferred to the Board of Electricity. v/ From the Board of Education, giving a detailed statement showing the purposes for which the 400,000 bond issue is intended to be expended. Upon the recommendation of City Attorney Poorman, Mr. Morgenstern moved that the report be adopted, excepting therefrom the matter of placing the whole issue upon the ballot as two pro- positions, the intention being to place them all as one question, seconded by Mr. Probst and carried by the follow- vote:- Ayes: Councilmen Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7) Noes:None. Ordered filed. fl From the Pacific Telephone and. Telegraph Company submitting a formal acceptance of the telephone franchise granted to it by the Council. Ordered filed. e' From the Police and Fire Commission giving their report on the charges made against the Crescent Hotel Bar. The report stated that inasmuch as the testimony was of a contradictory nature, they recommended that there be no revocation of the license. Accompany- ing the report was a transcript of the testimony taken. Ordered filed. /7 From Geo. E. Plummer,et al, protesting against the erection of three gasoline tanks on te Goldstone property. Ordered filed. / From the Police and Fire Commission recommending that John Goldstone be denied permission to erect storage tanks on Harrison Avenue. Mr. Hammond moved that the report be adopted, seconded by Mr. Morgenstern and carried. //' From Street Superintendent, V. M. Proddon, asking permission to relay and grout the gutters on Santa Clara Avenue, between Park Street and Webster Street at the city's expense, and recommending further that all property owners who have not already constructed cement curbing to be notified to do so before the 10th of April, and that after that date all curbs and gutters not reconstructed will be relayed under public contract at the expense of abutting property owners. Mr. Hammond moved that the recommendation be adopted, second- ed by Mr. Morgenstern and carried by the following vote:- Ayes:Council- men Bullock, Hammond, MacRae, Morgenstern, Probst, Rthth and Stewart, (7). Breitenbach, a city trustee of Sonoma, asking the Council to take certain action against proposed change in the handling of the liquor question by local bodies. From the Public Buildings and Grounds Committee, submitting to the Council a temporary distribution of the free telephones acquiried under the terms of the new franchise. Mr. Probst moved that the report be adopted, seconded by Mr. Morgenstern and carried by the following vote:- Ayes:Councilmen Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). After some discussion, Mr. Hammond moved that the matter be taken up Friday evening, March 6th, and that the Council adjourn to an adjourned regular meeting on that date at 8 o'clock, P. M., seconded by Mr. Morgenstern and carried by the following vote:- Ayes:Councilmen Bullock; Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bartlett and. Morris, (2), 14 As the rate to be levied in the proposed street reconstruc- tion ordinance had not been determined, Mr. Hammond moved, seconded by Mr. Morgenstern and carried, that the City Engineer and. Street Suerintendent prepare a report of the number of accepted streets in the City of Alameda and to report back at the adjourned regular meeting of the Council. 15 A report from the Street Committee was received, recom e ing that the Street Superintendent notify the owners of the trees on Pearl Street, between Lincoln Avenue and Santa Clara AVenue to have the same removed. Upon motion of Kr. Morgenstern, seconded by Jr. Hammond and carried the recommendation was adopted. 16 v Mr. Morgenstern introduced the following Resolution and moved its adoption: RESOZ-JTION. That the Council of the City of Alameda hereby determines that the public interest and necessity of said City of Alameda demand the acquisition, construction and completion by the City of Alameda of certain permanent municipal improvements in said City which are necessary and cohvenient to carry out the objects, purposes and powers of said municipality, and which are namely:- The acquisition, construction and completion on Oakland Harbor on the Northerly water-front of the City of Alameda of municipal wharves, docks, piers, slips, and quays, with their appurtenant buildings, equipment and appliances, and including approaches to said wharVes, docks, piers and quays, and necessary bulkheading, dredging and filling, all required for the accommodation of commerce and to be acquired, con- structed and completed on Tract 28 and Tract 9, as said. Tracts are delineated and so designated on that certain map entitled, "Map of Alameda Marsh Land, as partitioned among the owners thereof in the suit numbered 8923 and entitled, Pacific Improvement Com- pany, Plaintiff, vs. James A. Waymire, et al.,De- fendants, Superior Court of Alameda County, State of California," filed in the Office of the County Re- corderof Alameda County on July 30th, 1900, in Book 25 of Maps, at pages 75,77 and 79. The cost of all said improvements is hereby estimated to be the sum of Two Hundred. Thousand. Dollars. SectiOn 2. That the Council of the City of Alameda hereby further determines that the public interest and hecessity of said City of Alameda de- mand the acquisition, construction and completion of certain other permanent municipal improvements and property in said City which are necessary and convenient to carry out the objects, purposes and powers of said municipality, and which are namely:- (a) The construction and completion upon the existing school lot of the Porter School in the City of Alameda of a new school-building for use in the place and stead of the existing school-building thereof, to- gether with the furnishing and equipping thereof, and the acquisition of a lot of land adjacent to said existing school lot for the purposes of a schbol- yard and school-house site and additions to the ex- isting school-yard and school-house site of said school. (b)- The construction and completion of additions to the existing school-building of the Lincoln School in the City of Alameda, together with the furnishing and equipping thereof, and the acquisition of a lot of land adjacent to the existing school lot of Lincoln School for the purposes of a school-yard and school- house site and additions to the existing school-yard and school-house site of said school. . The acquisition of a lot of land adjacent to the existing school-lot of the Longfellow School in the City of Alameda for the purposes of a school-yard and school-house site and additions to the existing school-yard and school-house site of said school. (e) The construction and completion of improvementsof and additions to the existing school-buildtng of the Everett School in the City of Alameda, together with the furnishing and equipping thereof. (f) The construction and completion of the work of re-modeling, re-arranging, re-equipping and re-furnishing the existing school building of the Porter School in the City of Alameda in such manner as will render it suitable for the vocational work of the Alameda High School. (g) The acquisition of a lot of land adjacent to the existing school lot of the Alameda High School in the City of Alameda for the purposes of a school-yard and school-house site and additions to the existing school-yard and school house site of said school. The cost of all said improvements and property is hereby estimated to be the sum of Three Hp.ndred Thousand Dollars, Section 3. That the Council of the City of Alameda hereby further determines that the cost of the hereinbefore mentioned permanent municipal improvements, and of each of them, will be and is too great to be paid out of the ordinary income and revenue of said City, and that the cost thereof, and of each of them, will require an expenditure greater than the amount allowed or which may be obtained by the ordinary annual tax levy of said City, and that the cost thereof, and of each of them in assition to the other expenditures of said City, will ex- ceed the income and revenue provided for in any one year, or in the current fiscal year. Section 4. That the Council of the City of Alameda hereby further determines that said Council will, for the public interest and necessity, and in accordqnce with the Provisions of an Act of the Legislature of the State of California, entitled, "An Act Authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements, and Regulating the ac- quisition, Construction or Completion thereof," which At became a law under constitutional provision, without the Governor's approval, on the 25th day of February, 1901), and of Acts amendatory thereof, (in accordance with which Act and amendatory Acts of the Legislature this resolution is adopted) at a subsequent meeting of said. Council of the City of Alameda, by ordinance, call a special election and submit to the qualified voters of said City, the proposition of incurring a bonded indebtedness for each of the two purposes therein set forth and as in this resolution stated, respectively, in Section 1 and Section 2 hereof. Section 5. That this resolution shall take effect and be in force immediately. Mr. Bullock seconded the motion to adopt the Resolution and it was passed and adopted by the following vote:- Ayes:Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent; Councilmen Bartlett and Morris, (2). 17 v Ir. Hammond introduced the following Resolution and moved its adoption: RESOLUTION INSTRUCTING THE CITY ATTORNEY March 2nd, 1915. by directed to prepare and present to this Coullcil such resolutions and ordinances as may be necessary to continue and carry out the bond issue proceedings this day commenc- ed by resolution of this Council; and that he prepare and present to this Council from time to time such notices, resolutions and ordinances as may be necessary for the call- ing and holding of the election therefor, and issuance and sale of such bonds as may be authorized. Mr. Morgenstern seconded the motion to adopt the Resolution and it was adopted and passed by the following vote:- Ayes:Councilmen Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bartlett and. Morris, (2). 18 Mr. Roth moved that the matter of causing the City to realize moneys due on its outstanding delinquent tax and assessment sales be referred to the Finance Committee and City Attorney. Mr. Hammond seconded the motion and it was passed and adopted by the following vote:- Ayes:Councilmen Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and Stewart, (7). Noes:None. Absent:Councilmen Bartlett and Morris, (2). 19 Mr. Hammond called attention to the tree on Santa Clara Avenue, between Willow Street and Chestnut Street, in front of the Faben's placeand moved, seconded by Mr. Probst and carried, that the tree be allowed to stand and that the curb be so constructed under the direction of the Superintendent of Streets as not to interfere with the tree. 20 Mr. Morgenstern stated that Mr. Mott, the owner of the Porter School lot refused to sell the same for les than $4500 and moved that the City Attorney take the necessary steps for condemnation proceedings seconded by Mr. Hammond and carried by the following vote:- Ayes: Councilmen Bullock, Hammond, MacRae, Morgenstern, Probst, Roth and. Stewart, (7), Noes:None. Absent:Councilmen Bartlett and Morris, (2). Mr. Morgenstern reported that he had investigated the statement of the Pacific Telephone and Telegraph Company giving their receipts for the years 1913 and 1914 and that the check for the two per cent of the gross receipts acquired under the terms of the franchise was satisfactory. 22 Mr. Bullock stated that he had taken up the matter of filling the reservoir on High Street, awned by the Peoples Water Company, and that the matter would come before the Board of Directors meeting on Wednesday morning, and that he would submit a report at the adjourned regular meeting, Friday evening. 23 Mr. W. S. McLean of the Board of Health, Presented a petition signed by residents in that vicinity urging the Council to take the necessary steps to abate the nuisance of the reservoir, by having the same filled. The petition was ordered filed. Mr. MacRae called attention to the Southern Pacific spur tracks on Encinal Avenue, between Park Avenue and. Regent Street, and moved, seconded by Mr. Hammond and carried that the Street Superintendent notify the Southern Pacific Company to remove the same. City Attorney Poorman called attention that the Election Pro- clamation provided that the initiative measures be published and not mailed. The Council having previously adopted the proposition of having the ordinances printed and set out with the sample ballots, he was instructed to omit the provision mentioned.
