1915-04-13 Regular CC MinutesADJOURNED REGULAR MEETING OF THE COUNCIL OP TEE CITY OF ALAMEDA, TUESDAY EVENING, APRIL 13TH, 1915. The meeting convened with Mayor Frank Otis presiding. The roll was called and Councilmen Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (8) were noted present. curoum present, Councilman Hammond arrived later and was noted present. Mr. Morgenstern introduced the following Resolution and moved its adoption: RESOLUTION TRANSFERRIIG SEVEN HUNDRED AND FIFTY DOLLARS FROM THE GENERAL FUND TO THE RECREZ2ION FUND. RESOLVED, That there be transferred from the General Fund. to the Recreation Fund, the sum of Seven Hundred and Fifty and 00/100 Dollars (050.00) for park improve- ments. The Auditor and the Treasurer are hereby authorized to make the said transfer upon their respective books. Mr. Bartlett seconded the motion to adopt the REsolution and it was passed and adopted by the following vote:- Ayes:Councilmen Bartlett, Bullock, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (8). From the Alaska Packers Association, calling the Council's attention to the sewer discharge in Fortmann Basin and the damage that has resulted from same and urging the Council to take the necessary steps to abate the nuisance. Nolan enclosing a letter from Secretary of War Garrison stating that no action will be taken towards changing the harbor lines until a public hearing is held some time afte r the bond election. Referred o the Harbor Advisory Board. From the Otate Compensation Insurance Fund giving report of the -v Expert of Oalcland on the inadvisability of that city creating an in- surance fund for its own employees. Referred to the next Committee of the nole. 11. City Engineer Sutton presented a subpoena requiring him to appear be- fore the United States District Court as a witness in the case of Milton Bernard vs. the Southern Pacific Compony. Er. Bartlett moved, seconded by Lr. Hammond and carried that he be granted the necessary leave of absence to comply with the subpoena. 12. Mr. MacRae introduced the following Resolution and moved its adoption: RESOLUTION ACCE2TTG JTOBLB AVE= AS A PUBLIC HIGHWAY. WHEREAS, there has been this day submitted to the Council of the City of Alameda, said Council being the governing body of said City having control of the public highways therein, a certain map entitled, "Noble Tract, Alameda, Cal,", which said map is of certain lands situated in said City and was made from his own survey of the ground by James E. City of Alameda, County of Alameda, State of California, for the purpose of submitting to the qualified voters of said City two certain propositions for incurring a bonded indebt- edness amounting in the aggregate to five hundred thousand dollars for certain permanent municipal improvements in said city,-to wit: - First,- A Bonded indebtedness in the sum of Two hundred thousand dollars, for the acquisition, construction and completion of wharves, docks, Piers, slips and quays re- quired for the accommodation of commerce, together with their appurtenant buildings, equipment and appliances, and includ- ing approaches to said wharves, docks, piers, slips and quays, and necessary bulkheadihg, dredging and filling; and, second- A Bonded indebtedness in the S11111 of Three hundred thousand dollars for the construction and completion of certain new school buildings, together with the furnishing and equipping thereof, the construction and completion of additions, im- provements and alterations of and to existing school-buildings, together With the furhishing and equipping thereof, the ac- quisition of lots of land adjacent to and near certain existing school-lots to be used for the purposes of school-yards and school-house sites and additions to existing school-yards and school-house sites; declaring the estimated cost of said pro- posed public improvements, and the amount of the principal of the indebtedness to be incurred therefor, and the rate of in- terest to be paid thereon; declaring and determining that the cost of said proposed public improvements and of eachof them will be and is too great to be paid out of the ordinary annual in come and revenue of said municipality, and will, in addition to the other expenditures of said City of Alameda, exceed the income and revenue provided for in any one year; and fixing Wednesday, the 14th day of April, A. D. 1915, as the date upon which said election shall be held, the manner of holding such election and the voting for or against incurring such indebted- ness, establishing election precincts and polling places for such election, and appointing boards of election therefor and proclaiming and giving notice of said Election",- which said Ordinance was adopted and passed on the 23rd day. of March, A. D. 1915, and approved on the 24th day of March, A. D. 1915, came up for passage and was read by the Clerk. Noes:None. Absent:None. 14. A BIll for Ordinance entitled A BILL FOR ORDINANCE NO. NEW SERIES. Providing for the acquiring by the City of Alameda of certain Real Property for the Use and Benefit of the Public Schools of said City, came up for passage and was read by the Clerk. Mr. Morgenstern moved that the Ordinance be adopted, seconded by Mr. Bartlett, and it was passed and adopted by the following vote:- Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9) Noes:None. I The Recreation Commission presented a communication giving the approximate needs of lands, buildings and lighting for the recreation -oand the City, the money for which is to be raised by bonds, axml. / that the same be included in t'le,Ordinance calling the Bond Election, seconded by Yr. Mr. Probst moved that the Council meet in adjourned regular session sday evening, April 15th, 1915, seconded. by Mr. Morgenstern and carried by the following vote:- Ayes:Councilmen Bartlett Aullock, Hammond, MacRae, Morgenstern, Morris, Probst, Roth and Stewart, (9). Noes:None. lbsent: April 13th, 1915. requiring twenty cents to be raised in the annual tax levy for the re- construction of streets had been defeated and moved, seconded by Hr. Roth that the proposition of raising 300,000 by bond issue be in eluded in the forthcoming election. Mx. Hammond offered a sututitute motion, that the matter be referred to the Committee of the Whole meeting and that the Council meet as a Camittee of the Whole on Thursday evening, April 15th, 1915, second d by Mr. Morgenstern and carried. Mr. Morgenstern then moved that the action taken calling an adjourned regular meeting on April 15th, 1915, be rescinded, second- ed by Mr. Bartlett and carried by the following vote:- Ayes:Counci men Bartlett, Bullock, Hanmond, MacRae, i:orge tern, Morris, Probst Roth and Stewart, (9). Noes:,-jone. Absent:None. Mr. MacRae introduced a Bill entitled A BILL FOR ORDINAITCE NO. NEW SERIES. Establishing the Official Curb Grade on Fillmore Street in the City of Alameda from the 7jesterly line of Mound Street to a lince Crossing said. Fillmore Street and arallel with said Westerly line of Mound. Street, and Distant 209.09 feet 7:esterly Therefrom, which was laid over under a provision of the Charter. V/ Mr. Probst called attention to the water standing on the marsh at the north end of Bay Street and moved, seconded by Mr. Bullock and carried, that the Clerk communicate with the Board of Health asking them to investi- gate the insanitary condition of the water. 18. Tir. Probst asked of the City Attorney when the certified check of A. T. Snence,submittednwith his bid on the Municipal Garage, could be returned. Mr. Boorman stated that he would ascertain by Friday night if possible, whether the revenue stamps on the bond were sufficient. 19. Mr. Roth stated that the Chief of Police desired a sink put in the photo- graph room in the new Garage and moved that the some of 5.00 be allowed to install the same, and that the City Engineer alter the plans of the Garage, seconded by Mr. Hammond. and carried by the following vote:- Ayes:Councilmnn Bartlett, Bullocr Hammond, MacRae, Morgenstern, Morris , Probst Roth and Stewart, (9). 7oes:None. ;Absent:ITone. 20. Mr. Stewart stated that Joseph Koenig desired the refund of a0,00 which he paid as the license foe for soliciting cleaning and dyeing. wqs advised that inasmuch as the money had been paid and no legal protest accompanied thesame, the refund could not be made. 21. Hr. Bartlett asked what action the City ,ettorney had taken on the matter of issuing an injunction agaonst the City of Oakland pumping mud on the marshes. The Attorney stated that he was preparing the necessary papers. Mr. Bartlett moved, seconded by :Ir. Probst and carried, that the City Attorney give a written opinion on the matter on Friday evening. City eLttorney Poorman addressed the Council relative to the mistake nece ssitating the postponement of the Bond ]aection and stated that he April 13th, 1915. interpreted by the Clerk, with the result that the first Publication was not made within three days as required by the Charter. He stated further that it was an inadvertence on the part of the Clerk and that he did not desire to place an blame, and also, that if the responsiblity could be fixed on him he would gladly pay the additional cost, R'J Hr. 7. P. Robinson requested of the Council a statement, relative to the 241.4: C. nu: application he made for the moving of his house on Santa Clara Avenue. Cit., Attorney Doorman stated that the Superior Court had ruled that the City cannot deny a grant to remove a hou—e, but the Judgement had not been entered as yet. As soon as the proper entry is made, he will appeal the case to the hillor court. Mr. Morgenstern moved that thePeoples ater Company be granted permission to move their house across Fornside 'Aulevard, seconded by Mr. Bullock and carried by the following vote:-, Ayes:Councilmen Bartlett, Bullock, Hammond, MacRae, Morgenstern, Morris, Frobst, Roth and Stewart, (9). Morgenstern moved that the Clerk communicate with the Peoples Water Company to ascertain from them when the Company intended to place the new fire ydrants as agreed upon at a meeting held with the Finance Camnittee, seconded by r. Ste;art, and carried. There being no further business to transact the Council adjourned to meet in adjourned regular meeting, Friday evening, April 1Gth, 1915, at 8 o'clock.
