Alameda Reuse and Redevelopment Authority Interoffice Memorandum DATE: TO: FROM: November 8, 2001 Honorable Members of the Alameda Reuse and Redevelopment Authority Doug Yount, Assistant Executive Director 3 -A SUBJECT: Request for ARRA Approval of Assignment of Sublease of Buildings 774, 800, 804, CPO 14, CPO 23 and CPO 24 Containing Twelve Dwelling Units from United Indian Nations CDC to Alameda Point Collaborative. BACKGROUND United Indian Nations Community Development Corporation (UIN CDC) is a member organization of the Alameda Point Collaborative (APC). As a member organization it was responsible for the rehabilitation of twelve units comprising Unity Village. The units serve formerly homeless people. Since completing renovation of the units, UIN has served 87 people (including children). Thirty -five people completed the program and exited with increased income - earning capacity. Thirty -five percent (10 people) found jobs and 75% (26 people) moved into permanent housing. However, at this time, UIN believes that its residents and the larger APC community would benefit from an assignment of its sublease to APC. UIN's primary mission is to develop housing and other projects to serve the Native American community. It has fulfilled this mission by rehabilitating and leasing up the units at Unity Village. UIN feels that an assignment of its sublease to APC will provide a better economy of scale for operations and management activities at Unity Village. ANALYSIS /DISCUSSION Section 5.2 of the Sublease between the ARRA and UIN provides for the assignment of the sublease pending approval of the ARRA Board. The Sublease requires that the following information be provided regarding the proposed assignee: • • • • name, address, and description of the assignee; the organization's most recent financial statement and other evidence of financial responsibility; a description of the intended use of the leased premises; and the terms and conditions of the proposed assignment. APC has provided staff with all of the required information pursuant to Section 5.2 of the Sublease. APC is a 501(c)(3) non -profit public benefit corporation. Its mission is to provide service - enriched housing and community space at Alameda Point for formerly homeless individuals and families. Honorable Members of the November 8, 2001 Alameda Reuse and Redevelopment Authority Page 2 The APC currently has 25 employees and anticipates hiring an additional 15 people at full development. The organization is currently funded through foundation and federal, state and local government grants. The 2001 -02 operating budget is approximately $2 million. APC proposes to continue the existing use of the 12 housing units which is to provide housing for Native American survivors of domestic violence, individuals in recovery, youth and reuniting families. UIN proposes to relinquish all rights and responsibilities pursuant to its Sublease with ARRA and APC proposes to assume all rights and responsibilities related to the 12 units. In addition, APC will assume the rights and responsibilities under the Alameda County Housing and Community Development loan documents and regulatory agreement and the Federal Home Loan Board Affordable Housing Program loan commitment. APC will also assume all financial obligations of the property. FISCAL IMPACT Approval of assignment of the Sublease will not have a fiscal impact. RECOMMENDATION Staff has reviewed the infoimation provided by APC pursuant to Section 5.2 of the Sublease between the ARRA and UIN and has concluded that APC has the financial capability, management expertise and operational capacity to assume the Sublease and to continue to carry out the existing uses at Unity Village consistent with the Sublease. Therefore, it is recommended that the ARRA Board approve the assignment of its Sublease with UIN CDC to APC. W PD Alameda Reuse and Redevelopment Authority Interoffice Memorandum November 7, 2001 TO: Honorable Members of the Alameda Reuse and Redevelopment Authority FROM: Doug Yount, Development Services Director SUBJECT: Request for the ARRA Governing Board to Transfer Authority to Enter Into an Interim Lease for a Nursery and Community Garden from University Avenue Housing to the Alameda Point Collaborative Background The ARRA Governing Board has previously authorized the ARRA Executive Director to finalize negotiations and execute an interim lease through the term of the Master Lease with University Avenue Housing (UA) for a site for a nursery on Parcel 99 and a site for a community garden on Parcel 98. The Alameda Point Collaborative (APC) and UA Housing are now requesting that the ARRA approve the transfer of authority to enter into an interim lease from UA Housing to the APC. Discussion At the time of the ARRA authorization for the interim lease, the Alameda Point Collaborative had not yet incorporated as a non - profit and had no permanent staff. In August 1999, the APC incorporated and over the past two years has secured a variety of funding grants. The APC currently has a staff of approximately 20 and has a wide range of services in place for the residents of the 200 units of Collaborative housing at Alameda Point. These services include provision of employment development opportunities, case management and other support services for residents. With the development of the APC capacity and services, the APC and UA Housing believe that it would be more appropriate and effective for the APC to directly manage and have responsibility for the nursery and community garden projects. The APC management will facilitate the integration of the projects with other APC services and ensure the opportunity for the involvement of all of the Collaborative residents in the associated programs and activities.
