1981-11-03 Regular CC Meetingrye REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY NOVEMBER 3, 1981 The meeting convened at 7:30 p.m. with President Corica presiding. The Pledge of Allegiance was led by Councilman Stone. The Invocation was given by Rev. James Oldham, First Baptist Church. ROLL CALL: Present: Councilmen Diament, Gorman, Sherratt, Stone, and President Corica - 5. Absent: None. MINUTES Councilman Diament made a motion, seconded by Councilman Sherratt, that the Minutes of the Special Council Meeting of October 23 and the Regular Adjourned Council Meeting of October 27, 1981, be approved as submitted; the motion carried by unanimous voice vote - 5. CONSENT CALENDAR President Corica announced that there was no Consent Calendar for this meeting. WRITTEN COMMUNICATIONS 81-692 From Bay Area Rapid Transit District, signed by Director Margaret K. Pryor, District 4, requesting to address the Council regarding the proposed BART satellite parking plan. Director Pryor read a report regarding access from Alameda to the BART stations and stated that BART is working on a plan for a satellite parking site in east Alameda as well as improved bus service from Alameda to BART. In response to inquiry of President Corica, Director Pryor stated that BART had not investigated a possible site at this point, and any participation by Alameda would expedite the project. She further stated that staff assistance could be con- sidered participation. Director Pryor distributed a notice regarding a meeting to be held November 10, 1981, for proposed route change in bus service to Bay Farm Island, At the conclusion of discussion, President Corica noted that the Public Works and Planning staff could work with BART to coordinate the proposed parking site and present recommendations to the City Council and the BART Board. President Corica expressed appreciation to Director Pryor for her interest in Alameda residents. REPORTS AND RECOMMENDATIONS 81-693 From Public Works Director recommending that improvements within Tract 4120 (Clipper Cove) be accepted. Councilman Sherratt made a motion, seconded by Councilman Stone, that the report be accepted and the recommendation approved; the motion carried by unanimous voice vote - 5. November 3, 1981 ����� � � v� 81-694 From Finance Director submitting Quarterly Financial Report. Councilman Diament made a motion, seconded by Councilman Sherratt, that the report be accepted; the motion carried by unanimous voice vote - 5. 81-595 From Finance Director submitting Interest Earnings Report for September, 1981, Councilman Stone made a motion, seconded by Councilman Gorman, that the report be accepted; the motion carried by unanimous voice vote - 5. 81-696 From Community Development Director regarding updated information relative to the HOPE Housing Counseling Contract. Preisdent Corica noted that the status had changed since the contract was approved by Council as the Executive Director position is now one-half time instead of full time. Councilman Stone expressed concern regarding supervision of housing counseling by the Executive Director as his position is 50% funded by Alameda County Employment and Training Board (ACTEB) and 50% of his time is allocated to rehabilitation. She further stated she would abstain from voting as she serves on the ACTEB Board. Councilman Sherratt made a motion, seconded by Councilman Diament, that the matter be carried over to the next meeting for a more thorough analysis and explanation Of the changes that have occured; the motion carried by the following roll call vote: Ayes: Councilmen Diament, Gorman, Sherratt, and President Corica - 4. Councilman Diament made a motion, seconded by Councilman Sherratt, that the report be accepted; the motion carried by unanimous voice vote - 5. RESOLUTIONS 81-698 Resolution No. 9637 "Establishing rates and fees to be charged for Play on Alameda Municipal Golf Course." Sue T8maDt0, 1524-A - 8th Street, spoke regarding use of funds for City services. Councilman Sherratt made a motion, seconded by Councilman Diament, that the resolution be adopted; the motion carried by the following roll call vote; Ayes: Councilmen Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. 81-609 Resolution No. 9638 "Authorizing execution of amendment to professional services agreement with DKS Associates in connection with design of Patton Way to establish new schedules and fees." Councilman Diament made a motion, seconded by Councilman Sherratt, that the resolution be adopted; the motion carried by the following roll call vote; Ayes: Councilmen Diament, Gorman, Sherratt, Stone, and President Corica - 5. November 3, 1981 INTRODUCTION OF ORDINANCES 81-700 Ordinance No. , New Series "Amending the Alameda Municipal Code by amending certain sections of Article 7 of Chapter 1, Title V, thereof relating to regulation of news racks." The following persons spoke in opposition to the ordinance stating they did not feel it was necessary: Larry Frankel, representing the Oakland Tribune Christopher Lammers, representing the San Francisco Chronicle and Examiner Gerhard Degemann, 304 Sand Beach Road, expressed concern about the types of news racks and the number placed in residential areas. Councilman Stone made a motion that the Oakland Tribune be requested to remove East Bay Today news racks from residential areas. Councilman Gorman stated that he would second the motion if amended to request that news racks be removed if complaints were received from residents in the area; the amendment was accepted by Councilman Stone. The City Attorney stated that the ordinance under consideration deals with the safety issue, and the location and aesthetics of news racks would be difficult to deal with because of the First Amendment. Councilman Sherratt recommended that all newspapers be included in the request to remove racks if complaints are received and that the newspapers notify the City if complaints are received. After further discussion, Councilman Stone restated the motion, as amended, and accepted by Councilman Gorman, that all the newspapers be requested to notify City of complaints regarding news racks in residential areas and that newspapers fully consider possible removal of racks if complaints are received; the motion carried by unanimous voice vote - 5. Councilman Diament made a motion, seconded by Councilman Gorman, that the ordinance be introduced and passed to print; the motion carried by the following roll call vote; Ayes: Councilmen Diament, Gorman, Sherratt, Stone, and President Corica - 5. FINAL PASSAGE OR ORDINANCES 81-705 Ordinance No. 2067, New Series "Amending the Alameda Municipal Code by amending Section 5-264.1 of Article 6, Chapter 2, Title V, thereof relating to administrative processing of Revocable Encroachment Permits." Councilman Stone made a motion, seconded by Councilman Sherratt, that the ordinance be finally adopted; the motion carried by the following roll call vote; Ayes: Councilmen Diament, Gorman, Sherratt, Stone, and President Corica - 5. Noes: None. Absent: None. UNFINISHED BUSINESS 81-706 From Public Works Director recommending acceptance of the State Triangle at Island Drive and Doolittle Drive and Lot 4 of Tract 3773. Councilman Sherratt made a motion, seconded by Councilman Gorman, that the report be accepted and the recommendation approved; the motion carried by the following roll call vote: Ayes: Councilmen Gorman, Sherratt, Stone, and President Corica - 4. Noes: None. Absent: None. Abstaining: Councilman Diament - 1. 81-707 Councilman Stone requested maps and material regarding the Mastick Senior Center requested by Charlie Tillman be furnished to him as soon as possible. Councilman Sherratt requested Councilmembers also receive the material. 81-708 Councilman Sherratt appointed Daniel Cummins, Attorney, to the Charter Review Committee. 81-709 In response to inquiry of Councilman Stone regarding the City Clerk auto- matically providing Councilmembers notice of items held over for specific periods of time; i.e., three or six months, the City Clerk stated that she would provide the Council a list of pending items. November 3, 1981 81-710 Councilman Diament requested a resolution of appreciation for the Mastick Senior Center Advisory Board be prepared for their volunteer work for the dedica- tion ceremony. BILLS 81-711 Councilman Sherratt made a motion, seconded by Councilman Stone, that an Itemized List of Claims, certified by the City Manager as correct, be approved in the amount of $95,334'61; the motion carried by unanimous voice vote - 5. ADJOURNMENT 81-712 Councilman Diament made a motion, seconded by Councilman Stone, that the Council adjourn to an Executive Session for a discussion of personnel matters; the motion carried by unanimous voice vote - 5. After discussion in Executive Session, President Corica ordered the meeting convened to open sesssion. Councilman Sherratt made a motion, seconded by Councilman Stone, that the City Clerk be granted an 8.5% pay increase retroactive to July 1, 1981, and granted a maximum of S500 payment of life insurance premium for Fiscal Year 1981-82; the motion carried by unanimous voice vote - 5. Councilman Sherratt made a motion, seconded by Councilman Stone, that the City Manager and City Attorney be granted a 6% pay increase retroactive to July 1, 1981, and each granted a maximum of S500 payment of life insurance premium for Fiscal Year 1981-82, and that the City Manager, City Attorney, and City Clerk have the option of.rOC6iVing the retroactive pay after January 1, 1982 if desired; the motion Carried by unanimous voice vote - 5.
