TUESDAY- -NOVEMBER 4, 2003- -7:25 P.M.
Mayor/Chair Johnson convened the Special Joint Meeting at 7:57 p.m.
Councilmember/Commissioner Gilmore led the Pledge of Allegiance.

Absent: Councilmember/Commissioner Matarrese – 1.
AGENDA ITEMS
CITY COUNCIL ACTION
(03-487CC) Resolution No. 13643, “Establishing a Policy of Fiscal
Neutrality Regarding Development at the Fleet Industrial Supply
Center/East Housing and Alameda Point.” Adopted.
Vice Mayor Daysog thanked the City Attorney and City Manager’s
staff for resolving the issue and seeking input from Council;
stated everyone wants to ensure the development is completed in a
fiscally responsible way.
Vice Mayor Daysog moved adoption of the resolution.
Councilmember Kerr stated the resolution includes language that
allows evaluation of lowering the special tax levy and review of
finances by future Councils; Appendix A, which refers to services
to be provide by the District, mentions specific parts of Tinker
Avenue, Fifth Street, and Mosley Avenue; future Councils should not
be limited to discussing support of only said streets; as
development occurs, there will be a need for other capital
improvement projects to support the development; for example, the
Constitution Way overpass was not needed prior to the development
of Harbor Bay Isle; action tonight should not arbitrarily limit
what future Councils can consider.
Vice Mayor Daysog stated the resolution is broad; at every point of
the budgeting process, residents can see how much money is needed;
future Councils can refer to the resolution and the requirement
that the project be fiscally neutral; therefore, Councilmember
Kerr’s concerns are captured by the resolution.

Councilmember Gilmore seconded the motion, which carried by
unanimous vote – 4. [Absent: Councilmember Matarrese – 1.]
COMMUNITY IMPROVEMENT COMMISSION ACTION
(03-061CIC) Resolution No. 03-118, “Resolution Supporting the City
Council’s “Fiscal Neutrality” Policy by Committing Fleet Industrial
Supply Center (FISC) Lease Revenues to Support Municipal Services
for Development of the FISC and Bayport Residential Development.”
Adopted.
Commissioner Daysog moved adoption of the resolution.
Commissioner Kerr seconded the motion, which carried by unanimous
vote – 4. [Absent: Commissioner Matarrese – 1.]
HOUSING AUTHORITY BOARD OF COMMISSIONERS ACTION
Recommendation to direct the Chief Executive Officer to take all
actions necessary or appropriate to support the formation and
approval of Community Facilities District No. 03-1 of the City of
Alameda (Bayport Municipal Services District) and the
implementation of its purposes.
Commissioner Gilmore moved approval of the staff recommendation.
Commissioner Torrey seconded the motion, which carried by unanimous
voice vote – 5. [Absent: Commissioner Matarrese – 1.]
COMMUNITY IMPROVEMENT COMMISSION ACTION
(03-062CIC) Recommendation to direct the Executive Director to take
all actions necessary or appropriate to support the formation and
approval of Community Facilities District No. 03-1 (Bayport
Municipal Services District) and implementation of its purposes.

CITY COUNCIL ACTIONS
(03-488CC) Public Hearing to consider establishment of City of
Alameda Community Facilities District No. 03-1 (Bayport Municipal
Services District);
(03-488A-CC) Resolution No. 13644, “Resolution of Formation of a
Community Facilities District.” Adopted;
Mayor Johnson stated the public hearing is regarding formation of
Community Facilities District No. 03-1 of the City of Alameda to be
known as the Bayport Municipal Services District; opened the Public
Hearing; inquired whether the Clerk received any written protests
or speaker slips.
The City Clerk responded in the negative.
Mayor Johnson closed the public portion of the Hearing.
Councilmember Kerr moved adoption of the resolution.
Vice Mayor Daysog seconded the motion, which carried by unanimous
voice vote – 4. [Absent: Councilmember Matarrese – 1.]
(03-488B-CC) Resolution No. 13645, “Resolution Calling a Special
Election.” Adopted; and
Councilmember Gilmore moved adoption of the resolution.
Vice Mayor Daysog seconded the motion, which carried by unanimous
voice vote – 4. [Absent: Councilmember Matarrese – 1.]
(03-488C-CC) Resolution No. 13646, “Resolution Declaring Results of
Special Election and Directing Recording of Notice of Special Tax
Lien.” Adopted.
Mayor Johnson instructed the Clerk to conduct the special election
in Conference Room 391.
After the City Clerk returned from counting the ballots, Mayor
Johnson stated the Clerk has completed the form of canvass and
statement of results of election; requested that the Clerk attach
the form to the resolution Council would consider and read the
results of the election.
The City Clerk stated the special election has been conducted; that
she received and tabulated the ballots and completed the form of
Special Joint Meeting Alameda City Council, Community
Improvement Commission and Housing Authority Board of Commissioners
November 4, 2003

canvass and statement of results of election as attached to the
resolution declaring the resolution of special election and
directing recording of Notice of Special Tax Lien; as shown on the
canvass, all votes were cast in favor of the ballot measure.
Vice Mayor Daysog congratulated staff.
Councilmember Kerr moved adoption of the resolution.
Councilmember Gilmore seconded the motion, which carried by
unanimous voice vote – 4. [Absent: Councilmember Matarrese – 1.]
ADJOURNMENT
There being no further business, Mayor/Chair Johnson adjourned the
Special Joint Meeting at 8:10 p.m.
