ACCEPTING CONVEYANCE FROM ALAIvIEAD BELT LINE, A
CALIFORNIA CORPORATION, OF EASEMENTS IN CERTAIN REAL
PROPERTY AND CONSENTING TO THE RECORDATION THEREOF
WHEREAS, a certain indenture dated July 16th, 1946, made by and between
Alameda Belt Line, a Claifornia corporation, as Grantor, and. City of Alameda, a
municipal corporation of the State of California, as Grantee, was, on or about
said date, executed. and delivered by said. Grantor to said. Grantee; and
WHEREAS, by said indenture, the grantor therein named granted to the
City of Alameda certain easements under, upon, along or across the hereinafter
described portions of Tracts numbered 24 and 30, as said Tracts are delineated
and so designated upon that certain map entitled "Map of Alameda Marsh Land as
partitioned among the owners thereof in the suit numbered 8923 and entitled
'Pacific Improvement Company, Plaintiff, vs. James A. Waymire, et al., Defendants,'
Superior Court of Alameda County, State of California", filed in the office of the
County Recorder of Alameda County on the 30th day of July, 1900, in Book 25 of
Maps, pages 74 to 78, inclusive, for the construction, maintenance and operation
of an underground sanitary and storm sewer pipe line and appurtenant underground
pumping plant and underground junction box, as follows:
(1) A 48-inch reinforced concrete outfall sewer pipe line under and
along the following described real property:
A strip or parcel of land twelve (12) feet in width extending
from the eastern boundary of Parcel No. 2 in Tract 24 to the
southern boundary of The Atchison, Topeka and. Santa Fe Railway
Company property in Tract 30, said parcel lying six (6) feet on each
side of the following described center line and containing an area
of 0.425 acres more or less.
Beginning at the northeastern corner of Tract 24 as delineated
and so designated on the map heretofore referred to; thence north
86* 52' 00" west along the northern line of said Tract 24, a
distance of 109.55 feet; thence south 3* 08' 00" west, a distance
of 12.00 feet to the actual point of beginning for the center line herein
described; thence south 86* 52' 00" east parallel to said northern line
of Tract 24, a distance of 59.05 feet; thence northeasterly on the arc
of a curve concave to the northwest having a radius of 22.50 feet (the
chord of which bears north 62* 02' 30" east 23.24 feet) an arc distance
of 24.42 feet to a point in the northern line of Tract 24, said point
bearing north 86* 52' 00" west, a distance of 30.60 feet from the
northeast corner of said Tract 24; thence continuing northerly on the
arc of the aforesaid mentioned curve (the chord of which bears north
17* 02' 30" east 10.82 feet), an arc distance of 10.92 feet; thence
north 3* 08' 00" east parallel and being 28.00 feet westerly from
the eastern line of Tract 30, a distance of 1448.09 feet to a point
in the southern line of the Atchison, Topeka and Santa Fe Railway
Company property, said point being the northern end of said center line.
(2) A reinforced concrete water pumping plant having a 45 cubic-foot-
p ar-second capacity, a 48-inch reinforced concrete outfall sewer pipe and a 54-inch
reinforced. concrete inlet sewer pipe line to pumping plant, under, upon and across
the following described real property:
Beginning at the northeastern corner of Tract 24 as delineated and so
designated on the map heretofore referred to; thence north 86* 52' 00"
west along the northern line of said Tract 24, a distance of 109.55
feet to the actual point of beginning of the parcel of land herein
described; thence continuing north 86* 52' 00" west along said northern
line of Tract 24, a distance of 50.00 feet; thence south 3* 08' 00"
west a distance of 31.00 feet; thence south 41* 52' 00" east a distance
of 26,87 feet; thence south 86* 52' 00" east a distance of 31.00 feet;
thence north 3* 08' 00" east a distance of 50.00 feet to the actual
point of beginning, containing an area of 0.053 acres more or less.
(3) A 54-inch reinforced concrete sewer pipe line (connecting the
pumping plant located under and upon the real property described in (2) above with
the junction box under and upon the real property hereinafter described in (4)
hereof) under and along the following described real property:
A strip or parcel of land twelve (12) feet in width extending
from the western boundary of Parcel No. 2 to the northern boundary
of Parcel No. 4, said parcel lying six (6) feet on each side of the
following described center line and containing area of 0.071 acres
more or less.
Beginning at the northeastern corner of Tract 24 as delineated
and so designated on the map heretofore referred, to; then north
86* 52' 00" west along the northern line of said Tract 24 a distance
of 159.55 feet; thence south 3* 08' 00" west a distance of 24.00
feet to the actual point of beginning for the center line herein des-
cribed; thence north 86* 52' 00" west parallel to said northern line
of Tract 24, a distance of 58.23 feet; thence south 45* 10' 22" west,
a distance of 95.9 8 feet; thence south 31* 54' 00" west, a distance
of 104.56 feet to a point in the northern boundary of Parcel No. 4,
said point being the southern end of said center line.
(4) A reinforced concrete junction box with checkgate between
an existing 54-inch sewer pipe line under a portion of the real property
described in this (4) and the 54-inch sewer pipe line to be installed under
the real property described in (3) above, and any additional 54-inch pipe
line necessary to effect such junction, under, upon and along the following
described real property:
Beginning at Station 19 of the Segregation Line as delineated and
so designated on the map heretofore referred to; thence north 76* 04'
00" west along said Segregation Line, a distance of 75.01 feet, to the
point of intersection with the eastern line of Sherman Street; thence
north 3* 08' 00" east along the extension of the eastern line of Sherman
Street, a distance of 8.26 feet, to the actual point of beginning of the
parcel of land herein described; thence north 72* 36' 05" west, a distance
of 16.00 feet; thence north 17* 23' 55" east, a distance of 20.00 feet;
thence south 72* 36' 05" east, a distance of 7.89 feet to a point, said
point being the southern end of the center line described in Parcel No.3;
thence continuing south 72* 36' 05" east, a distance of 14.98 feet; thence
south 39* 56' 30" west, a distance of 19.35 feet; thence south 3* 08'
00" west, a distance of 2.20 feet to the actual point of beginning,
containing an area of 0.009 acres more or less; the location or each
parcel of said real property and a description of the easement with
respect thereto being shown on blue print marked Exhibit "A", attached
to said indenture and made a part thereof; together with the right of
ingress and egress over the adjoining lands of grantor for the purpose
of constructing, maintaining and repairing said sanitary and storm sewer
and appurtenances; reserving, however, to grantor the right to construct
railroad tracks or any other structures or improvements upon the real
property therein described, and make any other use of said real property
which shall not defeat the purpose of the easements thereby granted; and
WHEREAS, the City of Alameda did, on December 3, 1946, accept
said conveyance and acquired possession of the said easements in the real
property above described;
NOW, REFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA
that the aforementioned indenture be, and the same is hereby, accepted on
behalf of the City of Alameda, and said. City Council, acting for and in behalf
of said. City, hereby consents to the recordation of said indenture and orders
this Resolution to be attached thereto, as required by Section 1158 of the
Civil Code of the State of California.
1, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the City of
Alameda in regular meeting assembled on the 3rd day of December, 1946, by the
following vote, to wit:
AYES: Councilmen Howe, Osborn, Sweeney and President
Branscheid, (4).
NOES: None.
ABSENT: Councilman Jones, (1).
