SUBEITTING AN ORDINANCE NO. N. S. AMENDING ORDINANCE
NO, 276 N. S. , =OWN AS TEN PENSION ORDINANCE, ENTITLED
"Al ORDINANCE PROVIDING FOR A RELIEF, HEALTH, LIFE INSURANCE.
AND PENSION FUND FOR MEMBERS OF THE FIRE AND POLICE DEPART
DENTS OF THE CITY OF ALAMEDA; ALSO FOR THE ADMINISTRATION
OF SAID FUND", TO BE VOTED UPON AT THE GENERAL le I IPAL
ELECTION TO BE HELD IN SAID CITY ON TUESDAY MACH 11 1947.
WHEREAS, The Council of the City of Alameda, on its own motion, desires
to submit to the qualified electors of said City and ordinance No. N. S.,
amending Ordinance No. 267 N. S., known as the Pension Ordinance, entitled TrAn
Ordinance providing for a relief, health, life insurance and pension fund for
members of the fire and police departments of the City of Alameda; also for the
administration of said fundu, to be voted upon at the general municipal election
to be held in said City on Tuesday, March 11, 1947;

AN ORDIANANCE AMENDING ORDIANANCE NO 276 N. S., PROVIDING FOR
A RELIEF, HEALTH, LIFE INSURANCE AND =SION FUND FOR N711TTRS
OF THE FIRE AND POLICE DEPARTT,ENTS OF THE CITY OF ALAMEDA;
ALSO FOR THE ADMINISTRATION 011 SAID FUND.

SECTION 1. Subdivision (a) is hereby added to Eection 10 of Ordinance
110. 276 N.S., referred to in the title hereof, which shall read as follows:
(a) Any member who has been lawfully granted a leave of absence to
enter the service of any branch of the armed forces of the United States in time
of war or declared national emergency, and who, upon being honorably discharged
therefrom, reenters the city service within the period of said leave, may elect,
within sixty (60) days from the effective date of this ordinance or within sixty
(60) days from the date of reentry into city service, whichever is the later
date, to deposit in the Relief, Health, Life Insurance and Pension 11 :rd for
members of the -ire and Police Departments of the City of Alameda, a sum of
money equal to the contributions which would have been withheld from his comnen-
sation if he had remained in active city service in the position which he held
at the time such leave was granted. Such deposit may be made by said member
either in one sum or in as many monthly installments as equal the number of
months, or fractions thereof, that said eember was on said leave of absence.
In the event that such deposit is made thc City shall deposit into said fund
a sum equal to three per cent (31.) of the compensation which said member would
have received if he had remained in active city service in the position which
he held at the time such leave was granted; provided further, that whenever a
member has boon lawfully granted u leave of absence to enter the service of
any branch of the armed forces, as aforesaid, and reenters the active service
of the eity within the period of such leave, he shall be credited with the
time he was on such leave of absence in the same manner as though he had been
actually in active service in said Fire or Police Departments,
SECTION 2. This ordinance shall be in full force and effect ten (10)
days from and after the date of its adoption.
The City Clerk is also directed to publish once in the Alameda Times-
star, a daily newspaper of general circulation, published and circulated in said
City, the aforesaid proposed Ordinance Mo. N. S., amending Ordinance No.
276 N.S., known as the Pension Ordinance, en 1 ed "An Ordinance providing for
a relief, health, life insurance and pension fund for members of the fire and
police departments of the City of Alameda; also for the administration of said
f du. He shall cause copies or said proposed ordinance to be printed in con-
venient pamphlet form and shall mail a copy thereof, enclosed with the sample
ballot, to each voter at least ten (10) days prior to said election. He shall
also, until the day fixed for the election, advertise in the foregoing newspaper
a notice that such copies may be had at his office in the City hall, upon appli-
cation therefor.
lf the proposed Ordinance No. N. S. amending Ordinance No. 276
N. S., known as the Pension Ordinance, entitled "An Ordinance providing for a
relief, health, life insurance and pension fund for members of the fire and
police departments of the City of Alameda; also for the administration of, said
fund", so submitted, recoives a majority of the votes cast thereon at said
election, said ordinance shall be enacted accordingly and go into effect
ten (10) days after the declaration by the canvassing board of the result
of said election.

duly and regularly introduced and adopted by the Council of the City of Alaneda
in regular meeting assembled on the 7th day of January, 1947, by the following
vote, to wit:
AYES: Councilmen Howe-, Jones, Osborn, Sweeney and President
Branscheid, (5)
NOES: None.
ABSENT: None.
