Ordinance 3159CITY OF ALAMEDA ORDINANCE NO. 3159 New Series AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALAMEDA, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF ALAMEDA TO INCLUDE PROVISIONS PURSUANT TO GOVERNMENT CODE 20516 "COST SHARING" FOR LOCAL POLICE MEMBERS AND FOR LOCAL FIRE MEMBERS (REQUIRES FOUR AFFIRMATIVE VOTES) WHEREAS, due to ongoing economic difficulties, the City negotiated and approved revised agreements with its sworn safety employees whereby all sworn safety employee groups will contribute additional sums toward the employer portion of their retirement contribution; and WHEREAS, to effectuate this cost - sharing agreement under the State of California Public Employee Retirement Law Section 20516, an amendment to the contract between the City of Alameda and the California Public Employees' Retirement System must be approved; and WHEREAS, in accordance with the Charter Article 111. Sec. 12, this urgency ordinance is necessary to preserve the public peace, health or safety by implementing the negotiated agreement between the City and it Public Safety bargaining units and reducing the City's pension costs. Furthermore, in order to comply with the negotiated agreement between the City and its Public Safety bargaining units the ordinance must be adopted as an urgency ordinance for immediate effect and to assure the timely and appropriate reporting of employee retirement contribution to employee accounts and to avoid an additional 30 day processing delay. NOW, THEREFORE, the City Council of the City of Alameda does hereby ordain as follows: Section 1. The Recitals set forth above are true and correct and incorporated herein. Section 2. That an amendment to the contract between the City Council of the City of Alameda and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked Exhibit A, and by such reference made a part hereof as though herein set out in full. Section 3. The Mayor of the City of Alameda is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said Agency. Section 4. Effective Date. The City Council hereby declares, on the basis of the findings set forth above, that a great necessity exists and that this Ordinance is necessary in order to comply with the Labor Agreements with all City Public Safety Groups. Accordingly, this Ordinance is adopted as an urgency ordinance and shall take effect and be in force immediately upon its introduction and adoption on July 19, 2016. Section 5. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable. The City Council hereby declares that it would have adopted this Ordinance irrespective of the invalidity of any particular portion thereof. Section 6. The City Clerk will certify to the passage of this Ordinance by the City Council of the City of Alameda and a digest thereof shall be published once in the Official Newspaper of the City within three days after its adoption.
