AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
SUBSECTION 3-70.5 (ESTABLISHMENT OF A COMMUNITY
FACILITIES DISTRICT TO FINANCE CERTAIN SERVICES) OF
SECTION 3-70 (SPECIAL TAX FINANCING IMPROVEMENT CODE),
OF DIVISION I (GENERAL PROVISIONS), OF ARTICLE IV (SPECIAL
TAX FINANCING), OF CHAPTER III (FINANCE AND TAXATION)
BE IT ORDAINED by the City Council of the City of Alameda that:
Section 1. Subsection 3-70.5 (Establishment of a Community Facilities District to
Finance Certain Services) of Section 3-70 (Special Tax Financing Improvement Code) of
Division I (General Provisions) of Article IV (Special Tax Financing) of Chapter I I I (Finance
and Taxation) is hereby amended and restated in whole to read as follows:
3-70.5 - Establishment of a Community Facilities District to Finance Certain
Services.
A community facilities district may be established under this Code to finance any
one (1) or more of the following municipal services within the City or a designated
area or areas within the City:
a. Police protection and public safety services, including, but not limited to,
criminal justice services. Criminal justice services shall not be limited to
providing services for jails, detention facilities and juvenile halls.
b. Fire protection and suppression services, and ambulance and paramedic
services.
c. Street maintenance and resurfacing services.
d. Recreation program services and library services.
e. The operation and maintenance of parks, parkways and open space.
f. The operation and maintenance of museums and cultural facilities.
g. Flood and storm protection services, including, but not limited to, the
operation and maintenance of storm drainage systems, the construction and
maintenance of levees and shoreline stabilization improvements, including
bulkheads.
h. Maintenance of sanitary sewer system facilities and storm drainage facilities
including, but not limited to, sanitary sewer mains, laterals, manholes, pump
stations, and appurtenances to convey, treat, and dispose of sewage, and all
storm drainage lines, mains, inlets, channels and all appurtenances of the
system designed to convey storm waters by cleaning, repairing and removal
of debris, rubbish and other solid waste.
Transportation demand management services and expenses, including but
not limited to public or private bus services, including but not limited to the
purchase of bus vehicles, purchase and distribution of or contributions
towards bus and other transportation passes (including Alameda — Contra
Costa Transit "EasyPass," "BikeLink" and "Clipper cards," or the equivalent
of any of the foregoing), transportation demand management service staffing
and other administrative costs, rideshare subsidies or contracts, website
maintenance, safety educational and marketing materials, bike /pedestrian
facilities, bike share station installation equipment and operations, monitoring
contracts and surveys, and parking management.
Any other municipal service which the City is authorized by law to provide or
contribute funding.
For purposes of this Code, municipal services that may be financed include any of
the following related to the services described above: the furnishing of services
and materials for the maintenance, operation and servicing of any related
improvements, including repair, removal or replacement of all or part of any of the
improvements, the furnishing of water for the irrigation and the furnishing of electric
current or energy for any lights or irrigation facilities, obtaining, constructing,
furnishing, operating and maintaining equipment, apparatus or facilities related to
providing the services and /or equipment, apparatus, facilities or fixtures in areas
to be maintained, obtaining supplies or appurtenant facilities necessary for such
maintenance, paying the salaries and benefits of personnel necessary or
convenient to provide the services, payment of insurance costs and other related
expenses and the payment of cost of and the provision of reserves for repairs and
replacements, and provisions for reserves for future costs of services. The
services described above may be provided by the City, either with its own
employees or by contract with third parties, or any combination thereof.
Section 2. The validity of this Ordinance shall not be contested in any action or
proceeding unless such action or proceeding shall have been brought within thirty (30)
days from the date of the adoption by the City Council of this Ordinance. Unless an action
or proceeding is commenced within said period, this Ordinance shall be held valid and in
every respect legal and incontestable.
Section 3. This Ordinance shall be effective and be in full force and effect from
and after the date which is thirty (30) days after the date of its final passage.
Section 4. The City Clerk shall certify to the adoption of this Ordinance and shall
cause the same to be published in the manner prescribed by law.
