APPROVING AN AMENDMENT TO THE 15 -YEAR CONCESSION
AGREEMENT, WITH A 10 -YEAR RENEWAL OPTION, WITH DIALEMI,
INC, (KNOWN AS JIM'S ON THE COURSE), FOR THE PROVISION
OF FOOD AND BEVERAGE SERVICE AT THE CHUCK CORICA
GOLF COMPLEX
WHEREAS, the City is owner of the real property commonly known as the Chuck
Corica Golf Complex ("Complex") located at 1 Clubhouse Memorial Drive, Alameda,,
California 94502; and
WHEREAS, City has an existing agreement ("Existing Agreement") dated
February 6, 2016 with Tom Geanekos, an individual doing business as Jim's at the
Course ("Concessionaire") to provide food and beverage services at the Clubhouse
Building ("Building") located at the Complex; and
WHEREAS, the City desires to amend this Existing Agreement to change the
requirement to build an Enclosed Patio instead to an Event Center located adjacent to
the restaurant; and
WHEREAS, pursuant to City Charter Article XXII Section 12, the City Council,
without requiring a public vote, may grant concessions within public park property which
is defined to include the Complex,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda
that the New Agreement (as defined above) is approved; and
BE IT FURTHER RESOLVED, the City Manager of the City of Alameda or his/her
designee is hereby authorized to execute, for and on behalf of the City of Alameda, the
New Agreement subject to such technical or clarifying revisions as are reasonably
determined necessary by the City Manager and approved by the City Attorney, and the
City Clerk is hereby authorized and directed to attest to the same; and
BE IT FURTHER RESOLVED, the City Manager, or his/her designee, is hereby
further authorized and directed to execute all documents or instruments and to take any
additional actions that do not require the expenditure of City funds as may be necessary
or appropriate to carry out the provisions of the New Agreement on behalf of the City.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in a regular
meeting assembled on the 19th day of December, 2017, by the following vote to wit:
AYES: Councilmembers Ezzy Ashcraft, Matarrese, Oddie, Vella and
Mayor Spencer — 5.
NOES: None.
ABSTENTIONS: None.
