WHEREAS, on May 28, 2014, Balaji Alameda, LLC submitted an application for
a parcel map and land use entitlements to construct a 72 -room, four-story hotel at
1700 Harbor Bay Parkway; and
WHEREAS, the subject property is designated Business Park on the General
Plan Diagram; and
WHEREAS, the subject property is located within the C -M PD (Commercial
Manufacturing with a Planned Development overlay); and
WHEREAS, the Planned Development for the Harbor Bay Business Park was
approved by PD -81-2, and subsequently amended by PDA -85-4, and the Development
Plan for hotel development on the subject site was originally approved by FDP06-0001;
and
WHEREAS, on August 25, 2014, the Planning Board conditionally approved a
Final Development Plan and Design Review for the construction of the hotel, found the
project exempt from the California Environmental Quality Act ("CEQA") review under
CEQA Guidelines section 15332, and recommended that the City Council approve
Parcel Map No. 10275 to allow the subdivision of an existing 3.56 -acre parcel to create
a new 0.93 -acre parcel for the hotel; and
WHEREAS, on January 16, 2018, the City Council reviewed Parcel Map No.
10275 and all pertinent maps, documents, and exhibits.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Alameda finds that its disapproval of Parcel Map No. 10275 is not subject to the
requirements of CEQA pursuant to CEQA Guidelines Section 15270; and
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of
the City of Alameda makes the following findings pertaining to Parcel Map No. 10275:
1. The proposed map, together with the provisions of its design and
improvements, is not consistent with the General Plan. Page 4 of the Land
Use Element of the General Plan states that the maximum FAR for the Harbor
Bay Business Park is 0.5, with increases up to a maximum FAR of 2 permitted,
proportional to the amount of required parking enclosed in a structure. The
proposed subdivision of the parcel and development of the second hotel would
result in two parcels that exceed the General Plan's 0.5 FAR limit, neither of
which includes a parking structure; and
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of
the City of Alameda d e n i e s approval o f Parcel Map No. 10275 for the subdivision
of the parcel at 1700 Harbor Bay Parkway into two parcels pursuant to Government
Code Sections 66473, 66473.5, 66474 and 66458 and Alameda Municipal Code Section
30-78.5.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in a regular
meeting assembled on the 16th day of January 2018, by the following vote to wit:
AYES: Councilmembers Oddie, Vella and Spencer — 3.
NOES: Councilmembers Ezzy Ashcraft and Matarrese — 2.
