AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE THE
LANDING RIGHTS AGREEMENT LICENSE TO LAND AT HARBOR
BAY FERRY TERMINAL BY AND BETWEEN SAN FRANCISCO BAY
AREA WATER EMERGENCY TRANSPORTATION AUTHORITY AND
TIDELINE MARINE GROUP
WHEREAS, the biotech company Exelixis, one of Alameda's largest private sector
employers, has been exploring alternative transportation options for its employees, many
of whom live in the South Bay; and
WHEREAS, the leading option is a reverse commute private ferry service from
Oyster Point in South San Francisco to the Harbor Bay Ferry Terminal, a service newly
provided by Water Emergency Transportation Authority (WET A) on a limited basis; and
WHEREAS, the City and WETA entered into a Ferry Service Operations Transfer
Agreement (Transfer Agreement) in April 2011, for the Harbor Bay Ferry Terminal, under
which WETA is responsible for maintenance and operation of the waterside assets while
the City is responsible for the landside assets; and
WHEREAS, Tideline Marine Group (Tideline), the proposed operator of the private
ferry service, has been working with WETA to obtain permission to provide small vessel
private charter landings at the Harbor Bay Ferry Terminal; and
WHEREAS, the WETA Board of Directors approved Tideline's request for a six-
month trial program on September 6, 2018, and conditionally approved a Landing Rights
Agreement License to Land at Harbor Bay Ferry Terminal by and between WETA and
Tideline (Landing Rights Agreement), subject to consent by both the City of Alameda and
Harbor Bay Isle Associates (HBIA); and
WHEREAS, on January 3, 2019, HBIA consented to the Landing Rights
Agreement; and
WHEREAS, the City is supportive of alternative transportation modes that reduce
auto traffic, and defers to WETA regarding all waterside impacts and considerations; and
WHEREAS, the City's primary landside consideration would be any potential
impacts to parking, none of which are expected with Exelixis' current plan.
NOW, THEREFORE, BET IT RESOLVED, by the Council of the City of Alameda
that the Interim City Manager is authorized to consent to the Landing Rights Agreement
License to Land at Harbor Bay Ferry Terminal by and between WETA and Tideline.

regularly adopted and passed by the Council of the City of Alameda in a regular meeting
assembled on the 19th day of February, 2019, by the following vote to wit:
AYES: Councilmembers Daysog, Knox White, Oddie, Vella and
Mayor Ezzy Ashcraft-5.
