DETERMINING THAT SPECIAL TAXES SHALL CEASE TO BE LEVIED ON
PROPERTY IN THE CITY OF ALAMEDA COMMUNITY FACILITIES
DISTRICT NO. 4 (DEMOLITION AND BACK BONE INFRASTRUCTURE -
FISC AND EAST HOUSING SITES) AND DIRECTING RECORDATION OF
NOTICE OF CESSATION OF SPECIAL TAX
WHEREAS, under and pursuant to Resolution No. 13378 adopted by the City
Council on August 21, 2001, the City Council formed the City of Alameda Community
Facilities District No. 4 (Demolition and Back Bone Infrastructure-FISC and East Housing
Sites) (the "District") pursuant to the provisions of the City of Alameda Special Tax Financing
Improvement Code, constituting Section 3-70 of Article IV of Chapter Ill of the Alameda
Municipal Code (the "Law"); and
WHEREAS, pursuant to Ordinance No. 2861, adopted by the City Council on
September 4, 2001, the City Council authorized the levy of special taxes (the "Special Taxes")
on real property in the District to pay the debt service on bonds issued for the District and
administrative expenses of the District; and
WHEREAS, on March 14, 2002, the City issued for the District $10,000,000
principal amount of Special Tax Bonds, Series 2002-A (the "2002 CFD Bonds"), the proceeds
of which were used to finance public improvements authorized to be funded by the District;
and
WHEREAS, also on March 14, 2002, the Alameda Public Financing Authority
issued two series of its revenue bonds (the "2002 Authority Bonds") proceeds of which were
used to, among other purposes, acquire the 2002 CFD Bonds; and
WHEREAS, on November 3, 2003, the Community Improvement Commission .
of the City of Alameda issued two series of its tax allocation bonds proceeds of which were
used, among other purposes, to refund in whole the 2002 Authority Bonds and thereby refund
in whole the 2002 CFD Bonds; and
WHEREAS, the 2002 CFD Bonds were paid in full and retired on November 3,
2003;and
WHEREAS, the City Council now desires to make a determination that the
Special Taxes shall cease to be levied on real property in the District, and to direct the
recordation of a Notice of Cessation of Special Tax in the Alameda County Recorder's Office.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda that:
1 . The above recitals are all true and correct.
2. The City Council, as the legislative body for the District under the Law,
hereby determines that the Special Taxes shall cease to be levied in the District, as provided
in Section 3. 70.42 of the Law.
3. The City Clerk is hereby authorized and directed to record a Notice of
Cessation of Special Tax, in the form attached hereto as Exhibit A, in the Office of the County
Recorder of the County of Alameda as soon as practicable following the adoption of this
Resolution.

NOTICE OF CESSATION OF SPECIAL TAX

Community Facilities District No. 4
(Demolition and Backbone Infrastructure-
FISC and East Housing Sites)
The City of Alameda (the "City"), County of Alameda, State of California, with
respect to the City of Alameda Community Facilities District No. 4 (Demolition and Backbone
Infrastructure-FISC and East Housing Sites) (the "CFD"), hereby gives notice that:
1. The City Council of the City has established the CFD under the provisions
of the City of Alameda Special Tax Financing Improvement Code, constituting Section 3-70
of Article IV of Chapter Ill of the Alameda Municipal Code.
2. On March 14, 2002, the City issued, for the CFD, $10,000,000 City of
Alameda Community Facilities District No.4 (Demolition and Backbone Infrastructure-FISC
and East Housing Sites) Special Tax Bonds, Series 2002-A (the "Bonds").
3. On November 3, 2003, the Bonds were paid in full.
4. By reason of the payment in full of the Bonds, the obligation to pay the
special taxes has ceased and the lien imposed by the Notice of Special Tax Lien recorded
on August 31, 2001 as instrument no. 2001329679 in the records of the County Recorder of
Alameda County, State of California, is extinguished.
5. The map of the boundaries of the CFD was recorded in Book 14 of Maps of
Assessment and Community Facilities Districts at Page 88 in the office of the County
Recorder for the County of Alameda, State of California.
