REPEALING RESOLUTION NO. 13893 EMPOWERING THE CITY
ATTORNEY TO EMPLOY SPECIAL LEGAL COUNSEL
WHEREAS, on September 6, 2005, Resolution 13893 was adopted by the City
Council; and
WHEREAS, Resolution 13893 granted the City Attorney authority to hire special
legal counsel for any matter up to $35,000; and
WHEREAS, the costs have increased and the not to exceed amount in
Resolution 19893 is no longer viable; and
WHEREAS, in July 2019, the City Manager and City Attorney revised
Administrative Policies and Procedures, Number 5, Purchasing Policy, as a first step in
providing for enhanced transparency and accountability in City procurement and to align
with present day expectations; and
WHEREAS, based on this policy, the City Attorney's office will advise the City
Council whenever a matter will or is expected to expend attorney's fees and costs in
excess of $75,000, which is in line with existing authority to approve purchasing
contracts with the same limit.
NOW THEREFORE, BE IT RESOLVED, that Resolution No. 13893, which was
adopted by the City Council on September 6, 2005, is hereby repealed in its entirety.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in a regular
meeting assembled on the 3rd day of September 2019, by the following vote to wit:
AYES: Councilmembers Daysog, Knox White, Oddie, Vella and
Mayor Ezzy Ashcraft — 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
