AUTHORIZING THE CITY MANAG'ER TO UTILIZE UP TO $1.605
MILLION IN THE CAPITAL PROJECTS SEAPLANE LAGOON FERRY
TERMINAAL PROJECT FUND FOR THE SEAPLANE LAGOON
FERRY TERMINAL PROJECT AND REVERSING BACK ANY
REMAINING FUNDS TO THE BASE REUSE AND TIDELAND TRUST
BUDGETS IN THE PftOPORTION ORIGINALLY ALLOCATED TO THE
PROJECT
WHEREAS, on June 16, 2015, the City Council approved a Disposition and
Development Agreement (DDA) with the private developer, Alameda Point Partners, LLC
(APP), for the Site A Development at Alameda Point, consisting of a 68-acre mixed-use
project at Alameda Point; and
WHEREAS, contingent upon the closing of the City's transfer of the Phase 1
property to APP, APP was obligated to pay $10 million toward the costs to be incurred for
permitting, designing and constructing the Seaplane Lagoon Ferry Terminal (Project) and
associated parking and landside improvements as part of the Phase 1 backbone
infrastructure; and
WHEREAS, on March 6, 2018, staff proposed and City Council approved the
awarding of a $1 ,604,676 architecture and engineering contract for the Project to Marcy
Wong & Donn Logan (MWDL) in advance of the closing of Site A to get a jump-start on
the design and permitting process and meet the timeline for completion of ferry
construction in FY 19/20 if Site A closed; and
WHEREAS, the award of the $1 ,604,676 MWDL contract prior to the availability of
the $1 0 million to be contributed by APP required that the full cost of the contract be
covered by the City with existing funding sources; and
WHERAS, on March 6, 2018, City Council approved Resolution No. 15350
increasing the Capital Projects Budget (91814) by $1 ,604,646 using the $1.35 million APP
Option Extension Payment and $254,675 from the Tideland Trust Fund until Site A
closed, with the stipulation that the funds would be reversed back to the respective
funding source when Site A closed; and
WHEREAS, the Project has experienced cost overruns and delays and the final
cost is projected to exceed the original budget of $22.2 million; and
WHEREAS, the City Manager recommends use of $1 ,604,646 in remaining funds
in the Capital Project Budget to cover this budget shortfall; and
WHEREAS, the City Council has considered the report and recommendation of
the City Manager on the use of $1 ,604,646 funds for the Project.
NOW, THERFORE, BE IT RESOLVED by the City Council of the City of Alameda
that the City Manager is authorized to utilize up to $1 .605 million in the Capital Projects
Seaplane Lagoon Ferry Terminal Project and reverse back any remaining funds to the
Base Reuse and Tideland Trust budgets in the proportion originally allocated to the
project.
