CANCELING CITY TAXES ON PROPERTYACQUIRED BY THE
CITY OF ALAMEDA FOR MUNICIPAL PURPOSES.
WHEREAS, the following described real property, situated in the City of
Alameda, County of Alameda, State of California, to wit:
PARCEL NO. 1. -
Being a portion of that certain 14.63 acre parcel of land
described in Quitclaim Deed from American Trust Company, a cor-
poration, to Oakland Title Insurance and Guaranty Company, a
corporation, dated 1,,Iay 25, 1936, and recorded May 15, 1937, in
book 3437 of Official Records of Alameda County, page 149, de-
scribed as follows:
Commencing at Tide Land Survey Stake No. 8 as listed on
Table II Meanders of Salt Tviarshes according to "Map No. 2 of
Salt Marsh and Tide Lands situate in the County,,of Alameda,
State of California"", prepared by order of the Board of Tide
Land Commissioners and on file in the office of said Commis-
sioners in San Francisco, certified copies thereof having been
filed with the Surveyor General of the State of California, and
with the County Recorder of the City and County of San Francisco;
and running thence South 251' 341 20" East 60.92 feet; thence
North 56" 401 30" East 161.06 feet;,thence South 33-,,191 30"
East 650 feet more or less., (640.56 feet by calculation) to -a
point in the east line of Lot 14 in Section 30 as said lot and
section are shown on that certain map entitled, "Sale Map No.
10 of Salt Marsh and Tide Lands, situate in the County of Alameda,
State ofCalifornia'", prepared under the direction of the Board
of Tide Land Commissioners., by G. F. Allardt, Chief Engineer,
filed June 9. 1888 in Book 17 of maps, at page 30, in the office
of theCountyRecorder of Alameda County; thence North along the
east line of Lots 14 and. 3 in aforesaid Section 30, 564.27 feet,
more or less, to a point in a line drawn -parallel with the center
line of Maitland. Drive, formerly South Shore Drive, as said drive
is described in that certain grant from E. B. Stone to the City
of Alameda, dated December 91, 1924, and recorded Tdarch 2, 1925 in
Book 899 of Official Records of Alameda County, page 295, and dis-
tant 560 feet northeasterly therefrom., measured at right angles
thereto. Said point being the actual point of beginning for the
parcel herein described; continuing thence north along the east
line of said lot 39 967.61 feet, more or less, to the northeast
corner of said lot; thence Viest along the north line of Lots 3
and 4 in Section 30, 960 feet, more or less (971.31 feet by cal-
culation) to a point in a line drawn parallel with the center
line of said Maitland Drive and distant 280 feet northeasterly
therefrom, measured at right angles thereto; thence South 33*

91 1388 in Book 17 of flaps, at page 30 in the office of the County
Recorder of Alameda County; thence South along the east line of
Lot 3 and Lot 14 in aforesaid Section 30., 323.80 feet, more or
less, to a point in a line drawn parallel with the center line of
TvIaitland Drive (formerly South Shore Drive, as said drive is de-
scribed in that certain grant from E. B. Stone to the City of
Alameda, dated December 9. 1924, and recorded 1,41arch 2. 1925 in

distant 250.00 feet northeasterly therefrom, measured at right
angles 'thereto.; thence North 33- 19t 30" West (parallel with. the

Commencing at the southeast corner of Lot 28 in Section 19 in
Township 2 South, in Range 3 West of the Mount Diablo Base and
Meridian, as said lot and section are shown on that certain map
entitled, "Sale Yap No. 10 of Salt Tv'Tarsh and Tide Lands, situated.
in the County of Alameda, State of California", prepared under the
direction of the Board of Tide Land Co=,iissioners., by G. F. Allardt,
Chief Engineer, filed June 9, 1888 in Book 17 of 1,117aps, at page 30,
in the office of the County Recorder of Alameda County; and run-
ning thence North along the east line of said Lot 28, 475.74 feet,
more or less, to a point in a line drawn parallel with the center
line of Iviaitland Drive, formerly South Shore Drive, as said drive
is described in that certain grant from E. B. Store to the City of
Alameda., dated December 91, 1924, and recorded March 2.9 19251 in
Book 899 of Official Records of Alameda County, page 295, and dis-
tant 250 feet northeasterly therefrom, measured at right angles
thereto; said point being the actual point of beginning for the
Parcel herein described; thence continuing North along said lot
line 185.88 feet, more or less., to a point equal distant from the
north and south lines of said Lot 28; thence West 1-22.22 feet,
more or less,, to a point in aforesaid line parallel to Maitland

day of June, 1888, and therein recorded in Book of Maps No. 17,

and unpaid; and

WHEREAS, after the time said taxes became a lien on said real property,
to wit, on September 11, 1947, said real property was, by deed recorded in the
office of the County Recorder of Alameda County on September 11, 1947, under Re-
corder's Series AB77654, acqaired'. and ever since has been, and now is,, owned by
the City of Alameda, and has been and now is being used for public purposes, and
because of such public ownership is not subject -to sale for delinquent taxes;
NOW, THEREFORE., BE IT RESOLVED BY TIE COUNCIL OF THE CITY OFALAMEDA,
with the written consent of the City Attorney attached hereto, that all uncol-
lected taxes charged or levied for city purposes upon the aforesaid real property,
together with penalties and costs thereon, be, and the same are hereby, canceled,
and the Auditor and Tax Collector of the City of Alameda are hereby authorized
and directed to cancel the same on their respective books.
BE IT FURTHER RESOLVED, anything in this resolution to the contrary
notwithstanding, that this resolution and order shall not be construed as cagy
coling, or authorizing the can3elation of, any special assessment taxes levied
against said real property by the City of Alameda pursuant to the provisions of
the "Acquisition and Improvement Act of 1925."
I., Stanley D. Whitney, City Attorney for the City of Alameda., State
of California, do hereby consent to the cancelation of any and all uncollected
taxes and assessments or penalties and costs thereon, charged or levied for
city purposes upon the parcels of real property described in the within reso-
lut i on.
