RESOLUTION NO. 3864
ACCEPTING COMY-ANCE FROM STOEELY FOODS, INC., A
CORPORATION, OF EAS:EMr JTS IN CERTAIN REAL PROPERTY
AND CONSENITINCT TO TIE RECORDATION THEREOF
KIEREAS, a certain indenture dated the 12th day of October, 1948, made
by and between Stokely Foods, Inc., a corporation, as party of the first part,
and City of Alameda, a municipal corporation, as party of the second part, was,
on or about said date, executed and delivered by said party of the first part to
the City of Alameda; and

dIEE REAS $ by said indenture, the grantor therein named granted to the

City of Alat-rieda permanent easements and rights of way to, at any time, or from
time to time, construct, maintain, operate, replace, re -move and renew underground
storm sewers and/or drains in, through, under and along that certain piece, strip
or parcel of land situated in the City of Alameda, County of Alameda, State of
California, particularly described as follows, to -wit:
An easement ten (10) feet wide, described as follows:
BEGI1,1NING at Station No. 19 of the Segregation Line as said
Station and Line are delineated and so designated upon that
certain map entitled "Map of Alameda Marsh Land as partitioned
among the owners thereof in the suit numbered 8923 and entitled
Pacific Improvement Company, Plaintiff, vs. James A. SIaymire,
et al, Def endalts, Superior Court of Alameda County, California",
and filed in the office of the Recorder of said County of Alameda
on July 30, 1900, in Map Book 25, pages 74 to 78, inclusive;
running thence South 840 341 East 60.84 feet to a point; 81,1ence
South 720 251 East 16.78 feet to a point; thence South 79 46Y
East 542.75 feet to a point; theuce South 730 561 East 582.88
feet to a point thence South 70u 181 East 190.93 feet to a point;
thence North 19 421 East 5.00 feet to a point in the northerly
boundary of an existing North Side Sewer easement, said point
being the beginning of this easement; 'thence North 190 421 East
10.46 feet to the northerly property line of Stokely Foods, Inc.,
as said property line is designated in that certain Deed dated
March 2. 1948, executed by Alaska Packers Association, a corpora-
tion, to Stokely Foods, Inc., a corporation, and recorded Miarch
4, 19482 in Book 5430, at Page 95 of Official Records of Alameda
County; thence Easterly along the said property line on a curve
of radius 4.40 feet, a distance of 10.32 feet to a point; thence
South 190 421 West 13.13 feet to the northerly boundary line of
the said North Side Sewer easement; thence along the said ease-
ment boundary line North 700 18' West 10.00 feet to the point
of beginning; and
VVKEIUAS, the City of Alameda did, on the 19th day of October, 1948, accept
said conveyance, and acquired possession of the said easements in the real property
above described;
NOW THEREFORE, BE IT RESOLVED B� THE COUNCIL OF THE CITY OF ALAIvIEDA that
the aforementioned indenture be, and the same is hereby, accepted on behalf of the
City of Alameda, and said City Council, acting for and in behalf of said City,
hereby consents to the recordation of said indenture and orders this resolution
to be attached thereto, as required by Section 1158 of the Civil Code of the State
of California.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda in
regular meeting assembled on the 19th day of October, 1948, by the following vote,
to wit:
AYES: Councilmen Anderson, Jones, Osborn, Sweeney and President
Branscheid, (5).
NOES: None.
ABSENT: None.
