RESOLUTION NO. 3930
AUTHORIZING THE ACOUISITIM OF C!RTAIN HEAL PROPERTY
FOR PU3L!C STREET AND HIGHWAY PURPOSES (2CSTER)
WHEREAS, public interest and necessity require that the real property
hereinafter described be acquired by the City of Alameda for public street and
hQhway purposes; and

vaEREAS, Leitha Foster, a widow, is the owner of the real property
hereinafter described and is willing to sell the same to the City of Alameda for
the sum of $120.00;

as follows:
Section 1. That the City of Alameda purchase from Leitha Foster, a
widow, for the suL of $125.00, that certain real property situated in the City
of Alameda, County of Alameda, State of California, particularly described as
follows:
PO 110 of the parcel of land described in the deed by Robert C.
Boyington and lrene B. Buyington to Donald Percy Foster dated April 6,
1946, recorded April 12, 1946, in book 4850 of Official Records of
Alameda County, at paSe 363, described as follows:
BEGIMING at a point on the southern line of said parcel of land,
distant thereon westerly 93.26 feet from the western line of 5th
Street; and run ninZ thence along said southern line westerly 26.74
feet to the western line of said parcel; thence along the last named
line north 10 35' 45" east 11.57 feet; thence south 640 58' 39" east
on a line, a distance of 29.14 feet to the point of be ;inning,
uyun the following terms and conditions, to -wit:

�a) That jwod, merchantable title in fee simple in said real property
be conveyed to the City of Alameda, free and clear of all objections, liens, en-
cumbran3es, clouds and claims of title, but subject to second installment of
taxes and assessments for the fiscal year 1948-1949;
(b) That the title to said real property be evidenced by policy of
title insurance issued by the Alameda County -East Say Titln Insurance Company,
insuring title in the City of Alameda, as provided in the preceding subdivision
(a);
(c) That upon deposit with said title insurance company for delivery
to the City of Alameda of a good and sufficient deed of grant conveying said
real property to the City, of Alameda, and conditioned upon the issuance of a
title insurance policy, as aforesaid, to be approved by the City Attorney, a
warrant of the City of Alameda be drawn for $i40.00, payable to the order of
said Alaaeda County -East Bay Title Insurance Company, and delivered to said
title insurance company as escrow holder for the purpose of effecting the con-
summation of said purchase and to pay cost of title insurance policy.
Section 2. The sum of $140.00 is hereby appropriated from Gas Tax 11'"2
Fund of the City of Alameda to pay the purchase price of said real property and
cost of title insurance policy.

I, the undersigned, hereby certify that the fore goinS Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 18th day of January, 1949, by the following
vote, to wit:
AYES: Councilmen Anderson, Jones, Osborn, Sweeney and President
Branscheid, (5).
ROES: None.
ABSENT: None.
