Resolution 039324 9 4 RESOLUTIGh YO. 3932 AUTHORIZING THE AQUISITION OF CERTAIV REnL PROPERTY FOR PU3LIC STREET Al�-D _HIGH'v',1AY P'1LTR,1'0SES (MARCHETTI) WHEREAS, public interest and necessity require that the real property hereinafter described be acquired by the City of Alameda for public street and highviay purposes; and. _JLEREAS, Domenico Marchetti and Raymond A. Antonali and Dorothy Marie Antonali, his wife, are the owners of the real property hereinafter described and are willing to sell the same to the City of Alameda for the sum of $150-00; li'u'v''I ThEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALALEDA as follows: Section 1. That the City of Alameda purchase from Domenico Marchetti and Rayand A. unto tali and Dorothy Marie Antonali, his wife, for the sum of $150.00, that certain real ,property situated in the City of Alameda, County of Alameda, State of California, particularly described as follows: PORTIOY of the parcel of land thirdly described in the Decree of Distribution in the estate of Chiarina Torre, deceased, to Louis Torre dated January 4, 1937, recorded March 1, 1937, in book 3441 of Official Records of Alameda County at page 292, described as follows: BEGINNING at a point on the western line of said parcel of land, distant thereon south 10 25' west 138.11 feet fron the southern line of Pacific Avenue; and running thence along said western line of said parcel of land south 10 251 west 10.58 feet to the southern line thereof; thence along the last named line south 880 24' 15" east 24.38 feet; and thence in a direct line north 640 58' 39" west 26.60 feet to the point of beginning, upon the following terms and conditions, to -wit: (a) That good, merchantatle title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens, en- cumbrances, clouds and claims of title, but subject to second installment of taxes and assessments for the fiscal yea.. 1948-1949; (b) That the title to said real property be evidenced by policy of title insurance issued by the Alameda County -East Bay Title Insurance Company, insuring title in the City of Alameda, as provided in the preceding subidivion (a); (c) That upon deposit with said title insurance company for delivery to the City of Alameda of a good and safficient deed of grant conveying said real property to the City of Alameda, and conditioned upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City of Alameda be drawn for 1165.00, payable to the order of said Alameda County -East 3ay Title Insurance Company, and delivered to said title insurance company as escrow holder for the purpose of effecting the con- summation of said purchase and to pay cost of title insurance policy. Section 2. The sum of 8165.00 is hereby appropriated from Gas Tax#2 Fund of the City of Alameda to pay the purchase price of said real property and cost of title insurance policy. * * * * A * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was daly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day of January, 1949, by the following vote, to wit: AYES: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5).
