APPROVING A LEASE AND AUTHORIZING THE CITY MANAGER OR
DESIGNEE TO EXECUTE DOCUMENTS NECESSARY TO
IMPLEMENT THE TERMS OF A ONE-YEAR LEASE WITH FOUR
ONE-YEAR EXTENSION OPTIONS, EACH SUBJECT TO
REASONABLE DISCRETIONARY APPROVAL OF THE CITY
MANAGER, WITH SHELTER IN PEACE, INC, A CALIFORNIA
CORPORATION, FOR 2815 SAN DIEGO ROAD LOCATED AT
ALAMEDA POINT TO OPERATE TRANSITIONAL HOUSING FOR
REFUGEES
WHEREAS, Shelter in Peace, Inc. is a non-profit organization providing transitional
housing and other services to refugee households being resettled in Alameda; and
WHEREAS, 2815 San Diego Road is a single-family home at Alameda Point; and
WHEREAS, the Premises have been vacant since June 2016 and were deemed
uninhabitable due to a cracked foundation; and
WHEREAS, on March 3, 2019, City Council approved the use of CDBG Substantial
Rehabilitation funds to replace the cracked foundation and make the home available for
refugee families being resettled in Alameda; and
WHEREAS, the foundation is currently being repaired and the residence will be
habitable in summer 2020; and
WHEREAS, the Premises will be used to provide transitional housing to refugees
and families immigrating to the Unites States who qualify as very low-and low-income
households; and
WHEREAS, the annual rent for the term of the Lease is $1.00 and the security
deposit is $1 ,000; and
WHEREAS, the proposed lease is not a property disposition and therefore not
subject to the State Surplus Lands Act.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Alameda
that by four affirmative votes that:
Section 1. The City Manager of the City of Alameda or his designee is hereby
authorized to negotiate, execute, for and on behalf of the City of Alameda, a lease with
Shelter in Peace, Inc., a California corporation, for 2815 San Diego Road at Alameda
Point for one year with four one-year extension options, each subject to reasonable
discretionary approval of the City Manager, subject to such technical or clarifying
revisions as are reasonably determined necessary by the City Manager and approved by
the City Attorney, and the City Clerk is hereby authorized and directed to attest to the
same.
Section 2. If any section, subsection, sentence, clause or phrase of this ordinance
if, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this ordinance. The City Council
of the City of Alameda hereby declares that it would have passed this ordinance, and
each section, subsections, clause, or phrase hereof, irrespective of the fact that any one
or more sections, subsections, sentences, clauses and phrases are declared to be invalid
and unconstitutional.
Section 3. This ordinance shall be in full force and effect from and after the
expiration of thirty (30) days from the date of its final passage.

regular meeting assembled on this 18th day of February, 2020, by the following
