RATIFYING THE CITY MANAGER'S DECLARATIONS OF THE
EXISTENCE OF A LOCAL EMERGENCY IN RESPONSE TO
MULTIPLE WAVES OF SEVERE WINTER STORMS
WHEREAS, the Alameda Municipal Code, Chapter 2-24, defines a local
emergency as "the actual or threatened existence of conditions of disaster or of extreme
peril to safety of persons and property within a jurisdiction;" and
WHEREAS, Government Code Section 8630 empowers the City Council to
proclaim a local emergency by ordinance when the City of Alameda is affected by a public
calamity and/or serious threat to the public health, safety and welfare; and
WHEREAS, on January 4, 2023, the State of California proclaimed a State of
Emergency to exist throughout California that will assist local governments and protect
public health and the environment; and
WHEREAS, on January 9, 2023, President Biden declared that an emergency
exists in the State of California, and ordered Federal assistance to supplement State,
tribal, and local response efforts due to emergency conditions resulting from successive
and severe winter storms, flooding, and mudslides; and
WHEREAS, on January 4, 2023, the City Manager and Director of Emergency
Services made findings that due to severe winter storms that started December 27, 2022,
conditions of extreme peril to the safety of persons and property have arisen in the City
of Alameda and, based thereon, declared a local emergency in the City of Alameda that
expires on January 11, 2023; and
WHEREAS, on January 10, 2023, the City Manager and Director of Emergency
Services made findings that due to multiple rounds of severe winter storms and convective
weather bringing gusty winds, brief periods of heavy rains, and thunderstorms with possible
lightning strikes, conditions of extreme peril to the safety of persons and property have
arisen in the City of Alameda and, based thereon, declared a continued local emergency
in the City of Alameda that expires on January 17, 2023; and
WHEREAS, the January 4, 2023 declaration of emergency terminated by
operation of law on the 7th day and was subsumed by the January 10, 2023 declaration
of local emergency, and
WHEREAS, the City Manager and Director of Emergency Services terminated the
January 10, 2023 declaration of local emergency on January 17, 2023; and
WHEREAS, adoption of this resolution is exempt from review under the California
Environmental Quality Act Guidelines, Section 15378 (not a project) and Section
15061(b)(3) (no significant environmental impact).
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Alameda does resolve, declare, determine, and order the following:
Section 1. The City Council finds and determines that the foregoing recitals to
be true and correct and hereby incorporates them in this resolution.
Section 2. The City Council ratifies and declares that the City Manager's January
4, 2023 and January 10, 2023 declarations of a local emergency due to severe winter
storms are appropriate.
Section 3. The City Council also ratifies and declares the termination of the
January 4, 2023 and January 10, 2023 declarations of local emergency as of January
17th, 2023.
Section 4. This resolution is effective immediately upon its passage and
adoption.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in a regular meeting assembled
on the 17th day of January 2023 by the following vote to wit:
AYES: Councilmembers Daysog, Herrera Spencer, Jensen, Vella and
Mayor Ezzy Ashcraft — 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
