Ordinance 3360 CITY OF ALAMEDA ORDINANCE NO. 3360 AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE WITH THE ALAMEDA TRANSPORTATION MANAGEMENT ASSOCIATION FOR A SINGLE OFFICE SPACE IN CITY HALL WEST AT ALAMEDA POINT FOR A FIVE-YEAR LEASE TERM WITH BASE RENT OF ONE DOLLAR PER YEAR WHEREAS, by Resolution No. 14891 the City Council of the City of Alameda certified the Final Alameda Point Environmental Impact Report (Alameda Point EIR) (State Clearinghouse No. 201312043) under the California Environmental Quality Act (CEQA), California Public Resources Code Section 21000 et seq. and adopted written findings and a Mitigation Monitoring and Reporting Program (MMRP) on February 4, 2014, for the Alameda Point Project; and WHEREAS, the City Council approved the Transportation Demand Management Plan for Alameda Point on May 20,2014 (Alameda Point TDM Plan), a crucial component of the City's approach to addressing the City's transportation issues associated with the reuse and redevelopment of Alameda Point and to mitigate the transportation impacts identified in the FEIR; and WHEREAS, the Alameda Transportation Management Association (ATMA) was established in 2017 as an independent California non-profit public benefit corporation that oversees the ongoing implementation of the Alameda Point TDM Plan, the Northern Waterfront transportation mitigation area requirements, and other TDM Plans; and WHEREAS, on September 5, 2023, City Council approved the renewal of two pass-through agreements with the ATMA for the provision of transportation services consistent with the Alameda Point TDM Plan for all residents and employees at Alameda Point; and WHEREAS, the ATMA needs a permanent office space in order to effectively provide the contracted-for services; and WHEREAS, City Hall West, Suite 240 (the "Premises") consists of approximately 250square feet of rentable space that is currently unoccupied. NOW, THEREFORE, the City Council of the City of Alameda does hereby ordain as follows: Section 1. The City Council, based upon its own independent review, consideration, and exercise of its independent judgment, hereby finds and determines, on the basis of substantial evidence in the entire record before the City, that none of the circumstances necessitating further CEQA review are present. Prior to approving the lease, the City can rely on the Alameda Point EIR. Section 2. The City Manager of the City of Alameda is hereby authorized to execute on behalf of the City of Alameda, a lease agreement with the Alameda Transportation Management Association, a California nonprofit corporation, for a single office space in City Hall West, at 950 West Mall Square, for a five-year lease term, subject to such technical or clarifying revisions as are reasonably determined necessary by the City Manager and approved by the City Attorney, and the City Clerk is hereby authorized and directed to attest to the same. Section 3. If any section, subsection, sentence, clause or phrase of this ordinance if, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council of the City of Alameda hereby declares that it would have passed this ordinance, and each section, subsections, clause, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases are declared to be invalid and unconstitutional. Section 4. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date 9f its final passage.
