Dear Vice Mayor Gilmore:
In recognition of National Fair Housing Month, the Community Development
Department of the City of Alameda has provided funding to Sentinel Fair Housing for the
production of the enclosed fair housing education booklet. The material is presented to
the property owner engaged in the rental housing business in the City of Alameda, and
covers the basic federal and state laws and rules applicable to the lawful conduct of the
rental housing business. The booklet is not meant to provide legal advice on any of the
topics covered and urges all owners and managers to seek assistance from their legal
counsel as needed.
The enclosed sample copy is the English version of the booklet. It is being translated to
Spanish and to Chinese for the use of non English speaking property owners, and will be
mailed this month to all property owners engaged with the Alameda Section 8 Program,
all owners of properties in Alameda comprised of more than 40 units, and to all property
owners in Sentinel's data base. In addition, it will be available for any property owner
who requests it, up to a maximum of 500 copies, free of charge.
Thank you for your support of fair housing in the City of Alameda and for your
recognition of the 38th Anniversary of the passage of the federal Fair Housing Act by the
issuance of the Proclamation designating April as Fair Housing Month in the City of
Alameda.

Mayor and Councilmembers,
Thank you for your willingness to address the recently voiced concerns
of Alameda citizens and review the Master Fee Resolution's current
uncapped appeal fees at your upcoming meeting. After reading the staff
report for item 5B and the three options recommended by planning staff,
I am afraid the proposed solutions are still not the best possible.
While all three options propose a cap, two of them still allow a
non - applicant to be charged up to $1,000 for appealing a Planning Board
decision. This is an amount most ordinary citizens can't reasonably
afford. The possibility of such a high charge would deter the filing of
appeals and would be in violation of the First Amendment which sates
that "Congress shall make no law ... prohibiting... the right of the
people ... to petition the Government for a redress of grievances."
I understand the need for the Planning and Building Department to
recover some of the time and material costs associated with various
tasks it is asked to perform. However, the appeals process is not the
way to do that. An appeal by definition has to do with some concern
about harm or violation of due process, and its purpose is to address
the concern and /or correct the mistake. By preventing an issue to be
heard by a body of higher authority, you will in effect be preventing a
system of checks and balances to occur. The ability of citizens to
oversee and question government is a basic asset of democracy —an appeal
recourse must be available to everybody, regardless of ability to pay.
A return to a low flat fee, comparable to that of other cities our
size, is the only way to ensure such recourse and it is the only right
thing to do.
Since we support our City government with our taxes, the least we
should be able to receive back is an open, democratic process all the
way to the top. Excluding appeals from the cost recovery policy of the
Planning and Building Department will not hurt the department's
solvency, but will go a long way towards building trust in our elected
and appointed officials. As an added benefit, the fact that appeal
costs would have to be absorbed would encourage Planning staff to work
diligently with applicants, neighbors and the community at every level
to make sure that each project is as acceptable to everybody as it can
be, thus reducing the chances of an expensive and often contentious
appeal process from taking place at all.
In the case of very large projects with unpredictable impacts, a review
of which could result in significant expenditure of time and labor, an
option you may want to consider is a requirement that a developer

assume some part of the appeal costs arising from his /her project.
Indemnity clauses are standard in Developers' agreements and there's no
reason why the cost of an appeal cannot be part of the clause. Since it
is in our City's interest that all issues arising from a project are
properly addressed, protecting citizens from harm and the City's
interests this way is only natural.
At the end, I hope that before you approve another resolution you will
examine carefully all the fine - grained detail of the appeals fee issue
and its down- the -road implications. If you do that, I trust you will
reach the conclusion that a low flat fee that keeps our government open
and accessible is the only right solution.

I write in regards to the appeal fee schedule recently implemented in Alameda and which is
coming up for discussion at the next city council meeting. I urge you to consider implementing a
reasonable flat fee for all appeals to the city council to ensure that ordinary citizens have access
to petition the city council and to allow for open government.
I contacted several city clerks in neighboring cities and found that all of the cities charge a flat

It is also interesting to note that most of the cities' websites contain easily accessible fee
schedule information, which is not the case in Alameda. Hopefully, you will encourage our city
staff to make that information easily available too.
Please rescind any and all time and material fees charged to anyone who has filed an appeal
since the time and materials fees were implemented. Please return to a flat fee for filing appeals
that is comparable to surrounding cities.

As a recent recipient of a shockingly large invoice for hourly T &M fees
based on appeal of a Planning Board decision re: the Megaplex which was
clearly against popular opinion and in violation of the general plan, I
would like to voice and record my opinion on City staff's
recommendations for revised fee schedule structures.
Since it is obvious that City Council and City appointed boards do not
always act or decide in the best interest of the majority of the
citizens or in accordance with City statutes, it is my firm belief that
any decision of City Council or any City appointed board be appealable
by any citizen at any time regardless of economic position. In order to
allow that to happen, the structure for appeal fees should be made as
low as possible for applicant or non - applicant citizen appellants
without commercial interests in the project. $100 or there abouts is a
reasonable fee for paperwork to file the appeal and would help
discourage frivolous appeals. One possible exception could be to bill
applicant developers who stand to realize large financial gains at the
current rate of $100 (or more) per hour T &M with no cap or ceiling in
order to recoup City costs to defend said developer against citizen
appeals. That would be the only fair and valid assessment of T &M fees.
Appeal fees should NOT be seen as a cost recovery tool with ordinary
citizens bearing the financial burden. To do so could only be seen as
punitive and an attempt to silence critics of any potential project.
Therefore, I propose that none of the options suggested by staff be
adopted and that instead Council consider a fourth returning to the
previous $122 flat fee to be paid by citizens filing or defending an
appeal with the one exception being to charge T &M as incurred (without
option of waiving) for any commercial or institutional applicant to
either file or defend an appeal. This would be the only fair and
equitable way to administer fees.
Finally, I strongly suggest that any lowering of overall fees as a
result of revision of Master Fee Schedule be retroactive and that CMFA
be refunded the remaining difference between their original payment and
the newly revised fee.

In November of last year Valerie Ruma and I received an invoice for $5,500 in addition to $1,200 originally
paid in connection with filing two appeals. After an exchange of several letters with the department and an
attempt to collect the money, the issue became public and the city withdrew the charges -- definitely the
right thing to do. I was surprised today when the Alameda Journal announced that the City had decided to
"forgive" the charges - -a very stunning interpretation of what happened. People are forgiven if they have
made a mistake - -we didn't. We filed an appeal because we were, and continue to be seriously concerned
about the impacts of the theater /garage project, and we filed the appeal on behalf of thousands of
Alameda residents who felt the same way.
I hope that the forgiveness of debts, sins, or whatever is not the version the City wants to promote in this
case, and that maybe the word was not a quote but a bad choice on behalf of the reporter. I know that
when I spoke to you two weeks ago, I did not plead for forgiveness, I asked for justice. If anyone acted in
a rash and unjustified manner it was the Planning Department, not us. If anyone did not consider every
implication when they approved a resolution allowing citizens to be charged an open ended fee for
appeals, it was the City Council, not the citizens.
This said, I personally am willing to forgive past mistakes, especially if I see the will tonight to correct the
current policy which is clearly undemocratic and punitive to appellants with sincere and honest intentions.
Unfortunately, the three options outlined in the staff report still fall short of the mark of a fair and open
appeal process. Two of the options allow for a charge of up to a thousand dollars - -a lot of money for the
average citizen —and very much out of line with fees in other cities. The third option, which charges a
non - applicant a flat fee and a capped at $1,000 T &M fee to the applicant sounds more reasonable but is
has the potential to penalize a home owner whose application for a small variance for example might be
challenged by a grumpy neighbor. Neither one of these options seems fair when you consider all
circumstances.
It seems that the solution is to go back to a flat fee in the range of a hundred dollars that everybody can
afford. It will not cover all the time, salary, pensions, overhead and other expenses of the department, and
that's fine — dealing with grievances is a natural cost of government. If you understand that you will see
that the review of an appeal must be treated differently from the rest of the tasks of the department and
that the associated cost should be absorbed, not recouped. If Planning staff believes that a large and
complicated project has a good chance of being appealed thus burdening the department, then build the
contingency into the developer's agreement from the beginning. As far as the appeals process, keep it
simple, uncluttered and affordable - -it's the only fair thing to do.
