(Public Works) Adjournment CITY OF ALAMEDA MEMORANDUM Date: May 3, 2006 To: Honorable Mayor and Councilmembers From: Debra Kurita City Manager Re: Recommendation to Reject the Bids, Adopt Amended Plans and Specifications in Accordance with Amended Caltrans Requirements and Authorize a Second Call for Bids on an Expedited Basis for Fernside Boulevard Pedestrian Access Improvements Near Lincoln Middle School (Safe Routes to School), No. P.W. 11 -02 -15 BACKGROUND On March 21, 2005, the City Council adopted plans and specifications and authorized call for bids for Fernside Boulevard Pedestrian Access Improvements Near Lincoln Middle School (SR2S), No. P.W. 11- 02 -15. The project is funded, in part, with a $331,663 Safe Route to School grant that uses federal transportation funds and is administered by Caltrans. Bids were opened on April 19, 2006. Four contractors submitted bids. The list of bidders and bid results is as follows: Bidder Business Location Bid Amount Vanguard Construction Oakland, CA $ 573,111 Ghilotti Brothers, Inc. Napa, CA $ 594,800 McGuire and Hester Oakland, CA $ 599,520 DISCUSSION /ANALYSIS The City of Alameda had an approved Disadvantaged Business Enterprise (DBE) program for federal fiscal 2006, with a goal of 11 %. On May 1, 2006, Caltrans adopted new DBE program requirements, which became effective immediately. This action affects all projects with federal transportation funding administrated by Caltrans. Although Caltrans had previously reviewed the project plans and specifications and authorized the City to call for bids, they have now indicated that since award of the project will occur after May 1, the bid specifications and contract documents must be in compliance with the new DBE program. Since the Safe Route to School Grant is a significant funding source for the project, the project can not move forward without the grant monies. Therefore, the project specifications must be revised to reflect the new DBE requirements, or the project will not qualify for the grant monies. Staff recommends therefore, that all bids received on April 19, 2006, be rejected. Report #1 5 -3 -06 Honorable Mayor and Councilmembers Page 2 May 3, 2006 Since the project is located in the vicinity of Lincoln Middle School, the original bid specifications planned for the major construction to occur during the summer months. To maintain this construction schedule objective, an expedited public bid process is requested. The amended project specifications are on file in the City Clerk's Office. BUDGET CONSIDERATION /FINANCIAL ANALYSIS General Fund monies are not programmed in this project. This work is funded under CIP 02 -98, receiving funds from a Safe Route to School grant and Measure B. Transportation Development Act funds have also been identified by the Metropolitan Transportation Commission for the project. Council will be required to adopt a Resolution to request Metropolitan Transportation Committee allocate these funds. RECOMMENDATION The City Manager recommends that the City Council, by motion, reject the bids, adopt amended plans and specifications in accordance with amended Caltrans requirements and authorize a second call for bids on an expedited basis for Fernside Boulevard Pedestrian Access Improvements Near Lincoln Middle School (Safe Routes to School), No. P.W. 11- 02 -15, No. P.W. 11 -02 -15 Respec, ubmitt Matthew T.
