(2) The contingency for the theater under the 7/26/2006 budget is approximately 13% instead of 15% with the increase in construction budget; and the garage was reduced to 5% still exceeding industry standards. (3) This contingency was incorrectly stated as a $200,000 in previous budgets. The DDA states it is a $250,000 contingency. (4) As part of the value- engineering process for the the theater, these funds are likely to be required for additional soft costs. I want to commend the Mayor and the City Council on re- appointing Betsy for another 4 -year term. I want the Council to know that Betsy has been an outstanding Commissioner. She started the very successful Senior Golf Club, which golfs every Tuesday and Thursday. Betsy works well with Staff and her presence at the golf course is evident to the golfing public .As the present Chair of the Golf Commission, she makes sure the stays on top of issues. My sincere congratulations to Betsy and good luck for another 4 years. A perfect way to celebrate this Proclamation will be to institute a ban on leaf blowers. The following City of Alameda Ordinances, if enforced will effectively eliminate these abominations from our ears, eyes and lungs. Chapter 4 Offenses and Public Safety Article 4 -10 Noise Control. Measured noise level may not exceed fifty-five dBa for more than 30 minutes out of any one hour time period. Typical gas powered leaf blowers exceed 75 dBa. Chapter 21 Solid Waste and Recycling. Article 21 -3.1 Prohibited Acts Deposit of Waste Upon street or private premises, or in Sewer, Etc No person shall deposit upon any public street or upon any private premises any solid waste or other material of any kind. Leaf blowers routinely blow into the street or into neighboring properties. Chapter 24 Public Health Article 24 -1.1 Conditions Declared a Nuisance c. The discharge of sewerage, garbage or other organic filth into or upon any place in such a manner that transmission of infective material to human beings may result there from. e. The maintenance of any real or personal property, whether improved or unimproved, in such a manner that dust, sand or any other foreign material shall be caused to be blown into the atmosphere or spread or drift upon property or premises of any other person in such a manner as to be a detriment to the public health and safety of others. The use of leaf blowers causes small particulate matter to be blown around in the air and breathed into the lungs of people and animals. Leaf blowers kick up ground dust which includes molds and pollens, animal feces, pesticides, lead, arsenic, mercury and viral disease. Article 24 -9.3 Release of Hazardous Materials Declared a nuisance a. The City Council of Alameda hereby declares that any hazardous material released in the City is a public nuisance subject to summary abatement and is also a violation of this Code.
