AMENDING THE FISCAL YEAR 2024-25 GENERAL FUND AND GOLF
FUND OPERATING BUDGETS APPROPRIATING $800,000 FROM
GENERAL FUND RESIDUAL FUND BALANCE TO GOLF FUND
(FUND 250) FOR EXEPENSES FOR ONGOING LITIGATION
AGAINST GREENWAY GOLF ASSOCIATES, INC.
WHEREAS, on June 18, 2024, the City Council adopted by Resolution No.
16173 a budget representing the financial plan for conducting the affairs of the City of
Alameda for the Fiscal Year beginning July 1, 2025 and ending June 30, 2025; and
WHEREAS, the adopted Golf Fund (Fund 250) Operating Budget has a total
expenditure appropriation of $853,450; and
WHEREAS, the City of Alameda (City) is engaged in ongoing litigation against
Greenway Golf Associates, Inc.; and
WHEREAS, in September 2024 the trial court continued the trail date to April
2025, which will increase the cost of litigation; and
WHEREAS, to ensure sufficient funds are available in the Golf Fund (Fund 250)
to fund this increase to anticipated litigation costs in Fiscal Year 2024-25 there is a need
to transfer $800,000 from General Fund Residual fund balance to the Golf Fund (Fund
250); and
WHEREAS, the City Council has reviewed the report and recommendations of
the City Attorney regarding the budget amendment and has determined that the
proposed amendment is both fair and appropriate.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda
that Fiscal Year 2024-25 Operating Budget amendment appropriating $800,000 from
General Fund (Fund 100) Residual fund balance to the Golf Fund (Fund 250) for the
Fiscal Year 2024-25 Budget is approved.
I, the undersigned, herby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in a special
meeting assembled on the 17th day of December 2024, by the following vote to wit:
AYES: Councilmembers Daysog, Herrera Spencer, Jensen, Vella and
Mayor Ezzy Ashcraft— 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
