Resolution 15723A CITY OF ALAMEDA RESOLUTION NO. 15723A AUTHORIZING THE CITY MANAGER TO ENTER INTO USE AGREEMENTS WITH THE ALAMEDA SOCCER CLUB FOR THE ALAMEDA POINT FIELD AND THE HORNET FIELD AT ENTERPRISE PARK Whereas, since 2012, through various agreements, the City of Alameda (City) has partnered with the Alameda Soccer Club (ASC) to operate and maintain the four soccer fields at Alameda Point Field (AP Field) and the Hornet Field at Enterprise Park, whereby ASC maintains and improves the fields at no cost to the City and provides soccer leagues, clinics and camps for hundreds of youth each year; and Whereas, ASC has requested longer agreement terms to provide opportunities for grant and donor funding to invest in significant capital improvements, such as in ground irrigation, replacing fields with synthetic turf and planting landscaping, and to bolster fundraising efforts; and Whereas, in 2000, the State Legislature enacted and the Governor signed into law SB 2049, the Naval Air Station Public Trust Exchange Act, that facilitates the productive reuse of the lands comprising the former Naval Air Station Alameda in a manner that will further the purposes of the public tidelands trust; and Whereas, the Hornet Field is within a tidelands trust area and therefore is subject to SB 2049; and Whereas, uses of such trust lands under SB 2049 may be permitted for uses other than those consistent with the public trust if the City makes certain findings; and Whereas, the City Council, as to the Hornet Field, finds as follows: (a) there is no immediate trust related need for the Hornet Field property; (b) the proposed use of the property will not exceed five years and the City may terminate the use in favor of trust uses at any time; (c) the proposed use prohibits the construction of new structures or improvements that, as a practical matter, prevent or inhibit the property from being converted to permissible trust uses if it becomes necessary for the property to be so converted; and (d) the proposed use will not interfere with commerce, navigation, fisheries, or any other existing trust uses or purposes. Whereas, although the AP Field is not subject to SB 2049 and the proposed AP Field Use Agreement is a 10-year term with a 10-year option, the City nevertheless must retain the right to terminate the Use Agreement at its discretion; and Whereas, the Hornet Field is subject to SB 2049 and the proposed Hornet Field Use Agreement is limited to a five year term and is also subject to termination at the discretion of the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY ALAMEDA RESOLVES AS FOLLOWS: Section 1. The Recitals set forth in this Resolution are true and correct and adopted herein by reference as findings of the City Council. Section 2. The City Manager is authorized to enter into the Use Agreements with the Alameda Soccer Club for the Alameda Point Filed and the Hornet Field at Enterprise Park. Section 3.
