Resolution 16335 CITY OF ALAMEDA RESOLUTION NO. 16335 AMENDING MASTER FEE RESOLUTION NO. 12191 TO ADD THE SIDEWALK VENDOR PERMIT FEE TO THE FEE SCHEDULE FOR THE PUBLIC WORKS DEPARTMENT WHEREAS, the Alameda Municipal Code and the California Government Code provide that the City Council shall set fees reasonable to recover the cost of providing various services by resolution; and WHEREAS, the City Council, at the August 27, 1991 Special City Council meeting, directed City staff to amend the Alameda Municipal Code to reflect that City fees shall be set by City Council Resolution; and WHEREAS, the City periodically amends Resolution No. 12191 and updates its Master Fee Schedule to account for various cost increases relating to municipal programs, services and activities; and WHEREAS, the City is creating a framework and permit process to regulate and enforce non-motorized sidewalk vending in the public right of way and other public property of the City in compliance with California State Law, SB 946, enacted in 2019 and known as the Safe Sidewalk Vending Act; and WHEREAS, the sidewalk vending permit will be reviewed by the Public Works Department, and it is anticipated that the typical review will take one hour; and, WHEREAS, the Master Fee Schedule establishes the permit review fee for the Public Works Department at a rate of$262 per hour for the fiscal year 2025-2026; and, WHEREAS, the City desires to establish a flat-rate fee at a lesser amount to ensure accessibility to the sidewalk vending permit program, and that by establishing such lesser fee, the amount thereof will not exceed the reasonable cost to the City to review sidewalk vending permits. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the foregoing recitals are true and correct and are hereby incorporated herein as findings and determinations of the City Council; and BE IT FURTHER RESOLVED, that the Master Fee Schedule as set forth in Resolution No. 12191, as amended and shown as Exhibit -A, is hereby amended to add the Sidewalk Vendor Permit Application Fee to the fee schedule for the Public Works Department, and the amount of said fee shall be $50 per application.
