ADJOURNED REGULAR MEETING OF THE COUNCIL OF THE
CITY OF AT,IIIEDA, TUESDAY, FEBRUARY 26, 1918.
The meeting convened at 8:10 p. m. with President Majors presiding.
The roll was called and Councilmen Latham, Noy, Otis, Probst and President Majors
( (5) were noted present . Absent:None .
The following communications were received:
1. From the Postum Cereal Company requesting a gratuitous license to solicit
orders for retail grocers and to sell grape nuts, Instant Postum and Post Toasties .
The -application did not bear the endorsement of the Chief of Police . Communications
from Tillman & Bendel and the Wm. Ckuff Company were read endorsing the request.
Mr. N. W. Smith, on behalf of the Company, presented a petition signed by the mer-
chants of Alameda asking that the privilege be granted to the Company,and also spoke
on the subject explaining it in detail. Mr. Latham moved that the gratuitous license
be granted, seconded by Mr. Probst and on roll call catt i ed unanimously.
2. ✓ Mr . Otis introduced the following Resolution and moved its adoption:
"Resolution No. 115.
Ordering the Closing of an Alley Between Buena •
Vista Avenue and Eagle Avenue.
Mr . Probst seconded the motion to adopt the Resolution and on roll call it was adopt-
ed and passed unanimously.
3. ✓ 1E. Otis introduced the following Resolution and moved its adoption:
"Resolution No. 116.
Amending That Certain Permit to Dredge , Granted to
The Oakland Water Front Company on May 1, 1917 , by
Resolution No. 41.n
Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted
and passed unanimously. -
4. / The application of the Oakland Water Front Company for an exclusive permit to
dump dredged materials on the tidelands south of the Alameda Mole and west of the
City of Alameda came up for consideration. Messrs. George L. Sessions, John Beaumont
and Earl H. Pier presented the case for the Oakland Water Front Company and Harrison
S. Robinson spoke on behalf of the Bethlehem Steel Corporation. After considerable
discussion, the following facts were tentatively agreed upon, with the understanding that
the Company would put them in writing and submit them to the Council:
a, That the Company would be given an exclusive permit to fill to seventy-five per
cent of the capacity of the enclosed basin to be determined when the levee now under
construction is completed. Said permit to run for a period of four years;
b . The remaining twenty-five per cent to be under the absolute constrol of the City
of Alameda to grant such privilege as it may desire ;
c. The Oakland Water Front Company to maintain the levee during all the period of
operation;
d. The arbitration of all diferences except physical facts and conditions by the
appointment of a representative of the Oakland Water Front Company as one arbitrator,
the City Manager of Alameda thesecond arbitrator and in the event that they cannot
agree, they two appoint a third;

f.Failure on the part of the Oakland Water Front Company to properly maintain
its work for the period of ninety days after notification of the same by the City
Manager, to work as a forfeiture of their rights.
5. ✓ A Bill entitled

was introduced and laid over under a provision of the Charter.
6. / A Bill entitled

For Ordinance No. New Series.
Amending Chapter IX, Section 554 and 555 of
Ordinance No. 1, New Series, imown as The
Municipal Code of the City of Alameda,
came up for passage. Mr. Otis moved that the Ordinance be adopted, seconded by
Mr. Latham and on roll call it was adopted and passed unanimously.
7. `� City Manager Hewes brought up the matter of allowing the San Francisco
Oakland Terminal Railways to skp—stop at unimportant points and showed that by
the elimination of certain stops a saving of thirty—five per cent could be
effected. The matter was laid over until the next meeting of the Council.
There being no further business to transact the Council adjourned to meet
in regular session Tuesday evening, March 5th, 1918, at 8 o' clock.
