1918-07-16 Regular CC Minutes k- REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALL DA, TUESDAY EVENING, JULY 16TH, 1918 . The meeting convened at 8:04 p. m. with Council-president Majors presiding. The roll was called and Councilmen Latham, Noy, Probst and President Majors, (4) were noted present. Absent:Councilman Otis, (1) . The minutes of the previous meeting were approved as read. Oral protests against the payment of the assessment for the opening and extending of Lincoln Avenue were received from F. A. Frissus, Mrs, A. B. McCardie, Margaret R. Parsons and Adelaide Bruzzone. No action thereon was taken, legal time of protest having expired. \ 1. Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 143. Directing the Treasurer to Transfer All Surplus Moneys to the General Fund." Mr. Noy seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 2. An Affidavit showing due publication of Notice to Publishers of Newspapers inviting bids for the city's advertising was Presented and ordered filed. In response to said notice the Clerk stated he was in receipt of one bid. Mr . Probst moved that the bid be opened and read, seconded by Mr. Latham and carried. Thereupon the Clerk opened and read the bid as follows:- From the Alameda Review offering to do the advertising at the following rates: For the first, or one insertion of any advertise- ment for a square of 234 ems nonpareil measurement 49 cents . For each subsequent insertion of any advertisement of 234 ems nonpareil measurement . . . . . . . . . . . 0 . . . , . . . . 47 cents The bid was accompanied by a bond in the sum of 500,00. City Attorney St. Sure stated that the bid could not be accepted for the reason that the paper is not printed in the City of Alameda as is required by law. Mr. C. S. Kind, the publisher, stated that his bid could be accepted for he felt that it was legal. Mr . Probst moved that inasmuch as the City Attorney ruled the bid illegal, it be rejected, seconded by Mr. Noy and carried. The matter was re- ferred further to the City Manager. The following communications were received: 3. From the State Compensation Insurance Fund, soliciting the renewal of the insurance policy covering the employees of the City of Alameda . Mr. Probst moved that the policy be renewed, seconded by Mr. Latham and on roll call carried unanimously. 4. From the California Traffic Officers' Association, asking for an appropria- tion to further the work of the organization. Inasmuch as the City cannot make such appropriations, the City Clerk was instructed to so notify the organization. v 5. From the Board of Education requesting permission to sell at auction the buildings on the property renently acquired for the use of the Longfellow School. Mr. Latham moved that the request be granted, seconded by Mr. Probst and carried. 6. From Col. W. H. Heuer, announcing a meeting in San Francisco for the purpose of providing rules and regulations governing anchorage grounds in San Francisco Bay. Referred to the City Manager. July 16 t h, 1918 . V 8. From the City Clerk presenting the petitions filed by the Public Utilities District League to the Council and stating that a sufficient number of qualified electors have signed said petition to call the election for the creation of the Public Utilities District. Mr. Probst thereupon introduced the following Resolution and moved its adoption: "Resolution No. 144. Directing the Clerk to Public Notice of Filing Petitions for the Incorporation of a Public Utility District, et cetera." Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 9 . Mr. Probst introduced the following Resolution and moved its adoption: "Resolution No. 145. Requesting the Immediate Removal of the Present Drawbridges Across the Estuary and Urging the Construction of a New Bascule Bridge. " Mr. Latham seconded the motion to adopt the Resolution and on roll call it was adopted and passed unanimously. 10. Mr. Probst moved that the City Manager invite W. G. McAdoo to view the bridges across the Estuary in an endeavor to have him use his influence to have these obstructions removed, and the new bascule bridge constructed, seconded by Mr. Latham and carried. 11. . Mr . Probst introduced the following Resolution and moved its adoption: "Resolution No. 146. Resolution of Intentnion No. 46, New Series. Providing for the Clsing of Eagle Avenue from Hibbard Street to Paru Street ; Eagle Avenue from Paru Street to a Point 354 Feet Westerly Thereof, and Paru Street from Buena Vista Avenue to the Northerly end of said Paru Street." Mr. Noy seconded the motion to ado of the Resolution and on roll call it was adopted and passed unanimously. V 12. A Bill entitled "A Bill For Ordinance No. New Series. An Ordinance Calling and Providing for A Special Election to be Held in the City of Alameda, on the 27th day of August, 1918 , for the Purpose of Submitting to the Quali— fied Electors of said City of Alameda, the proposition of the Incorporation and Organization of a Public Utilities District , under the Provisions of the Public Utilities District Act of 1915. " was introduced and laid over under a provision of the Charter . 13. A Bill entitled "A Bill For Ordinance No. New Series. Repealing Section 1 of Ordinance No. 94, New Series. " came up for passage. Mr. Probst moved that the Ordinance be adopted, seconded by Mr. Lathan and on roll call it was adopted and passed unanimously. 14. Mr. Probst moved that when the Council adjourned it adjourn to meet in adjourned regular meeting assembled Friday evening, July 26th, 1918, seconded by Mr. Latham and carried. 4 15. City Attorney St. Sure reported relative to the peddler' s license, instruction to change which were given him and he stated that the matter had been adjusted by removing the offender complained of. No further action on the matter was desired. 16. City Manager Hewes brought up the matter of the liquor licnese of W. W. Hopkins and stated that he investigated the same and recommended that the transfer from July 16th, 1918. 17. Relative to the purchase of Palm Beach, City Attorney St. Sure stated that the ordinance had not been prepared by him for the reason that adjustment of the financial matters had not been completed. 18 . City Manager Hewes stated th .t he had conferred with the Southern Pacific officials rear/tire to the improvement of their rights of way and they promised to attend to the matter as soon as possible. 19 . City Manager Hewes likewise spoke of the application of the De Luxe Transpor- tation Company for a permit and asked for more time, which was granted. ` 20. Mr. Lathan introduced the following Resolution and moved its adoption : "Resolution No. 147. Directing the City Attorney to file on Behalf of the City, the Petition before the Railroad Commission of the State of California Requesting said Railroad Commission to Rescind, Alter and Amend its Order and Decision No.5534. " Mr. Noy seconded the motion to adopt the Resolution and on roll call it was adopted and passed by the following vote :- Ayes : Councilmen Latham, Noy, and Probst, (3) . Noes-Council-president Majors, (1) . Absent :Councilman Otis, (1) . V 21. The City Manager called attention to the bill of the Times Star Company in the sum of $27.00, which was an increase on the contract price of ti 20 .50, and stated that the book was made at a loss to the Company and he felt that the former price was legitimate , Mr. Latham moved that the bill be paid, seconded by Mr. Probst and on roll call carried unanimously. 22, Claims against the Genera 1 Fund amounting to 01656.15; against the Police Fund amounting to 0166.70; against the Fire Fund amounting to 082.37; against the Health Fund amounting to 036. 65; against the Street Fund amounting to 5+ 1961.03; against the Relief Fund amounting to 4 55.00; against the Park Fund amounting to $4.00; against the Electric Light Fend amounting to < 1087 .25 and against the Store Fund amounting to 0348.47 having been approved and audited by the proper officials were listed by the Clerk as follows : GENERAL FUND.
