Resolution 16378 CITY OF ALAMEDA RESOLUTION NO. 16378 ACKNOWLEDGING ACCEPTANCE OF THE ALAMEDA FIRE DEPARTMENT’S ANNUAL REPORT ON COMPLIANCE WITH STATEǦMANDATED INSPECTIONS PURSUANT TO SECTIONS 13146.2, THROUGH 13146.4 OF THE CALIFORNIA HEALTH AND SAFETY CODE WHEREAS, California Health and Safety Code Sections 13146.2 and 13146.3 require local fire departments providing fire protection services to perform annual inspections of specific occupancy types, including public and private schools (E occupancies), institutional facilities (I occupancies), and residential occupancies such as hotels, motels, lodging houses, and apartment buildings containing three or more units (R occupancies); and WHEREAS, in 2018, the California Legislature enacted Senate Bill 1205 (SB 1205), adding Section 13146.4 to the Health and Safety Code, requiring each fire department to annually report to its administering authority on its level of compliance with the mandated inspections described in Sections 13146.2 and 13146.3; and WHEREAS, Section 13146.4 further requires that the administering authority, which for the City of Alameda is the City Council, formally acknowledge receipt of the annual inspection compliance report by resolution or similar official action; and WHEREAS, the purpose of SB 1205 is to ensure transparency and accountability in the performance of stateǦmandated fire and life safety inspections, particularly in occupancies where vulnerable populations reside or gather; and WHEREAS, the Alameda Fire Department has completed its annual review of mandated inspections for the 2025 reporting period and has reported that it completed 97 percent of required inspections for E occupancies, 100 percent of required inspections for I occupancies, and 90.63 percent of required inspections for R occupancies; and WHEREAS, the City Council has received and reviewed the Alameda Fire Department’s Annual SB 1205 Inspection Compliance Report for the 2025 reporting period; and WHEREAS, the City Council intends to acknowledge the Alameda Fire Department’s annual report in accordance with SB 1205 and the applicable provisions of the California Health and Safety Code. NOW, THERFORE, BE IT RESOLVED by the council of the City of Alameda hereby acknowledges receipt of the Alameda Fire Department’s Annual Report on Compliance with StateǦMandated Inspections for the 2025 reporting period, as required by California Health and Safety Code Sections 13146.2, 13146.3, and 13146.4; and BE IT FURTHER RESOLVED by the Council of the City of Alameda that this Resolution shall become effective immediately upon its adoption.              * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 7th day of April 2026, by the following vote to wit: AYES: Councilmembers Boller, Daysog, Jensen, Pryor and Mayor Ezzy Ashcraft – 5.
