CITY OF ALAMEDA RESOLUTION NO. 16383
RESCINDING RESOLUTION NO. 15517 (ELLIS ACT POLICY)
WHEREAS, the Ellis Act is a state law that addresses the rights of tenants when a
property owner decides to withdraw permanently rental units from the rental market or
demolishes rental units; and
WHEREAS, on April 2, 2019, the City Council adopted an Ellis Act Policy via a
resolution (Resolution 15517) as part of the establishment of just cause provisions in the Rent
Control Ordinance as it then existed; and
WHEREAS, the provisions of that Policy, with revisions, are now embodied in an
adopted Rent Program Regulation (26-01) and no longer need to be in a Policy adopted via a
resolution, for example, if the policy needs to be revised in the future, it is more expeditious to
amend the Regulation; and
WHEREAS, for those reasons, Resolution No. 15517 is no longer necessary to carry
out the intent and purposes of the Rent Control Ordinance and may be rescinded.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ALAMEDA as follows:
Section 1. Resolution No. 15517 concerning the Ellis Act Policy is rescinded.
Section 2. This Resolution shall take effect immediately upon its adoption.

City Council of the City of Alameda at a regular meeting on the 7th day of April 2026 by the
following vote:
AYES: Councilmembers, Daysog, Jensen, Pryor and Mayor
Ezzy Ashcraft – 4.
NOES: None.
ABSENT: Councilmember Boller - 1.
ABSTENTIONS: None.
