TUESDAY - - SEPTEMBER 17, 2002 - - 7:30 PM
(02 -436) Acting Mayor DeWitt convened the Regular Meeting at 7:33
p.m. in memory of Mayor Appezzato. Councilmember Johnson read a
statement from the Appezzato family. Councilmember Johnson led the
Pledge of Allegiance. Acting Mayor Dewitt called for a moment of
silence in memory of Mayor Appezzato. Bob Brown, Kathy Moehring,
Bruce Knopf, and Kelly Park sang an Alameda Anthem, written for
Mayor Appezzato's retirement, in honor of Mayor Appezzato.
ROLL CALL - Present: Councilmembers Daysog, Johnson, Kerr and
Acting Mayor DeWitt - 4.
Absent: None.
AGENDA CHANGES
(02 -437) Acting Mayor DeWitt announced that the recommendation to
accept Quarterly Financial Report [paragraph no. 02 -441], the
Public Hearing to consider adoption of Resolution Vacating a
Portion of Cypress Street Right -of -way East of Third Street
[paragraph no. 02 -445], the Public Hearing to consider an Appeal of
the Historical Advisory Board's decision [paragraph no. 02 -446],
and the Mayor's appointments to the Mayor's Committee on Disability
Issues [paragraph no. 02 -448] would be held over to the next
meeting.
PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS
(02 -438) Proclamation recognizing and commending Edwin Dankworth
for receiving the Daily Points of Light Award and for his service
to the community.
Acting Mayor DeWitt read the proclamation and presented it to Edwin
Dankworth.
(02 -439) Proclamation declaring the month of September as Alcohol
and Drug Addiction Recovery Month.
Acting Mayor DeWitt read the proclamation and presented it to
Barbara McClung, Xanthos, Inc.
Ms. McClung thanked Council for the proclamation and invited
Council to attend the bowl -a -thou on Friday, September 20, 2002 to
fund drug and alcohol diversion programs for youth and teens.
CONSENT CALENDAR
Acting Mayor DeWitt announced that the Recommendation to accept
Quarterly Financial Report for period ending June 30, 2002 would be

held over to the next meeting.
Councilmember Kerr moved approval of the remainder of the Consent
Calendar.
Councilmember Daysog seconded the motion, which carried by
unanimous voice vote - 4.

( *02 -440) Minutes of the Regular City Council Meeting held on
September 3, 2002 and the Special Joint City Council and Alameda
Reuse and Redevelopment Authority Meeting held on September 4,
2002. Approved.
(02 -441) Recommendation to accept Quarterly Financial Report for
period ending June 30, 2002 (Year -End) and authorize supplemental
appropriations and carry -over of year -end balance. Held over.
( *02 -442) Recommendation to award contract in the amount of
$192,000 to Mike Brown Electric Company for Traffic Signal
Improvements at Main and Pacific and Webster and Atlantic Project,
No. P.W. 07- 01 -21. Accepted.
( *02 -443) Introduction of Urgency Ordinance Adopting Ordinance No.
Which Repeals and Replaces Chapter XXI (Solid Waste and
Recycling) of the Alameda Municipal Code and Making Said Ordinance
Effective on October 6, 2002. Introduced.
( *02 -443A) Introduction of Ordinance Amending the Alameda Municipal
Code by Repealing and Replacing Chapter XXI (Solid Waste and
Recycling). Introduced.
( *02 -444) Ratified bills in the amount of 1,321,897.34.
REGULAR AGENDA ITEMS
(02 -445) Public Hearing to consider adoption of Resolution
Vacating a Portion of Cypress Street Right -of -way East of Third
Street. Held over.
(02 -446) Public Hearing to consider an Appeal of the Historical
Advisory Board's decision to deny a certificate to allow the
demolition of a residence, damaged by fire, listed within the
City's Historical Buildings' Study List; and adoption of related
Resolution. The residence is located at 1525 Minturn Street within
an R -5 Residential Zoning District. Applicant /Appellant: Will

(02 -447) Public Hearing to consider an Appeal of the Planning
Board's decision approving Variance, V01 -0015, to permit the
installation of a 16 -foot wide driveway to be located at the rear
of the corner lot and accessed from Third Street, where Alameda
Municipal Code Subsection 30- 5.7(i) precludes a 16 -foot wide
driveway, and Major Design Review, DR01 -0098 for the construction
of a two -story duplex with four off - street parking spaces; and
adoption of related Resolution. The property is located at 301
Spruce Street within the R -4, Neighborhood Residential Zoning
District. Applicant: Hinh Nguyen. Appellant: Patrick G. Lynch and
Jeanne Nader.
The Public Hearing was not held due to the Applicant withdrawing
the application for a Variance and Major Design Review.
ORAL COMMUNICATIONS, NON- AGENDA
None.
COUNCIL COMMUNICATIONS
(02 -448) Consideration of Mayor's appointments to the Mayor's
Committee on Disability Issues. Held over.
(02 -449) Acting Mayor DeWitt announced that Memorial Services for
Mayor Appezzato would be held on Saturday, September 21St at 10:00
a.m. on board the U.S.S. Hornet.
Acting Mayor DeWitt announced that he is honored to serve as Acting
Mayor in absence of Mayor Appezzato and that no action is required
by Council for him to serve in such capacity.
Councilmember Kerr noted that she concurred with Acting Mayor
DeWitt serving as Acting Mayor.
ADJOURNMENT
There being no further business, Acting Mayor DeWitt adjourned the
Regular Meeting at 7:52 p.m.
