2003-11-04 Special CC CS MinutesMINUTES OF THE SPECIAL CITY COUNCIL MEETING TUESDAY- - NOVEMBER 4, 2003- -6:10 P.M. Mayor Johnson convened the Special Meeting at 6:15 p.m. Roll Call - Present: Councilmembers Daysog, Gilmore, Kerr, Matarrese and Mayor Johnson - 5. Note: Councilmember Matarrese was present via teleconference. Absent: None. Public Comment Barry Luboviski, Building Trades Council, stated the Building Trades Council has raised issues regarding prevailing wages statewide over the past ten years; the City of Long Beach v. Department of Industrial Relations (DIR) case is being appealed to the Supreme Court; the Trades Council is taking the issue to each of the Charter cities in the State; the cities of Hayward, San Leandro, Berkeley and Oakland have all adopted resolutions supporting prevailing wage; urged the Alameda City Council to write a letter expressing the position; stated essential issue is whether the State can compel Charter cities to utilize prevailing wage on municipal projects; when an issue is of statewide concern, it is under the State's purview; there are sufficient findings for the City to make a determination that prevailing wage is a statewide concern; the legislature passed a resolution with bipartisan support; the court decision makes a detailed argument for why the issue is of statewide concern; discussed the advantages of prevailing wages. Mike Dunlap, Operating Engineers Local #3, stated prevailing wage guarantees a certain level of income for workers and allows the benefit of known capability; prevailing wage is a statewide issue. Matt Maloon, International Brotherhood of Electric Workers 595, stated prevailing wage is important to working families because it provides a level playfield and is a better value. The Special Meeting was adjourned to Closed Session to consider: (03 -485) Conference with Legal Counsel - Existing Litigation; Name of case: City of Long Beach v. Department of Industrial Relations. (03 -486) Conference with Legal Counsel - Existing Litigation; Name of case: Broauedis v. Citv of Alameda. Special Meeting Alameda City Council 1 November 4, 2003 Following the Closed Session, the Special Meeting was reconvened and Mayor Johnson announced that regarding City of Long Beach v. Department of Industrial Relations, the City Council rescinded its prior closed session action of October 21, 2003; and regarding Broquedis v. City of Alameda, the Council gave instructions to the City Attorney.
