Mayor Appezzato convened the Regular Meeting at 8:25 p.m.
ROLL CALL - Present: Councilmembers Daysog, DeWitt, Johnson,
Kerr and Mayor Appezzato - 5.
Absent: None.
AGENDA CHANGES
(00 -158) Mayor Appezzato announced that the recommendation
regarding the Community Development Block Grant Action Plan
[paragraph no. 00 -172] would be held over to April 18; and the
Ordinances setting mandatory sentencing and penalties for Alameda
Housing Code Violations [paragraph no 00 -173] were withdrawn to
allow Councilmember Johnson to review the matter with the City
Attorney; stated anyone interested in the Ordinances should contact
Councilmember Johnson or the City Attorney.
PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS
(00 -159) Mayor Appezzato presented a Proclamation to Martha
Burkard for winning the San Francisco City Golf Championship.
Norma Arnerich, Junior Golf Program, congratulated Martha Burkard
on her championship; recognized other members of Junior Golf who
participated in the Golf Tournament: Ki Shui Liao, Mika Takayama,
Mike Schmity, Doug Yi, Keith Liao, and Jon Burkard; and announced
portions of the Tournament would be shown on CNN Television
Network.
CONSENT CALENDAR
Mayor Appezzato announced that the Resolution Supporting the Bus
Riders' Bill of Rights [paragraph no. 00 -166] was removed from the
Consent Calender for discussion.
Councilmember Johnson moved approval of the remainder of the
Consent Calender.
Councilmember Kerr seconded the motion, which carried by unanimous
voice vote - 5. [Items so enacted or adopted are indicated by an
asterisk preceding the paragraph number.]
( *00 -160) Minutes of the Special and Regular City Council Meetings
held on March 21,2000, the Special Joint City Council and Community
Improvement Commission Meeting held on March 21, 2000, and the

( *00 -161) Recommendation to waive Housing Authority Payment in Lieu
of Taxes for Fiscal Year 2000 -01. Accepted.
( *00 -162) Recommendation to accept the Ad Hoc Homeownership
Committee Recommendations from the Housing Commission, Planning
Board, and Economic Development Commission. Accepted.
( *00 -163) Recommendation to allocate funds, adopt Plans and
Specifications, and authorize Calling for Bids for the Repair of
Portland Cement Concrete Sidewalk, Curb, Gutter and Driveway, No.
P.W. 01- 00 -02. Accepted.
( *00 -164) Recommendation to adopt Plans and Specifications,
authorize Calling for Bids, and authorize the City Manager to enter
into all Agreements for award of the Construction Contract for
Phase 1, Buildings 11 and 400A, Roof Repair and Fire Sprinkler
Change out Project, No. P.W. 01- 00 -01. Accepted.
( *00 -165) Recommendation to award Contract in the amount of
$214,700 to Tennyson Electric, Inc., for Signal Installation at
Atlantic Avenue /Challenger Drive and Marina Village
Parkway /Challenger Drive, No. P.W. 06- 99 -17. Accepted.
(00 -166) Resolution No. 13201, "Supporting the Bus Riders' Bill of
Rights." Adopted.
Richard Neveln, Member, Public Transit Committee, stated the Bill
of Rights for bus riders makes good sense; urged Council to adopt
the Resolution.
Julian Frederick stated there are 230,000 bus riders in Alameda
County and 8,000 in the City of Alameda; the Bill of Rights has
been endorsed by: Congresswoman Barbara Lee, Alameda County Board
of Supervisors, and the Cities of Berkeley and Oakland; a healthy
community requires a healthy transit system; the ideas in the Bill
of Rights must be put into action; if A.C. Transit adopts the Bill
of Rights, it would be the first acknowledgment of Bus Rider's
Rights in the United States; urged Council to adopt the Resolution.
Allan Shore, Member, Public Transmit Committee, thanked the City
Council for forming the Public Transit Committee; stated the
Committee has increased the community's interest regarding the
public transit issue.
Mayor Appezzato stated transit is on the minds of everyone,
including the Governor; recognized Alice Creason, Alameda's
Representative on the A.C. Transit Board of Directors.

Alice Creason, A.C. Transit Board of Directors, stated that she
supports the Bus Riders' Bill of Rights; A.C. Transit will do
everything to implement the goals.
Councilmember Johnson stated that she and Councilmember DeWitt
serve on the Public Transit Committee; thanked Alice Creason for
participating and assisting with the Committee.
Councilmember DeWitt stated the Public Transit Committee will work
to increase bus service and make public transit more popular than
cars.
Councilmember Johnson moved adoption of the Resolution.
Councilmember DeWitt seconded the motion.
Councilmember Kerr stated bus drivers are always willing to lower
the lift or kneel [mechanism] on the bus upon request, however,
half of the time the [lift] mechanics do not work.
On the call for the question, the motion carried by unanimous voice
vote - 5.
( *00 -167) Resolution No. 13202, "Authorizing the City Manager to
Submit a Three -Year Grant Application for Sixth Cycle Used Oil
Recycling Block Grant Funds (FY 2000 -03) to the California
Integrated Waste Management Board and Execute All Necessary
Applications, Contract Payment Requests, Agreements and
Amendments." Adopted.
( *00 -168) Resolution No. 13203, "Authorizing an Exchange of Funds
from TEA 21 (Transportation Equity Act for the Twenty -first
Century) STP /CMAQ (Surface Transportation Program /Congestion
Mitigation and Air Quality Program) to Unused County Share of ISTEA
(Intermodal Surface Transportation), TEA and Proposition 116 Funds
for Harbor Bay Express II Repair Project and Approving Conditions
of Use of Harbor Bay Express II Settlement Money." Adopted.
( *00 -169) Resolution No. 13204, "Consenting to and Calling a Joint
Public Hearing on the Proposed Amendment to the Community
Improvement Plan for the Business and Waterfront Improvement
Project." Adopted.
( *00 -170) Ratified bills in the amount of $1,414,478.04.
REGULAR AGENDA ITEMS
(00 -171) Resolution No. 13205, "Appointing Bruce C. Reeves as a
Member of the City Recreation and Park Commission." Adopted.
Councilmember DeWitt moved adoption of the Resolution.

Councilmember Johnson seconded the motion, which carried by
unanimous voice vote - 5.
The City Clerk gave the Oath of Office and presented a Certificate
of Appointment to Mr. Reeves.
(00 -172) Recommendation to adopt FY 2000 -01 through FY 2004 -05
Five Year Strategic Plan; FY 2000 -01 Community Development Block
Grant Action Plan; Amendment No. 2 to FY 1999 -00 Community
Development Block Grant Action Plan; and authorize execution of
Related Documents, Modifications and Agreements; and
(00 -172A) Recommendation regarding Community Development Block
Grant FY 2000 -01 Public Service Funding Allocations.
Held over to the April 18, 2000 Regular City Council Meeting.
(00 -173) Introduction of Ordinance Amending the Alameda Municipal
Code by Amending Subsection 1 -5.1 (Misdemeanors; Infractions;
General Penalties; Continuing Violations) of Section 1 -5 (Penalty
Provisions Enforcement), of Chapter I (General), to Set Mandatory
Sentencing Guidelines for Specific Violations; and
(00 -173A) Introduction of Ordinance Amending the Alameda Municipal
Code by Amending Section 13 -7 (Alameda Housing Code) by Adding
Subsection 13 -7.4 (Mandatory Minimum Penalty Provisions) to set
Mandatory Civil Penalties for Alameda Housing Code Violations.
Withdrawn.
(00 -174) Powerpoint Presentation by Alameda County Transportation
Authority on Measure B Reauthorization Expenditure Plan; and
(00 -174A) Resolution No. 13206, "Approving the Alameda County 20-
Year Transportation Expenditure Plan." Adopted.
Mayor Appezzato read a Metropolitan Transportation Commission Press
Release: "If you think your ride to work is bumpy today, just wait;
over the Next 20 years, the San Francisco Bay Area is projected to
run short of funding for its local streets and roads to the tune of
$5.6 Billion, with $2.3 Billion of this amount specifically
shortchanging pavement upkeep and repair, the rest affecting
traffic signals, road signs, storm drains, rehab of local bridges
and overpasses and the like;" stated Measure B Reauthorization will
be on the November Ballot; the Steering Committee voted unanimously
to support the Reauthorization; all of the jurisdictions in the
County and all environmental groups support the Measure; a 2/3 vote
of the citizens in Alameda County is needed to pass the Measure.

Authority, gave a presentation outlining the goals and projects
related to Measure B Reauthorization.
Richard Neveln, Alameda, stated bus services to Alameda Point
should be expanded; A.C. Transit will consider expanding said
service at its next meeting; Measure B funding is needed to
continue to increase bus service.
Jon Spangler, Alameda, stated Measure B funding is needed to
install another bike rack at City Hall; alternative modes of
transportation should be actively encouraged in Alameda.
Dan Wood, Alameda, stated it is better to pay the half -cent sales
tax increase, than to pay the increased gas price; urged Council
and Alameda County residents to support the Measure.
Jeff Hobson, Bay Area Transportation and Land Use Coalition,
submitted a Press Release; stated the Coalition is comprised of
over 60 environmental and public interest groups throughout the Bay
Area; on behalf of the Coalition, urged adoption of the Resolution;
further stated groups within the Coalition opposed the last [1998]
Plan, however, the Coalition unanimously supports the new Plan;
thanked Mayor Appezzato for his work on the Steering Committee;
stated the Plan includes crucial funding for bus services; urged
individuals interested in supporting the Measure B Campaign to
contact him.
William Smith, Sierra Club, stated that the Sierra Club supports
the Plan; automobile traffic will continue to become less
convenient over the years; if the County invests in mass transit,
it will become more convenient [than cars].
Allan Shore, Alameda, stated Measure B takes control of transit
issues out of the hands of politicians; there is an Oversight
Committee and a spread of power throughout the cities in Alameda
County; the City of Alameda should implement public transit systems
which are not in use yet.
Doug Linney, Alameda, stated Measure B is not a new tax; voters
turned down the Measure in 1998; however, November will be the last
opportunity to pass the Measure prior to funds running out; there
is broad support for the Plan.
Alice Creason, A.C. Transit Board of Directors, urged support of
the Measure, which is critical to Alameda; stated with the
development of Alameda Point, the City of Alameda will need more
transit to keep the community vital and have mobility for citizens.
Vice Mayor Daysog stated the City of Alameda should push for the
Measure.

Councilmember DeWitt stated without Measure B funds there will not
be funding to fix potholes.
Councilmember Johnson thanked Mayor Appezzato for his work on the
Plan.
Councilmember Johnson moved adoption of the Resolution.
Councilmember Kerr seconded the motion, which carried by unanimous
voice vote - 5.
ORAL COMMUNICATIONS, NON- AGENDA
(00 -175) Bill Smith commented on unsanitary living conditions.
COUNCIL COMMUNICATIONS
(00 -176) Mayor Appezzato requested information on the matter of
rabbit row [at the City's Animal Shelter]; suggested the Humane
Society be involved with resolving the matter.
(00 -177) Mayor Appezzato stated that he received a letter from
Arter and Hadden, Attorneys at Law, requesting the City support new
legislation regarding the Airport; requested the City Attorney to
review said legislation; further stated if passed, the legislation
will provide a $500 State income tax credit for homeowners living
in areas where noise levels exceed 65 decibels.
(00 -178) Mayor Appezzato announced that the dog park will be
finished soon and the grand opening is tentatively scheduled for
May 13, 2000.
(00 -179) Mayor Appezzato announced that he received a letter from
Harry Yahata, District Director of CalTrans; seismic retrofit of
Posey and Webster Tubes is going to begin; a map display will be
held on April 12, 2000 from 5:00 to 8:00 p.m. at the Chipman School
Multipurpose Room; the informal map display will show project
details, tube construction, closure schedules, temporary
construction easements, etc., and CalTrans staff will be present to
answer questions.
(00 -180) Councilmember Kerr stated that she visited CalTrans in
Oakland to view map displays; graphics show how cross sections of
the Tube would rise in a seismic event due to liquefaction of soil;
urged the public to view the maps on April 12; further stated
photographs are displayed on her website.
(00 -181) Councilmember Johnson stated AC Transit will consider
expansion of certain [bus] services in Alameda at an upcoming

meeting; requested a letter supporting expansion of [bus] services
be placed on the next City Council Agenda.
ADJOURNMENT
There being no further business, Mayor Appezzato adjourned the
Regular Meeting at 9:30 p.m.
