REUSE AND REDEVELOPMENT AUTHORITY MEETING
TUESDAY- - NOVEMBER 21, 2000- -5:45 P.M.
Mayor /Chair Appezzato convened the Special Joint Meeting at 5:50
p.m.
Roll Call - Present: Councilmembers /Commissioners /Board
Members Daysog, DeWitt, Johnson, Kerr and
Mayor Appezzato - 5.
Absent: None.
Public Comment
Marti Buxton, Vice President, Acquisitions and Entitlements,
Catellus Development Corporation, stated Catellus agrees with the
language provided to Council by staff; one point which is not on
the term sheet is Catellus will pay some of Renewed Hope and ARC
Ecology's legal fees; the number has not been negotiated, but there
will be no cost to the City; language from the petitions today
indicates both parties are substantively in agreement; the final
agreement is scheduled to come before the Council on December 19;
according to the settlement, the language is to be agreed upon by
December 8; Catellus is committed to work with the City and the
petitioners to reach an agreement.
In response to Mayor /Chair Appezzato's inquiry whether the language
can be ready by the deadline, Ms. Buxton responded in the
affirmative.
Ms. Buxton further stated that hopefully, this will be a new
beginning with housing advocates.
Councilmember /Commissioner Kerr inquired how it was decided that
Catellus would pay some legal fees to ARC Ecology.
Ms. Buxton responded the matter came up at last minute.
The Assistant City Manager, Community and Economic Development,
noted the Judge raised the issue.
Ms. Buxton stated the hours and rate quoted are not realistic;
Scott Allen has worked 300 hours and his rate is $300; Mike Rusin
has only worked 100 hours and his rate is $350; if an agreement is
not reached, the Judge will determine an amount which Catellus will
pay; the Judge believes the City of Alameda is going above and

beyond and even got the petitioners to admit the City is being very
generous.
Mayor /Chair Appezzato adjourned the Special Joint Meeting to Closed
Session to consider:
(CC 00 -629) (CIC 00 -52) Conference with Legal Counsel - Existing
Litigation; Name of Case: Renewed Hope Housing Advocates and ARC
Ecology v. City of Alameda, Community Improvement Commission, and
Alameda Reuse and Redevelopment Authority.
Following the Closed Session, the Special Joint Meeting was
reconvened and Mayor /Chair Appezzato announced that instructions
were given to the City Attorney /Legal Counsel.
Adjournment
There being no further business, the Special Joint Meeting was
adjourned at 6:15 p.m.
