ADJUSTING THE POLICE AND FIRE FEE REQUIREMENTS
AS REQUIRED BY SUBSECTEON 27 -2
(POLICE AND FIRE FEE REQUIREMENTS)
OF CHAPTER XXVII (DEVELOPMENT FEES)
OF THE ALAMEDA MUNICIPAL CODE
WHEREAS, the Alameda Municipal Code, subsection 27- 2.4(b)
requires that the City Council conduct an annual review of the
Police and Fire Impact Fees to determine whether the fees are
reasonably related to the impacts of new construction or whether
the fees are still needed; and
WHEREAS, the City Council of the City of Alameda
concludes that the Police and Fire Impact Fees are still necessary
because of continued construction in the City of Alameda with
approximately an additional 16.334 million square feet of new
construction; and
WHEREAS, the cost for communications equipment has been
increased from $450,000 to $1 million dollars, the cost for a c)
training facility has been increased from $400,000 to $816,000, and
the cost of ambulances has been increased from $65,000 to $85,000 °<
for each unit which is a total increase of $996,000; and
WHEREAS, Alameda Municipal Code section 27- 2.2(d) imposes o
only "some of the costs of the increased burden" directly upon A
sponsors of development and indirectly upon the occupiers of the
new construction; and
WHEREAS, the sponsors of new development shall pay
.25107559 percent of the total costs set forth above ($1,816,000 x
.25107559) or a total of $250,071, which shall be assessed by an
increase in the total Police and Fire Impact Fees by 1.5 cents for
each square foot of new development; and
WHEREAS, such fees will not be imposed upon sponsors of
development who have filed a completed application for a vesting
tentative map or parcel map on the effective date of this
resolution; and
WHEREAS, the increased fee shall be imposed on all other
development at the time of issuance of the building permit, and
collected pursuant to the applicable provisions of the Alameda
Municipal Code; and
WHEREAS, in increasing the Police and Fire Impact Fee,
the City Council has considered the effect on construction costs,
hardships related to special types of development so far as may be
contemplated at this time and legal issues.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that:
1. The Police and Fire Impact Fees are hereby increased
by 1.5 cents for each square foot of new construction, for a total
Police and Fire Impact Fee of 15.5 cents for each square foot of
new construction; and
2. The increase in fees set forth herein shall not
apply to vesting tentative tract or parcel maps for which a
complete application has been accepted on the effective date of
this resolution; and
3. All other developments shall be assessed the fee at
the time of issuance of the building permit, and the fee shall be
paid at the time of issuance of a Certificate of Occupancy or final
inspection, whichever shall first occur.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 7th
day of February , 1995, by the following vote to wit:
